  1. Passed the interview today :)

     

    The interviewer was all business but polite and thorough. He had a misunderstanding that through my job I must’ve stated I was a US citizen previously. I tried to explain my line of work, it’s unusual not to be a US citizen but I only needed to be a lawful permanent resident. He didn’t let me explain that, before reminding me to be honest. When he realized at the end of the interview, the temperature totally changed and was more pleasant for me. Having said that I’m glad the applications are truly scrutinized. I’m happy to take the pass. Status has been updated to waiting for an oath ceremony to be scheduled. :)

     

     

  2. Hi Everyone,

     

    I just want to say I started this thread in October 2020 when I was going through the process. Tomorrow, I’m eligible to file for naturalization. It blows my mind that we’ve reached 155 pages. The amount of useful information contained has been so helpful for me and so many others that went through after. I thank you for your input :)

     

    My time in the US been awesome. I now have an 8 month old son, who is a joy, and I’m glad we persevered through the hard days apart!  It was definitely worth it. Life is good, and I wish everyone all the very best with their processes :)

    I double checked the forms and you are correct I am entirely incorrect the I-129F does not ask any questions remotely related to overstay. I do apologize.

     

    I was getting mixed with the I-130 with touches on the topic about the beneficiary ever being in removal proceedings.

     

    However all things considered I’ve checked over our documents and we added a single sentence in the note section. Having recently gone through the process myself, I do think this would be sufficient in your circumstances. I remember at no point did anyone ask me about it, and I felt they would at the embassy interview. I think you are truly demonstrating honesty and fronting it by voluntarily adding it on the form in the notes. In the highly highly unlikely event you are asked, you can legitimately say it was pointed out on the forms.

     

    As I say, you qualify for the visa regardless it would appear even with a minor overstay so they won’t banish you forever over it. They will look at the totality of circumstances and I’m sure your case will naturally show a clear and genuine bonafide relationship and they will be happy to approve you!

  5. Don’t place it in the cover letter that is the not most appropriate place. The cover letter should summarily list all the evidence you are sending.

     

    The correct place for this information is on the I-129F. There is a section where it asks if you have ever overstayed. 
     

    I was in a similar boat I overstayed I think 39 days due to me not realizing the date stamped was the expiry (I wrongly assumed the visa validity date was what was important but hey we all learn).

     

    You can add a few lines at the notes section on the back of the I-129F if you really want but this won’t cause any issues nine years later. Good luck with the process!

     

    Just answer the questions they ask and nothing more as they’re busy processing thousands of petitions a week.

    Could I ask you a quick question? When you had your interview, did they ask you for financial documents?

     

    The travel.state.gov actually says “you do not need to bring your Affidavit of Support or financial evidence you submitted to the NVC,” and we have a slightly weird tax return situation that’s been giving me major stress, just in case they bring it up at the interview and it delays things. 

     

    Did they ask to see your financial stuff/proof of income? (We’re going to bring everything of course, but just trying to figure out how worried I should be)

    They already had the copies on their computer if what was uploaded but I also took the originals as some people had reported being asked to reupload documents.

     

    Try not to worry! We didn’t even have w transcript and used a tax filing that the IRS still haven’t processed! I’ve just remailed it off last week so they didn’t confirm with them!

    I don’t have the answer but I know in certain cases ages are locked when a case is documentarily qualified. I would recommend starting a new thread and someone will come along with more knowledge and answer it I’m sure! Its more likely to be picked up on a fresh thread I think.

    Well, technically I got the green slip asking me to upload the missus' 1040 for 2019. But uh... That is now already uploaded, because despite my wife being in california she's still awake and she did it 😂. CO told me as long as I did it today it wouldn't add any processing time to my visa processing. 

     

    The words do not exist in the English language to express my relief thst this is done, and that in all likelihood I'll be home with my better half for Christmas. This year has been horrible, I'm sure we can all agree. But thank you guys all so much, for all the information, support, encouragement, all of it. I'm feeling a lot of things right now so I'm not sure if I'm even typing this in English. 

     

    I'll do a interview review thing shortly. Right now I need to decompress. I'm sure those of you recently approved will be familiar with the feeling but it's like... Literally my whole damn life from august last year to right now has revolved around this process and now it's done. Do I laugh? Cry? Scream all of that stress into the void and breathe in the glorious fresh air of relief? I'll update you all which one(s) I decide to do.

    Interview was completed on 1st December and then shown as issued on 2nd December and at the courier site near my home on the 3rd December! :) It was very speedy!

    1. DQ 10th July 2020 interview notice received on 13th November.

     

    2. E-Mail from NVC with the booking landed at 7am precisely on 13/11/2020.

     

    3. A little over two weeks.
