    An update on this topic. Today I see the case status shows- the I-485 was approved. So I believe the mother should receive her green card in mail soon. So apparently the check they wanted to do did not take much time. Thank you all.

    Happy New Year everyone -
    Here it is one year to the date of my receipt date and no approval, no nothing.  just waiting.  Am praying USCIS finds my case again and processes it!  Happy for you all, but must admit I'm a bit jealous (and getting depressed).  My inquiry just sends me back the standard - we are working on it and will let you know.  Not very helpful.  Sorry for the rant.  Feeling a bit down after the holidays and a whole year gone by with nothing

    Good to know that good amount of visas are getting issued from last couple of months. But, I fail to understand one thing. If categories don't matter post DQ then why people over here post category related separate threads? For e.g. if I gets DQued on Dec 2020, F2b then is it possible any immigrant applicant( DQued after me) get IL? Thanks

    Yes, at least until the K-1 parent naturalizes. Before that daughter's marriage would kill an F2B petition, after naturalization that'd drop it into F3.

    Hi all,
     
    I have another complex question for you...
     
    If my (Indian) fiancé and I decided to go the route of K1 visa, keep in mind he has a stable employment in India, would he be able to leave US after we marry under the K1 visa (so that he can return to work) and then we file for a CR1 after? I know that in order for him to file the adjustment of status he has to remain in the US but we are trying to figure out how to navigate this without him having to quit his job for the duration of time it takes for these processes to complete. The intent is that when he returns to the US, he will be transferring his job from the Chennai office to the US office (we work for a global company, and met/committed while he was still here in the US on F1).
     
    Have any of you heard of anyone trying this before? Is this something that would raise red flags?
     
    We know that it may take more time but at the this point, the only reason we are looking adopt this option is because of the time and difficulties it takes to get married under the Special Marriage Act in India and complications/inconsistencies therein. It would be difficult for me to reside in India for more than a month due to my own obligations here in the US. Granted, if I have to then we'll just have to work something out...but it is not ideal.
     
    Any insight  is greatly appreciated.

    I think we should be fine with the rest of our package then, as we went to school together and lived in the same neighborhood in the US until April 2020, and we have met with each other's family multiple times between 2018 and 2020. Then we met again in my country in Nov 2021 and got engaged. Photos, boarding passes, trips, etc. everything is pretty well recorded! 

    Thanks a lot for your good wishes! This whole process is mentally challenging for a control freak like me, and it helps to get support from you all!

    We always had a floating wedding date and planned throughout the entire process. Some say it's impossible to have a ''real wedding'' in the timeframe that you're given. That's not really true, but it is incredibly difficult to do and you have to be willing to sacrifice a bit on how you define ''real wedding". I did not actually book a wedding date with my vendor until my husband had his visa. They were willing to work with me under a short timeframe. Some other vendors were very understanding and willing to accommodate us, others were not. This is a marriage just starting, and no one should be under such intense pressure to 'perform' or 'conform' to others expectations - that goes for vendors AND family members. We did indeed have a small wedding just as we intended and a reception dinner afterwards, and we had a great photographer.. but it was difficult and stressful. I got the flowers, designed the decorations, and did everything. At some point we thought of just eloping to a courthouse. The larger you make the wedding and have others involved the more difficult it will be. For those planning bigger things, perhaps keep in mind you generally have 6 months or so to enter after the visa is obtained, that should have given someone enough time to plan out something pretty great I'd think.

    The answer would change in a week anyway, just like she went from being 3 months pregnant bankrolled by a somewhat rich by some standards daddy to being 6 months pregnant funded by her own business 
     
    but yes good point on the baby not being able to have a checking account, I don’t think even debit cards on savings accounts are allowed until age 13.

    In a previous life, I was a manager in my home country with members of my team being from all over the world. I received a phone call late on a Wednesday night from the wife of one of my team who was currently offshore on an oil rig in the middle of the North Sea. She was calling me to say she had just been called by the USCIS to say that her husband’s oath ceremony had been scheduled for the coming Friday. He had been waiting 2 years for this. There was no way he was going to postpone.
     
    It then took a logistical miracle to arrange for a helicopter to divert to the oil rig on which he was on to bring him back to Aberdeen very early the next morning (Thursday). From the heliport, he run to the international airport next door  and got on a early morning flight to London then onwards to New Orleans. 
     
    He was back in Aberdeen by Tuesday afternoon after getting his passport expedited and back offshore by Thursday. No rest for the wicked. 
     
    Sorry I don’t have that power anymore to arrange for a helicopter for your wife but thought I’d share the story…

    We had a similar issue. We actually planned out a full wedding in India thinking we would do the CR1 and then covid hit. I applied for the K1 because I wasn't sure which would come faster. His family really wanted the CR1 so that they could have a massive wedding and invite all their friends/family, etc. Obviously that didn't end up working out and K1 was the best for us. However, the K1 process was exhausting imo. The embassy kept opening and closing, visa priorities kept changing, etc. We made the executive decision to keep the big wedding out of the picture until he could come to the US. Were our families happy? Nope, but we needed it for our mental peace. To be honest, the court wedding date kept changing too 😂 When he finally came, we went to Vegas with immediate family and a couple of friends and enjoyed that celebration. Came home and turned in all the paperwork, got him added to the health insurance, banks, etc. Then we planned the big party. We still haven't had the reception since his parents couldn't come from India, but the religious ceremonies are all done. This is the best way imo with this process. Families just won't get it and honestly, if you want the responsibility of marriage, you need to do what's best for you
     
    Editing to add that I personally think you're making a big mistake in gambling timelines like that for the big party. Keep an eye out for the fact that there is a new covid variant on the horizon. Hopefully it works out, but one thing I learned in this process, is that initial application was a big gamble on its own

    I have filed my I129f on March 4th of 2021. Now the USCIS site shows approval given up to April 4th. However, I did not get any approval.
    I called the USICS in August and enquired about the case. They suggested to apply for expedited processing. I thought some extra fee and agreed. Two days later, without asking any supporting documents, they rejected my expedite request. 
    Is it the reason for the delay in my case? I mean last action taken is showing as August 10 - rejected expedite action. Now my next action may be months later only? Is there any such rule?

    You are just starting this process and it is very invasive
    u will disclose all personal and private information including financial and criminal for the petition and then at the interview 
    it gets very intense for the AOS adjustment after marriage so be prepared to "tell all"
    they don't make it easy or cheap or fast so you just have to get use to 'hurry up and wait"
     
    The process and disclosures are for not only your protection and our country but for the protection of the intending immigrant 
    and all charges should be disclosed on the petition by u so the RFE doesn't hit u in the face like it has now
    and no charge is totally irrelevant to the immigration process / remember the officer doing your paperwork is as much responsible for what is included in your packet as you are and only doing the job as assigned 
     
    it gets a lot more intense as you go along so prepare yourself and just do whatever they say or ask u to do
    Immigration is  in control and that is probably the hardest part to understand as we like to be "in control" of our own life

    Good morning,
     
    I have had the displeasure of "working with" USCIS since I applied for a K1 in January. We were told July, then October, then finally November—imagine that, the government lying. At any rate, when we did hear back, it was to request additional information on a reckless-driving charge from seven years ago.
     
    Am I stupid, or is this totally irrelevant? What are they going to do, rescind my American-ness? Deport me from America TO MY NATIVE AMERICA? Why exactly would they waste both of our times investigating this dastardly misdemeanor when they're backlogged with cases and I would like my fiancée to come over? Why have they not responded two weeks later when it takes even a semi-literate person 15 minutes to run a background check? "Ma'am, there's something you should know before coming over. Your fiancé sucks at driving"
     
    Is this whole procedure sadistic, or merely idiotic, or both?

    Do you have proof of this? What is she going to do if she is denied entry? Also, she will probably need to be fully vaccinated to apply for AOS. It's better to reschedule the flight

    Agreed but s/normal tourist visa/normal tourist e-visa/
     
    I once had an Indian consulate take over 2 months to issue a paper visa.  I had to cancel my Sunday flight to India,   fly to the consulate on Saturday, and book a new flight ins different airline out of the consulate’s city to India.  I can’t imagine a scenario where I would apply for paper visa from India again when a 5 year e-visa is faster, simpler, and when including FedEx fees, cheaper.

    Sorry to break it to you, but as a US Citizen, you're American now. You will be considered a tourist back to India as weird as it sounds. What you're really looking for is the OCI but like everyone said, that will take months to get. Since you want to travel so soon, just apply for a normal tourist visa and when you return, apply for the OCI.
