    Thank you for the assistance and concern.
     
    However, I was able to correct the error using the uscis service request "make typographic error corrections for a case".

    Looking at your previous posts it seems your husband was DQ'd in Dec 2020?  If you asked this back then then a petition for the son could have been started and more than likely be approved by now.
     
    Regardless, a new I-130 has to be filed for the son and there will be a similar timeframe for the process - about 2-3 years.

    Answering yes to that question doesn’t create a petition for the son. If you are a citizen and sponsored your husband under CR1 or IR1, then there needs to be a separate petition filed for the child. This can be either you filing an IR2 petition for your stepchild  (assuming child is under 21) or your husband filing F2A; it would be preferable for a number of reasons for you to file IR2, including priority of such petitions, no quotas and no risk of aging out once filed.

    When USCIS tells you to if you want your I-130 to be sent. If it's needed it will be instructed to do so in the approval of your I-130. Follow to join doesn't apply to IR/CR so it wouldn't be filed under that situation.

    I-130.  The step-son cannot be a derivative of your husband's case.   Either you or your husband will have to file an I-130 to start the process (assuming an I-130 was never filed for the step-son)..

    Yeah. If you’re born before 1992, you need an Attestation of birth, my fiancée advised me to put it on here after my interview but it skipped my mind. People born from 1992 upwards don’t need attestation of BC but 1991 downwards needs attestation of age. I am in that 1992 bracket and I brought my attestation of BC and they said it’s not required for me. Also I get to understand people born 1992 upwards don’t have any issues with the doubt about age by the consular officers.

    Thank you for your response. No other delays just the birth certificate. They changed the type of birth certificate required after a certain date of birth. He is going right now to get it … lol

    I am not sure anyone can answer that question.  The best course of action right now is to get the requested information back to the consulate as soon as possible, but each case is individual, so there could be other delays such as further background checks, etc.  Hopefully once he submits the requested documents, it will be soon for both of you.

    NVC just asked for the Petitioners divorce decree to be uploaded recently, so it's likely they're going to ask us for it at the interview and when we called they said to bring originals.
    Probably because it's a certified copy and they want to see it's authentic.

    You should take any originals you have, they may or may not ask for them, but also bring copies, this is for the case that they want to keep something.
    This will also vary by country.
    If the petitioner has been divorced they'll likely want to see that.
    And every case is unique so it can really vary in what they'd want to see or don't care about.

    Can you be more specific as to what is being asked for from the petitioner?  During this phase of the process, nothing is typically needed from the petitioner.

    DQ’ed doesn’t mean disqualified. It means documentarily qualified.  Meaning you completed the NVC stage and waiting for the NVC to send your case to the embassy.
