    Just wanted to share the good news that today we got an e-mail form the embassy that they have been working on rescheduling interviews. We got our new interview date as well! 
    We didn't expedite or anything. This is in Santo Domingo. Couldn't be happier!

    Not valid for US immigration to start the CR-1 process  until you have been together....after the ceremony.

    I’m a U.S. citizen and married my U.K. husband in England in February, came home and applied for CR-1 spouse visa. We’re currently waiting for an interview appointment. I can share a bit on this process that might help you. The marriage visa part was easy. It’s a form and a fee and I had to go to an appointment at an office in our courthouse building (I live in Louisville, KY). They took a pic, fingerprinted me, and they took my passport. A few weeks later, my passport was mailed back to me with the marriage visa stamped inside. Google how to apply for a marriage visa and you’ll find the form and fee info.  The big thing is, depending on your work situation, amount of vacation time... you may have to make 2 trips to the U.K. to get married there. Here in the U.S. you could meet someone today and marry them today. The U.K. doesn’t work that way. In the U.K. even if you are both from the U.K., you must declare intent to marry and wait 28 days. As a non - U.K. citizen, before you can declare intent to marry, you must be in the country 8 days. In order to declare and marry in the same trip you would need to be in the U.K. 36 days total (28 days + the additional 8 days for being a foreign national) then have the wedding ceremony. Once you apply, I think you have to marry within couldn’t take that much time off work so last October I went to visit and after 8 days we went to declare (you must make an appointment to declare at one of the designated offices and there’s a fee. Also you need 2 passport photos of each of you) then I went back in February and we got married. After seeing the K1’s processing stalled due to Covid, very glad we did spouse visa. Good luck! 
     
    p.s. Almost forgot the timeframes! Marriage visa is good for 6 months and once you declare intent to marry in the U.K. you have 12 months to get married.

    I mean different people have different circumstances..... I get the CR1 has big advantages, especially during the pandemic, but the amount of K1 bashing I see on this site can be discouraging

    Thank you so much for your positive feedback and remorse. 
    I did not sign up for that case status, but I do look at my status on CEAC from time to time. 
    I emailed my local state representative last year and the office said they would email the embassy but I never heard back from them again. Maybe I’ll try again sometime soon. 
    My fiancé had to fill out this form called DS 5535. In this form it asked questions like his past travel history, his past home addresses, family info, social media info, etc. 
    They gave him this form to fill out after his interview, we filled it out and sent it back within a week and ever since then he has been under AP. 
    it’s most likely they are doing background checks but like almost a year and a half, like seriously.

    Or it can potentially last longer than that: "Support under the Form I-864 lasts until one of the five Terminating Events defined by federal statutes and regulations.     I am no expert here: Here are a few things that come to mind:

    Since Russian is a High Risk Country likely be extremely hard to convince the CO. 
     
    Even if you get the CO to approve, I am thinking the POE officer will send her back. 

    You also have to think about do you really want to be tied to her for Ten years? Even if you get her a GC. Will she leave you after? There are a lot of stories happening like that from there. 

    The real question, and you do not have to answer here, is why you even want to stay?

    Still new to this, so like don't quote me. I am just speaking from personal experience of knowing people who went through this personally. They got approved and when trying to enter did not get allowed because of " as i was told" risk of visa fraud.

    I think everybody else covered the relationship side of things pretty clearly. Nobody here knows your circumstances, but this is flashing red alarms that now is not a good time to add in the stress of immigration and such. I'd be running for the hills, but there is no harm in at least delaying things.
     
    Only a USC (or an American Indian born in Canada with least 50% American Indian blood) is guaranteed entry.
    But a denied entry with a K-1 is quite rare and suggests there were reasons for the CBPO to believe the visa has since become invalid for it's intended purpose or was issued incorrectly based upon the new information that the CO didn't have. They generally don't get into the position of overruling a CO who spent much more time with that one case than a CBPO with limited information and less time.
     
    I've seen a rejection because the CBPO asked if they intend to to marry the petitioner, and they responded with something along the lines of "maybe I will, maybe I won't". The officer felt they did not qualify for a K-1 visa anymore as the purpose of the visa is to enter and marry.
     
    I've seen a few handfuls of rejections because the individuals married abroad prior to entry, and found evidence of this.
    Some of these were marriages (legal or "only" ceremonial) to the petitioner.
    There is at least one case where there was a marriage to an SO they had abroad. Usually this one tends to gets caught at AOS or ROC or something (or when they eventually divorce and try to bring over their original SO), but I guess sometimes people get overconfident and assume they got away with it already.
     
    Other than the medical, it wouldn't be required. For the medical, I'm pretty sure it's asked (the x-ray and/or vaccinations alone are reasons why they need to know).

    Look at what assets you have also look at getting a part time job or increasing your income. 

    Since you are going from the Philippines, you can not get a joint sponsor for a K1 visa. 

    Many US embassies accept joint sponsors for fiance visas. However, unfortunately, the most popular country for the K1 visa, the Philippines, doesn't allow them. They do allow joint sponsors for married couples applying for CR1 visas, but not the fiance visa.May 13, 2019

    This could be something to check the website and get the I-134 and 1-864 . Might not need both, but good reference point.

    You click the multiple filer box on the I-129F.  Follow the instructions. 
     
    Inform your new and improved fiance of the previous petition as she may be asked about it at the interview.
     
    EDIT:  if it has been less than a year it would be advisable to withdraw the old petition in writing.

    You made $300 more than the minimum requirement. Start looking for a joint sponsor or obtain a second job.

    And you believe the bolded? It's more like she found out late that she's pregnant but couldn't terminate at that point. So the best thing was to cook up a story before you came to Russia that "she should be grateful about the pregnancy." Trust me, you and her will get pregnant again and it'll be termed "a miracle."
     
    I bet you the initial plan was to hide it from you, not mention the kid anywhere, migrate to US then either:
     
    1. divorce and go back to get the kid or on 25th Dec be like
    2. "Hurray. I have a kid, you know. His name is Dimitri. That's your 2021 X-mass present, babe. "
     
    However, they only came clean because somehow they may have found out those plans lead to a dead end if the child isn't mentioned NOW on the K-1 process. We've seen people who hid their kids and wives, married US citizens, then divorced to go bring the aforementioned. However, USCIS hits them with reality and they come on VJ asking how to remedy the situation.
     
    I guarantee you that if the 2 plans mentioned above would work, you would have gone to Russia to find a well maintained 'gym' body. She would have silently given birth, given the kid to family or the guy for keeps and hit the gym ASAP before your arrival. You would have been so happy she maintained herself for you while you were away, not knowing the dirt behind the curtains.
     
    First of all, how do you go around not using condom? This was not accidental. They knew what they were doing.

    Is this someone you would want to be financially responsible for potentially her entire life? If the kid comes on a k2 you’d be responsible for him as well.

    Hello, 

    I am sure this was already bought up. 

    During the Medical examination they will have to answer to it and you will have to confirm you want to move forward, given this new information. 

    If you have one or more children not listed on the visa petition, or a current pregnancy, or a prior undisclosed marriage even if it is now terminated, or currently have a contagious disease of public health significance, be prepared to present a notarized letter from the petitioner stating he/she knows the discrepancies between facts stated on the petition and your actual personal circumstances, and still wishes to proceed with marriage.

    There will be a lot of questions at the interview, and given that she cheated, might be grounds for Denial by the officer.
