Sunfl0wer got a reaction from 2022 in Filing I130 in person - expedited
Our situation fell under this.... He accepted a job they needed him immediately.
Short notice of position relocation: A U.S. Citizen petitioner, living and working abroad, who receives job relocation within the same company or subsidiary to the United States, or an offer of a new job in the United States with very little notice (employment letter is required).

again, just sharing my story because I asked on this site back in March how I could get my family together as fast as possible I got a lot of sorry not possible, just wait it out like everyone else - you'll be together in 12-15 months.  Nobody once said oh he had a job offer, you can file dcf and get there in 2 months.  Guess I shouldn't have bothered posting my story thinking it could actually provide some encouragement for others in a similar situation.

I'm not sure where to post but I just wanted my story out there in case anyone else gets in the same position as I was.
    our history....
me Born in Canada. My husband born in USA. He came to Canada, became a permanent resident, we met and got married we had 3 children to whom we all gave born abroad status to when they were born in case they ever in their lives wanted to go live in the United States. My husband became a Canadian citizen. Life was good. Fast forward 12 years he gets the job offer of his life in Philadelphia and accepts without thinking bringing me would be an issue.
We filed I130 in March and got Nebraska. I was led to believe there was nothing I could do to expedite our case so we just sat for months waiting for something to happen.  In Aug we got fed up, hired a lawyer who wrote to the Montreal office asking for DCF. They gave us an appointment in Toronto to file DCF Aug 30. We heard  back Sept 30 with packet 3, sent that back, packet 4 came on Oct 3rd with interview Date Oct 18th. I needed to get a police check and medical done in that short time. Unfortunately my police report didn't get returned to me in time (I did it Oct 4 at commisionaires, showed completed Oct 7 but never  arrived in the mail until Oct 23) I went to my interview they only really asked about my police check and if I have ever been in the US longer then 6 months. Gave me a form to send back free courier with my police report and passport said everything else was fine. I couriered back on Oct 23. They sent it back to me on Oct 30 complete. I drove directly across the border, they processed me quickly at the border. So total process took exactly 2 months from dcf to permanent resident even without having my police check at the interview.

Wow, thanks for sharing.  I had a new job offer last year and no one, not even a lawyer we consulted told us of that option.  We finally have our interview in two weeks after originally filing in April 2018.  I do hope your posting will help others!

The decision to be processed is made through the office in Mexico, but the actual processing is in Canada still.
DCF is not generally available due to the lack of a USCIS field office. Exceptional circumstances applies anywhere, though.

Well it would be lying if you just picked and chose.

    OP
I personally wrote down all 13 addresses for 18 moves that I had.  I used google maps, old pay stubs and tax returns.  I made sure to only put down places i actually would consider a permanent and not temporary so some place a recieved mail, and would have changed a driver's license to.  Because I also did an internship in the USA before 9/11 i put that address as well even though it was for 3 months.  But I had a police report there for a stolen wallet.

Sunfl0wer reacted to fdhs in Filing I130 in person - expedited
Providing they approve the exceptional circumstances, the processing of the I-130 should go quickly (since there isn't a pile of them that the embassy has to go through). It took us about 1-2 weeks to get exceptional circumstances + I-130 approved.

You then have to get the medical + schedule the interview for the beneficiary at the embassy - this can take some time, depending on how many free times the embassy has for interview, etc.

Overall, from the thread about exceptional circumstance filings, I think 1-2 months seems standard.

Thanks 😊 Reading the whole article it seems that it is almost impossible to prove there was no intent in the case of spouses, adjustment would be doomed to denial and, at least those attorneys, avoid them at all cost.

This is one attorney's  opinion-written article:

    https://www.soundimmigration.com/can-i-enter-on-a-visitors-visa-b-2-and-then-adjust-status-to-permanent-resident/

"Even if the person gets into the U.S. they still cannot adjust status to permanent resident.
Let’s say our Chinese wife gets into the United States on her B-2 visitor’s visa. Remember that all along she was planning to apply for residency, so after entry her husband files and I-130 Petition for Alien Relative and she files an I-485 Application to Adjust Status to Permanent Resident. She’s already in the country, and their marriage is legitimate, so is she home free? No.
An I-485 application for permanent residency is considered an application for admission to the U.S. This is a counter-intuitive concept that many struggle with. Even though the applicant is already in the country, U.S. Citizenship and Immigration Services (USCIS) treats the person as though they are outside the U.S. and seeking entry. Why does that matter? Because the person is screened for all grounds of inadmissibility.
What are the grounds of inadmissibility? The immigration statute has a long list of rules about whether a person is admissible to the U.S. A person is considered inadmissible if she has certain diseases, has committed certain crimes, is a security threat, etc. But a person is also inadmissible if she has committed immigration fraud. Under INA 212(a)(6)(C)(i):

Stranger things have happened. In a few cases I-130 petitions are somehow getting IOE numbers. And those petitions are processed relatively quick. In the thread below the petition was processed in 2 months:
But this is the exception, not the norm.
