I-944 / health insurance question.

Hello,

 

Could I get denied off the basis of not having health insurance at the time of filing? I am going to wait until I gain employment before I figure out health insurance, so soon I will figure it out. 

 

 

Part 3. Your and Your Household Member(s)'s Assets, Resources, and Financial Status (continued)

 

Have you enrolled or will soon enroll in health insurance but your health coverage has not started yet?  I will soon enroll / No.  ( I cannot go on my wife coverage. )

 

If you answered “No” to Item Number 15., you may provide information on how you plan to pay for reasonably anticipated medical costs. If you need extra space to complete this section, use the space provided in Part 9. Additional Information.

 

My wife has funds to pay if we have an emergency but we will use credit cards and (wife) financial sponsor until I gain employment and pay out of pocket or acquire coverage through employer.

It would count as a negative against whole of circumstances denial, based on multiple factors eg ability to self support, current medical conditions, liabilities etc etc, I wouldn’t count on waiting to find work, especially with so many out of work now seeking employment and the push for American first.. you might end find work for 6,9,12 months.. 

 

you’re supposed to get insurance within 30 days of arrival or have funds to pay what could be up to $20-30k of emergency costs for surgery etc..

 

I’m not sure credit cards would count for this, it would need to be cash in bank or assets that are easily liquidated..

 

why can’t you go on your wife’s insurance? You should be able to get added under life changing event.

It's possible; it's up to the CO to determine. Is your wife on Medicaid (that's a negative)? How does the rest of the I944 look? Are you educated/have debts/etc?

 

Also it is likely you may not be able to obtain a job for 4-6 months

I had insurance all through my F-1 studies through my school, but once I hit OPT my employer didn't offer insurance, and then I got laid off during Covid. My wifes parents pay for her coverage completely and since they're not 100% on board with this whole thing, as they think she'll be supporting me, adding to me their / her coverage isn't what they want to be doing right now. She has an emergency trust that would cover anything from 10-50k which we have statements for. Is there any healthare options ?

 

+ the whole health insurance industry here is so new because I've never had to pay for dime when it comes to anything health related, and I would always fly back to see my doctor even though I had blue cross here when I was in school.

Iwouldnt count on flying back to see a doctor during or after AOS, purely because you’ll no longer be a Canadian resident, you may or may not be permitted to claim the free healthcare. Genrally speaking, you need to be a resident to get it, similar to myself being Aussie, as a US resident I can’t use free Aussie health care cause I’m no longer paying Aussie taxes that give me entitlement too it.. I’m not familiar with the Canadian system, you may want to check that before relying on it, secondly, you mighten be capable of using it in an emergency.. 

 

I’m assuming you’re young or at least your wife is given her parents still pay for her insurance, does she work?  Or can she take out her own policy with you on it? Unfortunately a son in law can’t be added to the parents family insurance to my knowledge, what is her age? I think her insurance would cut off from family insurance anyway once she gets 25/26.. 

 

Personnaly I think a good i994 would show a working spouse/primary sponsor, health insurance for yourself preferably on spouses policy, good educations inc University, no debts, plenty of savings/disovavle assets, good US credit rating... the less you have of those listed the worse it looks..

Correct the Canadian system has similar rules so would no longer be covered.

Also, getting married could end her eligibility to be covered by her parents plan.
