Yes I’m not too worried! There is a million reasons why an AOS could be declined for that particular case!

It takes 60 seconds for the IRS to text you a code, everything is online. Make the account now and you can print them tonight. It's easy.

Actually, I was just able to create a new account with texting a code. However, the 2019 tax return isnt showing up on there yet. Probably because of the delayed deadline. Good thing I checked, though. Thanks!

Thanks! I heard that most of the time, they aren't quite as strict in the AOS interview because they mostly understand that coming here, moving cross countries and often continents etc. means you won't have much in both your names anytime soon. Let's hope!

I mean that would only make sense. I can’t imagine people can just throw things together so quickly and especially due to the fact we’re in a pandemic. I think you’ll do fantastic. Positive vibes your way !!!

We didn't submit all that attached to the I-130A - It's easy to overthink and stress this process - Follow the guides here or search the forums for cover letter, you will see how people organized theirs.

True, right now you do not need to include the I-944.

I paste here from my cover letter all that I included in the form I-130, and this include the I-130A as well. Let's say that I-130A is part of the I-130. I did not get any RFE! I hope this helps

Mmm, ok, you can file concurrently I-130 with I-485, by doing that you do not have to pay the fees for the travel permit (I-131) and the work permit (I-765)

    You have to options:

    1) You can send all together in one big envelope, but separating every application, like the I-130, then the I-485 with the I-864 and I-944 if needed, then the I-131 and I-765.

    2) You file I-130 online, then you get a NOA form I-797 that you must attach to the package with the I-485 and all that.

I just mailed both together, I-130 with my AoS application (I-485).

I hope it's clear. You can ask otherwise, but anyway there are a lot of threads and guides in VJ where this is explained

Toby_HB reacted to Kürbis&Tannenbaum in Passport photo curved edges?
I understand your worries about the passport photo, since I was equally worried about when we applied for AOS. I actually took them myself in front of a white wall and printed them at one of the drug store chains. I made sure to follow all of the USCIS guidelines about shadows, backgrounds, size of the face, and height of the top and bottom of the face in the picture. It took me forever, and I measured and cut the photos by hand at home. Even though USCIS accepted my photos, I would not advice to do it like me, and I would get my picture taken professionally, like you did.

As for your situation, I don't think that the black border is an issue, but I do not know about the rounded edges. Personally, I would get the pictures re-done, and ask them to not cut the edges, since it is better to be safe than sorry, imo, and it doesn't cost a ton. Maybe they'll even re-do it without charging you, if you explain your problem.

I want to point out that this is my personal opinion, and I don't know if USCIS would actually accept rounded edges. I just thought that since you couldn't find anything online, I'd share my thoughts.

Also, one last (important!) piece of advice: Make sure to measure the size of the head and the distance of the face in comparison to the top and bottom of the photo, according to USCIS' photo requirements. For I-129f, I had my picture taken at a drug store, and they actually did it wrong. The face was too large, and did not meet the requirements. I had it re-done without an up-charge. Make sure to bring a ruler, when you get your picture taken ;)

just to know if the person's debt would make it appear they would become a public charge

to me the foreigner's debt is not the issue  / a more reasonable approach should be for the USC to submit his/her debts and submit a credit report as it is ultimately the USC's financial responsibility.

There are 3 types of birth documents in all of Canada outside of Quebec:

    1. Short form, in the 90s this was wallet sized, only shows your details.

2.Long form, shows you and yours parents details.

    3. A certified copy of birth record.  This is a photo copy of what is actually on record at the department of vital statistics certified by that agency.

OP only has 1 and 3.  Based on the screen print from the DOS above, 2 or 3 are okay.

The copy of registration of live birth is what you need. I believe it is uniquely from Ontario. In BC you just have long and short form if your birth cert.

Ive never had a live birth registration, only the wallet sized birth certificates (2 of them, my original was lost and the 2nd is unreadable and doesnt contain parent info) that they no longer make and the long form I needed for immigration.  I got mine in 2011 and it looked just like that. (I was born in 1981.)
All live birth registration are filled out by hand. It's literally a certified copy of what your parents filled out when you were born.

It would count as a negative against whole of circumstances denial, based on multiple factors eg ability to self support, current medical conditions, liabilities etc etc, I wouldn’t count on waiting to find work, especially with so many out of work now seeking employment and the push for American first.. you might end find work for 6,9,12 months..

you’re supposed to get insurance within 30 days of arrival or have funds to pay what could be up to $20-30k of emergency costs for surgery etc..

I’m not sure credit cards would count for this, it would need to be cash in bank or assets that are easily liquidated..

why can’t you go on your wife’s insurance? You should be able to get added under life changing event.

    Toby_HB reacted to geowrian in F-1 AOS & Tax / I-864 question.
Technically, only the petitioner needs to be an I-864 sponsor. So your tax issue is only an issue with the IRS, not immigration.
Had you been trying to claim your income as well, your tax return would be needed too.

Are you doing AOS (green card while within US) or consular processing (immigrant visa abroad)? The forum you posted this in is for the visa. If so, I don't see anything off-hand where your taxes would be an issue.
Edit: Actually, the DS-5540 (a fairly new form used with IVs) does ask about US tax returns too.
If you are doing AOS, the I-944 requires you to provide both of your tax return transcripts.

An incorrect tax return is an IRS issue, not an immigration issue. Yes it should be fixed, but I wouldn't expect this to be an issue for immigration.

You need to amend your 2019 federal tax return.  Foreign students are not entitled to the $12,200 standard deduction.  Foreign students are considered foreign tax payers (non-resident tax payers) and every dollar earned in the US is subject to taxes.  The only exception is for students from India.

I know because I have filed tax returns for my niece who is a foreign student from Vietnam.  She earned $5000 and paid $500 in federal income taxes.

You can thank Trump for this.

The I-864 will only require your spouse's tax return.  Yours is not considered.  So file for AOS now, and amend your taxes when you can.

Your spouse should get a tax transcript from the IRS to turn in with the I-864.  A copy of the tax return is sometimes not accepted and USCIS will issue an RFE for a tax transcript.
