    Hello August AOS Filers,

    Update:

My wife completed her biometrics appointment last Friday for I-765! Still waiting for I-485 biometrics for her. We got a RFE on I-485 for not submitting I-944 form. The Injunction of the Inadmissibility on Public Charge Grounds Final Rule has us all confused up (long story) and I wish we would have submitted it. We got that taking care of last month, so hopefully the biometrics appointment will come before the end of the year.

You can translate documents if you are "competent to translate from the foreign language into English" and include a statement of certification.

We had 50+ pages of financial statements that required translating.

The official requirement for USCIS translation can be found in " 8 CFR § 103.2 - Submission and adjudication of benefit requests "

    and the specific requirement is:

What this means is as long as you know someone who is

    1. competent to translate from the foreign language into English, and
    2. they include a statement of certification at the end of the document (if you already have a translated document from a service you can just copy the same certification format they used)  that says they are competent to translate from the foreign language into English, and date the form

then you can have a friend or even a relative perform and certify the translation. (Friend is best. The petitioner/beneficiary cannot translate their own documents.)

Hopefully you know someone who can do these translations for you.

If not, assuming the documents are in Spanish, you should be able to find a translator somewhat easily and for not too much money. You do not need to go to some website that says "USCIS approved" and charges a high amount per page. You do not need notarization for this specific form. Anyone who is fluent in both languages and competent to translate and can certify can do this.

I almost missed that detail too. Originally I only had my last statement.

I didn't add the statements of my foreign bank account because it's been several years since my main bank account is in the US. But if that's not your case and you have a good part of your assets there, I think it would beneficial for you to add it (they just want to know how much money the household owns - so the more you can show, the better). Check with your foreign bank if they can issue the statements for you in english. Several banks have the ability to do that by request. So you won't need to spend money/time with translations.

Another alternative, though a little more complicated, would be to transfer your assets to the US.

Quick update...we received her credit report and score in the mail yesterday, it looks like the only reason she has them is because I made her an authorized user on my credit cards months ago. This didn't require a SSN.
I can't comment on getting an official credit bureau letter stating you have no credit report or score.

I just saw on USPS Informed Delivery that I have 3 pieces of mail coming from USCIS today. I assume it's the NOA1 of I-485, I-765 and I-131.

Never to early to start thinking about your AOS (I-485) interview here are a few things I would like to share with you in case you are drawing blanks on what you will take to your interview. Although my interview was waived I was still prepared to attend so I am sharing what I was going to bring to my interview. Since I did not use it it'll be used during ROC provided we have a interview then. I have posted this before, but it's most handy to post in your own thread so the people can find it readily. Lot's of items won't apply to you and I understand younger couples won't have near the amount of items. USCIS does expect you to have basic items that married couples produce together, so if you don't have it you only can bring what you have. Good luck to you all and I hope my little tidbits help you plan for your interviews:

I broke our materials down into folders (different colors) and carried them in a nice camo bag I had laying around. I prepared a master legend or key if you will so when the IO asks for a document or an evidence, I can look on my sheet and locate which color folder it is located in and pull the folder out and locate the document to give to the IO. Here are the documents I am taking:

All forms I-797C (Notice of Actions for AOS) included a I-797 NOA2 for the K1 also cause if you'll notice the interview sheet says bring EVERYTHING, they ever sent to you so we are electing to bring all but the kitchen sink!!!!!

Complete copy of the AOS packet and ALL supporting documents

    Current year 2019 tax transcript

    Job verification letter

    2 months of pay stubs

retirement pay letters (if applicable to you)

    USC passport

LPRs arrival documents to include K1 visa and I-94

    USC B/C

    marriage license

    SS card in married name

military ID card (if applicable to you)

divorce decree (if applicable to you) both USC and LPR

    health, dental and vision insurance

life insurances both for USC and LPR listing each other as beneficiaries

ROM (report of marriage) this is Philippines specific

last will and testament to include Texas advance directive and power of attorney (this is also great for ROC)

    utility bills with both names

    bank statements savings and checking

joint credit cards (actual card as statement does not list who made a charge)

large purchases receipt (furniture with both names on it)

assorted mail LPR has received at her present location we share

and finally, the entire copy of the K1 packet to include all documentation

There is no rental agreement or mortgage contract with both names because I owned our house before we married so I included a mortgage statement to show when the house was purchased before, we married! I also used the term LPR as my wife has her GC already. Several documents will be redundant because I did not want to break open the entire AOS packet until and if I need to.

Like I said we threw in everything but the kitchen sink and I would have included that had it fit inside my handy carry bag. As you know with my luck that I have had throughout this visa journey I can't be to unprepared. My motto "better to have it and not need it, then to need it and not have it!!!!!

    Hope this helps everyone!!!!!

I just completed most of my forms today and was hoping to post it out on Friday, without the I-944. I really hoping I wouldn't need to complete the I-944 so I would be interested in knowing what this means now that it seems that the injunction is narrowed.

I hope you won't get an RFE for the I-944 given that the guidance on the USCIS website when you applied asked applicants not to include it. Hoping more clarification comes soon

Is is true that I-944 will be required again?
I submited my  AOS petition this saturday and as of yesterday it was delivered to UCSIS offices, but it may take more than a week before they actually review it and  notify me.
I am afraid to receive an RFE requesting the I-944. Any one else with on the same situation?

The last time you visited U.S you stayed longer than 2 weeks, I don't see why you would a problem this time.

When you are asked about your reason for visiting say the truth, that you're visiting for vacations and to visit your fiance too (I mentioned my fiance on my visits and never had any problem)

Be sure to  double check for the current fees as fees do sometimes increase, so please check. Additionally check the forms as listed above i.e., current version and or edition date, there has been changes to various forms since February 24, 2020. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main  cover letter. Hope this helps in your preparation of your AOS. When in doubt ask questions.
