GinoNiña reacted to SalishSea in Daunted by the K-1/CR1 decision. Help!
So does filing a fiance visa petition without being completely sure.  After all, it does require intent to marry.  It is not a "try it out and see" type of deal.

GinoNiña reacted to RO_AH in How does a US Citizen Marry a Filipina in the Philippines
Here is what I posted the other day. I got married there so this is first hand:

Getting married there is not as daunting as it seems. Here are my main suggestions.
    1. Have her go to her LCR and ask what are the requirements to marry an American in the Philippines. The reason is that it does vary depending on where she lives. Every LCR has some different policies. Make sure she writes down every requirement and then read it back to verify. The reason for this is things are not very detail oriented there. You do not want to miss any requirements.
    2. One requirement in all of the Philippines is that it takes 10 business days to get a marriage license. Plan on a 3 week trip since it will take 14 days to get your license. Even more if there is a holiday so make sure you know the Philippines holidays.
    3. Last make sure she asks if there is an expedite process for your PSA marriage certificate. That will make it faster to apply for the CR1. If you do not ask, and pay the expedite fee it may take 6 months or so to get your official marriage certificate.

Your other option is an online Utah wedding. They are the only state that allows and has a process for online weddings. You can do this while you are together there or with you in USA and her in PH. You will need to be together in person during or after the wedding for you to be able to file for the CR-1

Now with that said, I am not sure all of the requirements for an online Utah wedding but if you search this forum for Utah wedding, you should find all that you need fairly easy as it has been discussed at length on this forum. If you do not have things like your birth certificate, do you at least have someone at home that can retrieve them and scan them to you?.

There is Philippine Airlines unaccompanied minor page.  https://www.philippineairlines.com/en/before-you-fly/special-needs-and-request/unaccompanied-minors  We flew our daughter from LAX TO the Manila unacompanied at age 10 last summer so she could stay with grandma and visit her cousins while school was out.  Philippine Airlines handled it very well and we felt she was in good hands for the trip so I would recommend them for an unaccompanied minor.

Tell her stop watching YouTube videos, Facebook groups etc. I don't know if I will catch flack for this but Filipinos love to go out of their way to find things to worry about.

The other thing that is real in the Philippines is they "they said" culture. You will hear the strangest things you can imagine and ask where they heard that from. The answer is...They said. Who is this "they"? You can't let a baby get a drop of rain on them but you can give them a bath. You can't eat watermelon after a c section or your wound will open up. I have really considered writing a book and calling it, they said.
Stick to these forums whee you will get accurate information.

Don't you let her pull you into this. You need to be the voice of reason.

GinoNiña reacted to top_secret in DHL, FedEx, or UPS for Documents to Philippines?
If you are in a US city that has a LBC office then that is by far the best option.  It costs us like $12 and gets delivered in like 4 or 5 days with full tracking.  If you are not in a US city that has a LBC office, I would probably go with DHL.  I previously had a poor experience with UPS in the Philippines and probably won't try them again.  I haven't personally tried FedEx there so no real opinion good or bad.

Just photos is likely not enough as evidence.

Since you filed AOS, what other evidence did you accumulate?

This may include bank statements from a joint account you opened, lease agreements listing both names, airline boarding passes showing trips together somewhere, health insurance policy showing both names, bills for utilities in both names or phone plans showing both names etc. If DL / ID was obtained by immigrant, include copies of it and US citizen spouse ID showing same address. If you married after coming on K-1, you should include marriage certificate. Also, may include venue or restaurant reservation for celebrating the marriage, letters from friends and family addressed to both of you congratulating on marrying.

As to photos, you need to edit them in word. Add 3 photos per page and caption them: date, event, place, who's on photos. The most valuable pictures are of you with family and friends, colleagues. Photos of just two of you are pretty low in value. You can print those in B&W as long as it's easy to see who's on the photos.

Yes! I have included G-1145 form, I made sure it is located on the top of all the forms. And sent the package to chicago lockbox for WA State residence.
my wife has ssn prior to  submitting forms but needs the i-765 approval so she can work.

Ours took a while too - keep waiting for now! I think depending on where the application is processing, the time to biometric scheduling is variable. We still don’t have one scheduled and they got our application on October 6 (mailed to the Chicago lockbox)

GinoNiña reacted to IWander in when to follow up K2?
The only restriction is that the Visa must be issued within one year of the K1, other than that you may apply when ready.  The starting point is the DS160.

GinoNiña reacted to smashtic in October 2023 - AOS Filers
I filed concurrently which I read was recommended since it saves the fee and the USCIS officers separate them anyway and process separately. In our case they took the packet and sent us separate NOA1 numbers for each of the forms.

You  filed I-765 with the 485? I read somewhere to wait for 485 receipt and then turn  in 765 with receipt from 485.

if you go to  SLEC website. they give you a  flow chart. First thing is to check in and pay the fee at the front desk. Most  of us paid at the hospital.
Make sure to schedule  your medical within 1 or 2  weeks prior to your interview day.

An update for everyone. They recently changed the CFO process so that you cannot even schedule it until AFTER you have your fiance visa in hand, so no more scheduling in advance and , of course, theres a waiting list for the CFO as well so now its going to take even longer to be seperated from your loved ones. Someone correct me if Im wrong about this.

GinoNiña reacted to powerpuff in Status after K1, but before approved I-485
Topic moved from K1 forum to Moving to America forum where DL issues are discussed.

Technically, they do not have a status but a pending I-485 grants them an authorized stay until it is adjudicated.

Many states do not issue IDs or DLs based on a pending I-485. You will have to wait until EAD or GC to apply.

GinoNiña reacted to Mike E in Filing for SSN before or after marriage, K1
In general best results occur when you apply for an SSN:

    * 2-10 working days after before date of entry, and
    * before marriage

As @Ontarkie frequently points out, the SSA policy memo says a K-1  fiance(e)  is eligible to file for an SSN.

Some SS workers interpret this to mean that a  married K-1 is not eligible for an SSN.

Had no problems at all with only one complete working day between 2nd day of medical and the interview.

All information is sent electronically - you do not carry anything physically to USEM from SLEC.
