    IT'S OFFICIAL EVERYONE WE HAVE JUST ARRIVED OUR NOA2!!!! RECEIVED A TEXT AT 8AM ON THE DOT TO CHECK UPDATED STATUS AND ONCE I CLICKED THERE IT WAS "CASE WAS APPROVED"

    I got my noa2 today November 14th..  Noa1 date of August 6th.  From the looks of it there are alot of people getting noa2's today.  Congratulations to us all.

    Anytime you see "case updated" it means someone has "touched" your case. So I guess if it were me I think that would be a good sign since you went 90 days with nothing.

    So here is my update:
    Sept 23rd 2019 I went to the US embassy in HCMC, Vietman and handed them a bunch of additional documents (fb chat logs from 2017-current, moneygram receipts, photobook, etc) and said they'll add to our files. 
    1 question was ask of me: Are you the petitioner?
    I asked if there's anything else you need from us, and do you have any questions for me and he said No, so we left.
     
    (Our case was never updated before I visited the embassy, since June 2019)
     
    A month later: 
    Sept. 23th 2019: Visited USEMVN (more evidence)
     
    Oct. 29th 2019:  Case updated
    Oct. 31st 2019: Case updated
    Nov. 4th 2019: Case Updated 
    Nov. 8th 2019: Case Updated
    Nov. 12th 2019 Case Updated
     
    Not sure if this is good or bad since we have not gotten a call/email or mail from them yet but at least they are looking at it.

    Your fiance and daughter need to apply for and receive Vietnamese passports from the Vietnamese government and have them in hand for the interview.  If the interview goes well and they are approved for the visas, then the US Consulate keeps their original passports.  The US Consulate then processes the K1 visa and glues the visa onto a page of the passport.  Once this is done (takes about 5 - 6 business days after approval) the passport gets mailed back to the passport holder.

    The DS-160 is a visa (thi thuc) application.  The US Government does not issue Vietnamese passports.
     
    Your fiance and her daughter will need Vietnamese passports (ho chieu).  They will need their passports in order to complete the DS-160 visa applications.  It's 200,000 dong and about 10 days to get a Vietnamese passport.

    I think what it's really about is if someone really has a claim, there is a basic to stop people and start asking for travel authorization. I've traveled all over Asia as well, some of the times with my 3 years old but no one ever asked me anything.

    My fiance has a son, and the quote you posted is from the Vietnamese divorce laws.. its basically standard boilerplate.  The consulate is not concerned about the parents rights.  They are there to adjudicate a visa application.
     
    USCIS and DoS don't care if you have a travel letter, they do not enforce travel rules, airlines do (or are supposed to).  I've traveled all over Asia and not once have I ever seen a single parent get asked about their kid.  This includes Chinese, Hong Kong, Japanese, US and Canadian airlines.
     
    For a K2, on the I-129F you just add the kids name.  The only additional documentation you need is at the interview is the kid needs a passport and birth certificate.
     
    What you want is a notorized travel authorization letter.  Google the format, they are pretty basic.  Its really just theater.  If you show up at a Chinese/US airline with a letter in Vietnamese, do you think they are gonna care??

    So went home to eat lunch and was surprised to see a bunch of letters in the mailbox although Informed Delivery said there was nothing today and the RFE letter came. The notorious 4a box it was. At least we have some relief that it wasn’t anything complex or more serious. Checked the box and signed it and overnighted back. Fingers crossed for a fast process.

    Fly American or United, maybe they won't ask - price is very similar to ANA and others. My VN wife says that the ex-husband probably doesn't have any custody. There might not be any custody paperwork. In any case, you can ask the airlines what they need and go accordingly. As long as the child has a passport and visa, you might not have any issues.

    I don't recall a consent letter being requested at the consulate.  We included among sll the other paperwork, so I don't know if they copied it.  Korean Airlines did require it (with birth certificate) before issuing boarding passes in HCM City.  - Jason

    Presumably the father has visitation rights mentioned in the order even though the mother has sole custody?  If so, she will probably need a consent letter from the father as moving the child out of the country obviously impacts his visitation.
     
    Some countries, sole custody is enough---others, not so.  I would have your fiance contact the embassy/consulate in Vietnam and ask what (if anything) is required from the father for the child to move permanently to the USA...alternatively she can ask a lawyer in her home country as well.
