TinNhi got a reaction from Timona in Submit RFE response by mail AND online?
Thank you @Timona, I'll try to assemble an all digital version of what we mailed, so we can upload it before the 12/22 deadline.  We wouldn't be so nervous about what we mailed except for the fact we don't see "signature confirmation" from what we sent.  We only see "Delivered, left with individual" and we don't want anyone at USCIS to deny they received our response.

This is all we received and see from the USPS Express service we used:

    Status: Delivered, Left with Individual
    Status Date / Time: October 21, 2022, 1:00 pm
    Location: SAN ANTONIO, TX 78258
Postal Product: Priority Mail Express 1-Day®
    Extra Services: Insured
    PO to Addressee
    Up to $100 insurance included

We were advised to and did. Worked out for us! We did have to move quickly to get evidence right after getting married. I think we waited 3 weeks though to have the marriage certificate. (Lease, will, powers of attorney, pictures, bank statements etc etc)

OP, your list looks easily approvable! Best of luck.

    I would not do that.

Btw, do NOT send a binder of stuff.  USCIS specifically states they do not want binders.

Your Exhibit List / Cover Letter is impressive and you are well prepared.

Adding  something like “ Statement/Affidavit Re the bonafides of Marriage “ is actually an excellent idea and will contain important easy to read relevant info that will be supported by the evidence submitted.

Just think of describing A Forest ( example : in our married life we make all the big decisions jointly .and even make time to shop together at Costco twice a month.) not the Tree ( a typical day ..)

Good question but it's AOS from K1 so there was probably none of it ( which is ok ) except for the certificate and that might got lost with USCIS.

I souldn't bother with the one-pager. You probably have enough already but if you're concerned one simple thing you could add would be to draw up a will and a durable financial and/or medical power of attorney that naming the other person in case something happens to one of you. There are some forms online for free - just fill out one from your state, print and have notarized.

Here the post about the RFE.
OP you have solid evidence to send in. No need to explain to them in which order you make your breakfast 😉

I mean, by law you should have done it within 10 days of moving, but no, she's not going to be deported. File AR-11 online, I865 by mail, breathe, carry on.

You said your wife is going to get mad at you for not doing this. Remember, you're together in this process and it's a shared responsibility. She needs to do her part too.

Also, your evidence sounds strong, but if I were you, on my way tomorrow to drop off the I-865 to USPS I'd stop at Chase with your wife and open a joint account.
If you both have DL that show the same address, that's another evidence of cohabitation.

Though it's the law, nobody gets prosecuted for not notifying USCIS about address change. Don't stress yourself over this all. Just make sure to send it ASAP. Good luck.

TinNhi reacted to OldUser in Do I send original affidavits or photocopies to USCIS?
Send the original affidavits. You can always get them again easily. It's things like passports, naturalization certificates etc that you send copies if.

@TinNhi it's better late than never! File it ASAP. LPR needs to submit AR-11 and the I-864 sponsor needs to file I-865.

@TinNhi I've never done it, but you should be able to do AR-11 online:
    https://egov.uscis.gov/coa/displayCOAForm.do

For I-865 that can only be done on paper as far as I know:

Even if you don’t have a joint bank account, if you can show you intermingle funds, or you pay her expenses as household expenses, that’s the next best thing.  If she’s an authorized user of any credit card, that helps.  I think that aside, you’re pretty solid.  Writing a letter helps-address anticipated questions.

Aldo shared gym membership, Costco accoun, AAAt-stuff like that can help.  Just thinking beyond bank and utilities.

OP, all of that sounds quite solid.  What did you send initially?  Did you not send the marriage certificate?

I agree that you should be able to get a joint bank account with just an SSN.  She does not need to be a green card holder.  My husband and I opened accounts at our local credit union after he got his SSN.

@TinNhi you need to look into different banks. I opened accounts in my name with non-immigrant visa, so LPR wasn't the requirement. Especially if your spouse has SSN, it should be possible.

Have you tried the following banks?
Bank of America, Chase, TD Bank, US Bank, Wells Fargo.
I had accounts in three of the banks from the list above. No issues opening with my foreign passport and valid visa / documentation.

TinNhi got a reaction from Tom.Jen in SHE PASSED THE K1 INTERVIEW! (Ho Chi Minh City, Vietnam)
My Fiancé passed her K1 interview at the U.S. Embassy and Consulate in Ho Chi Minh City, Vietnam an hour ago!

Here are the questions she was asked:

How did we meet? How many times did we meet? What are your fiancé's hobbies? What things does your fiancée dislike about his work? What is his job? How is his day? Describe his job? What is his address? What do we typically argue about? When was the last time we argued, and about what? How did he propose to you? Time and date? Will your parents attend you wedding in the U.S.? Where do you plan to get married?
They also asked "after 2 months your fiancée proposed?" She answered "yes, but it was more of a promise to try our best to stay together in long distance relationship."

I was not present for her interview. We did not have an engagement party.

The first question was in English. There was a female translator who translated the question to Vietnamese. But my Fiancé answered in 100% English . The translator then smiled and stepped away after that. All English thereafter.

We used RapidVisa to prepare our I-129F. (before we discovered this forum) No regrets, because their review of our petition and evidence brought us peace of mind. However, RapidVisa was not involved, nor did they really help us after NOA1 and NOA2.

If you have any questions, please ask. We want to help others going through this. It's been stressful beyond belief leading up to the interview.

Here's a TikTok video she made of everything she prepared, organized and brought to her interview.
