    Yes he/she can get married and return to original country to wait for interview. If he/she is coming to get married and AOS on a tourist visa, it is immigration fraud.

    ROC is removal of conditions. This changes your conditional green card (valid for 2 years) to a permanent one (each card will be valid for 10 years but your status will be permanent). 
     
    Citizenship is voluntary. You can, if you wish, remain a resident (aka green card holder) for the rest of your days here, if you wish. GC holders can’t vote and can’t take certain federal jobs. Depending on your current citizenship, you may or may not lose your original citizenship if you become a naturalized US citizen. Not all governments recognize dual citizenship.
     
    Assuming you remain “in marital union” with your USC spouse, you are eligible to start the application for citizenship 90 days prior to the third anniversary of the “resident since” date on your GC.

    K-1 is non-immigrant.
    I don't want to say 100% is won't be covered by this, but I do not see anything suggesting it is. I would expect K-1s to continue as normal (as normal as anything is right now).

    Immigrants applying for a green card from an embassy abroad for the following immigrant categories: DV All EB except EB-5 and EB2 (NIW only) F1, F2A, F2B, F3, F4 Parents of US citizens (but not spouse/child) What does this NOT affect?
    Nonimmigrant visas of any kind (F-1, J-1, B, etc) Nonimmigrant work visas (H, TN, etc) Who does this NOT affect?
    Anyone who's in the US at the date of the order, i.e. including existing Adjustment of Status applicants Anyone who already has a valid immigrant visa Anyone entering to work in healthcare/medical research, and their spouse/children EB-5 and EB2 (NIW only) Spouse and minor (under 21) child of USC

    Trump during his press conference confirmed that there would be exemptions. Let’s hope that is for the immediate family relatives. EO will be signed by tomorrow morning.

    I think you may be right. Waiting months for the NOA1, and then getting an "RFE over the phone" when they call to inquire isn't how things normally work.

    I'm going out on a limb here. Not to be the bearer of bad news, but unless your fiancee has provided you with a tracking number and proof it was mailed, I think he/she is just stringing you along. I believe the simplest answer is usually the right one. Maybe I am wrong, but I have a strong suspicion it was never sent. Have you seen any proof of mailing? did you round up all the information for him/her to build the packet? did you see proof of the money order or payment? While I do agree USCIS is known to not be the brightest crayon in the box, there seems to be too much bad information given to you from whatever source you are getting it from, and if you haven't called USCIS yourself to get this supposed information, I would not trust it. Just my 2 cents.

    I have tried to read through the facts and multiple threads..LOL....I agree that something is amiss.......How does a petition which is missing almost all required documents NOT get a flat denial?

    Often the embassy officers will handle the extension based upon requests by letter (email included), but each embassy does things just a little differently. If your particular embassy wants the form filled out and received, then by all means do it. I think that Fed Ex might be a little more than you need, but you should do what you feel most comfortable with.
    Extensions are common as the foreign individual may have circumstances requiring longer periods than the visa may allow, such as finishing college. The main thing is to make sure you are completely prepared and that the extension is for a valid reason.

    If you've communicated with the Consulate and they've instructed you to file the form, I would do it. It is well known that the visa process from NOA2 to interview/visa issue commonly takes more than four months and that Consular officers have the authority to extend the validity in four month increments, at their discretion.
    This is not a "form". It is an example of a letter you could use.

    According to your timeline, your case is now at the embassy. You should contact the embassy directly by email, telephone or mail explaining the entire situation and why you need additional time. Be sure to include both names completely, the new case number and contact information. The embassy officials are usually pretty good about giving extensions. You should plan for at least a week before they can respond to an email request.
    I wouldn't bother with the form.

    Yep, the Consular officers routinely extend the validity. Skip the form unless you have a specific unusual circumstance prompting you to use it.

    Are you filling out this form because your petition is set to expire and you have no set interview date yet?
    When I used this form (for the reason listed above) I did not have it notorized, and eliminated the "period of validity" statement. I added my own language stating the duration the petition is valid for.
    We received a response back stating - the consulate would automatically extend the approval due to the circumstance (this was Montreal).

    I'm the process of filling out the "Request to Extend Approval of I-129f" on this page.
    Everything makes sense except for "It is my understanding that pursuant to 9FAM 41.81 N3.1 (Period of validity)" What do I put in place of (Period of validitiy)? Does it really have to be notarized?!
    Also, I didn't remember that the petition will expire until less than a week before it actually expires! If they receive the letter AFTER the official expiry date, can they/will they extend it? I'm so worried that it will expire and there's nothing I can do

    Then Germany is the 1% who don't 😁 They want a new letter of intent from the petitioner every time. 
     
    The approval can be extended 3 times in 3 months steps to a total of 12 months. Have a look at the embassy/ consulate homepage and see if you can find something or email them and ask what needs to be done.

    There is nothing to worry about. You will have an extension. As of now, i will suggest you to focus on the next step. Start prepping the paperworks and get ready to roll when the Covid-19 ends. Good luck

    I would say 99% of embassies will automatically extend the noa2 date automatically without you doing anything. You are free to contact them and ask for a extension, but they will do it automatically for at least a year with no issues. They may automatically extend them longer with current situation.

    I am in the same boat as far as the NOA2. Mine runs out mid July 2020, at what point do I ask for an extension and who do I ask for an extension the Embassy or the NVC? My other issue is my fiancé is here in the USA on a B1/B2 Tourist Visa and good until Mid August, but with all the flights shutdown due to the virus I can't get her back to her home country. This is just a mess....:(

    Thank you! This is the kind of answer I was looking for xD. And yes I'm prepared for a longer wait which is fine. My fiancé's school might go longer than expected due to the outbreak so I would want to make sure his schooling fits in with all of this. So fingers crossed it gets extended to a longer period of time.
