His US immigration trajectory was doomed the instant he omitted his military service on his student visa application. [And quite possibly before that when he failed to obtain documentation for his divorce.]
And any of us could have told him that 5 years ago.
Him moving to China is, frankly, the system working as designed. Hope he was more forthcoming with them.

They lied........average time for a spousal visa, as reported by other VJ members, is 471 days from filing to interview....and it appears that times are increasing. Pakistan is known for quite long periods of AP.

Nothing has been approved yet. I suggest the two of you read about the process a lot more and understand how it works.
Your petition (not your visa) has been accepted and is under review. That takes at least 6 months. Currently Nebraska is taking a year. Then the NVC stage, then the embassy stage (medical and interview). Unfortunately for you, you are in the demographic that experiences the longest AP of all - Pakistani male. I wouldn’t bet the farm on having your visa in your hands before summer 2021.

Everyone gets a receipt notice a few days after they file.
Your wife’s petition will be approved 6-8 months after you filed.
Then it will go to the NVC. Processing there will take a few weeks.
Then it will go to the embassy and you can apply for a visa. Your visa process there can take anywhere from a few weeks to 18 months.
Your visa is a minimum of a year to a year and a half away.
All rapidvisa did? Charge your wife for simple forms she could have filled and mailed in herself.

Rapidvisa is a joke. You wasted your money. Nobody can speed up the time in immigration. You wait in line like everyone else. Spousal visas are taking a year and a half. And you could have done the process without paying a service if you would have found VisaJourney beforehand.
Rapidvisa is just another privately owned company looking for people to spend money on them. You can do a research and read all the info about them.

Add in that the OP and his ex-wife were planning on visiting the USA where the OP's new fiance lives? Would have also raised suspicion with the CO.
Perhaps the CO thought that the divorce was done only to obtain benefits with the USC fiance, quick US divorce, and then "remarry" the first wife and bring her over later on...unfortunately some people try to do this.

No one said it’s not “technically” legit. My understanding is that repeated, frequent travel for work can be questioned because its gives the appearance that you are working in the US. It’s something you should be aware of, not telling you what to do.
You may not care as it sounds like you will be leaving the job and staying in the US once you enter on the K1 anyway. Or maybe they will give you a long leave of absence,

Be aware that K1 is single entry visa and you can't leave U.S until you got AP in hand( 3-6 months waiting). K1 is a poor choice in your situation.

The K-1 is valid for 180 days from the date of your medical, not the date they issue the visa. If you have an extended period of AP after your interview then this will cut into the validity of the K-1.
I stand by my comment that the K-1 is a poor choice for someone with a thriving career. Good luck during the months of unemployment. It would have driven me crazy.

So you are also using the ESTA to work here?
But no don't take the risk unless you are ready to stay if they admit you on the K-1.
What are you going to do with work when you get here? You know you can't work for many months?

I don't think so. Odds are that the first time you enter with a K-1 visa in your passport, it will be voided. Let us know what you find out.

Couldn't agree more. I went down the K1 route and it was the worst decision I could have made, I am still struggling to get my career back on track after almost one year of Visa shananigans - and that's because I got my GC relatively fast, in less than 4 months.
OP, it looks like you do have a thriving career but please be aware that when you enter the US on your K1, work can only continue after you get your EAD and that might easily take 3 months or more. That's why a spousal Visa is a better option sometimes.

I can recall only one case where an AOS denial was related to intent. But that was because of misrepresentation from a discussion the new immigrant had with CBP during a secondary interview at POE. Generally, intent is determined by CBP at the time of entry into the US.

I think some people were giving you advice based on the idea you would marry and she would return for consular processing.
Marrying a few days into a visit is just something you will have to explain. My opinion is you will be questioned about why you married so quickly after a second visit.
I dont know what state you are in but can you get married and have the documents you need to submit done in about a week? The rules take effect on the 15th means you need to have the document receipt no later than the 14th.
I havent counted out the days but you should look look very closely at what is physically possible. Do you need a birth certificate for her to get a marriage license? Do you have it?
How is her family going to react to this and yours?

You should not make life decisions based on immigration policies. Rather it is best to live you life the way you want and deal with the policies that apply at that time. Are you ready to marry>? If there were no rule changes upcoming would you still get married right now?

We had friends in graduate school who lived apart because they were in different PhD programs in different schools in different states. They met during undergrad.
They had a lot of questions about their marriage but they were approved. They had a real relationship. So it’s not a deal breaker if you don’t live together for reasons relating to jobs or education.
Choosing to live apart because your kids don’t get along is not going to work.

They had a lot of questions about their marriage but they were approved. They had a real relationship. So it’s not a deal breaker if you don’t live together for reasons relating to jobs or education.
Choosing to live apart because your kids don’t get along is not going to work.

A bit more of history - Public charge was passed into law in the year 1800. It has a re-determination every 20 years to keep up with times.
In 1919 ther wasn't any social security. In 1939 re determination it was added. Social security was enacted in 1937.
So..
Either way this has been around a very long time. He is just enforcing what’s already in place that we never used.
I do believe it will be tougher but coming to the the US without the means would be even harsher.
I’d rather it be prior to being approved than finding out we could not afford the costs until after he gets here.
Just my opinion and hope it only protects the immigrant and the USC from the heartache of realizing this after we start our lives together. ❤️

and i have got visa
