  3. Yes, they’d have to contact NVC and request a change of consulate and attach a copy of their UK passport.
  4. Correct. It’ll go to Montreal. A change of the consulate can be requested if they wish to interview in UK.
  5. That won’t be possible unfortunately. The case won’t move forward at all without filing and processing the I-824 which will add an extra year to the process.

  7. If she has a green card then why does her spouse need to file I-130 and I-485? I-485 IS an application for a green card…..
  8. These statements directly contradict each other. I-130 is not needed for K1 adjustments unless they didn’t marry within 90 days.

  12. Interviews are happening about 23 months after being DQ’d.
  13. I would request the extension and delay of the interview before any medical exam (which expires after 6 months so there’s really no point of completing one) and interview. However, as I mentioned, I doubt the consulate will extend it several times and it’s fully at their discretion whether or not they will grant you an extension. If you go this route be prepared to take the risk - which is them denying the extension and then you’ll have to to either bite the bullet and interview and get the visa and move or let it expire and file anew for another fiancé or spousal petition.

  15. The recommendation was to have your parents file as insurance just in case. This might sound grim but if something happens to you the the petition you filed is dead. So parents would be back up.   21. Haven’t seen anything about this. Sure hope it’s true, I’m due to file for ROC this fall and I really don’t want to pay the increased fee

  23. Unfortunately it looks like you’ll have to cancel or reschedule the wedding. Setting a wedding date is something that is extremely risky to do with K1. Upcoming wedding is not a reason for an expedite.
