  1. I feel like because the vast majority of family based applicants would apply for premium processing making it… not premium processing any longer. I do not think it’s a viable option for family based petitions for that reason.

  3. What is the timeline of previous relationship? When did the new one start? Any major cultural/age differences with a previous partner and current? How many times have you met in person with your current partner?

  5. Instead of the USC spouse? No. USC spouse always remains the primary sponsor. The whole adjustment of status is based on the marriage to a USC spouse and if they came on a K1, they cannot adjust through anybody else but the one who sponsored them on a K1. Another limitation of a K1 AOS.
  6. No, a USC spouse cannot withdraw the I-485 because it’s not their petition, it’s the immigrant’s petition. However, a USC can withdraw the I-864 affidavit of support and if that happens before the interview/approval, then the I-485 will be toast (=denied). And no, you can’t prevent a USC from withdrawing I-864 if they so wish.

  8. I would forego the lease. We didn’t provide any hotel receipts or anything like that. Actual boarding passes and passport stamps would be a better choice

  10. Also, NVC doesn’t send welcome letters. They only send an email once the case departs NVC to the consulate but not before.
  11. You have to wait until it's “Ready” and that’s when the consulate has your file and you can proceed with booking interview/medical.
  12. There’s no adding them. They will be their own separate petitions. You should file now but do not expect them to follow the same timeline for I-130 as your husbands since as I mentioned they are separate cases. If you want them to immigrate at the same time as the dad, then yes there’ll be a delay as you’ll have to wait for the kids petitions to “catch up” when they get to NVC. You should I delay filing any documents to NVC for your husband (as long as you keep contact with them once a year) and when the kids petitions will be approved and sent to NVC, then they’ll be processed on the same timeline. Also keep in mind he’ll need to show that he is allowed to take them out of the country to immigrate to the US (can be a letter from the mom or court order).

  14. The category is automatic: married less that 2 years = CR1, married 2 years or more = IR1. IR1 means you will get a 10 year GC after you enter the US (as opposed to a 2 year conditional one for CR1 applicants) which means you will be avoiding the dreadful removal of conditions process.

  18. Unfortunately, most likely, no. I’ve seen it approved mostly for emergency travel to see a gravely ill immediate relative.

  22. No problem! I was asked at my interview about other people living in the house (they were not part of the household since nobody was on my now-husband’s taxes) so I just said they support themselves and that was it, he didn’t press it further.
