IR-1, CR-1 or K3 what do I want?

I have my notice of action from sending in my I130. I am Canadian living in Canada with our kids. My husband of 11 years moved to Philadelphia for work in January. My kids have dual citizenship. How do I get us there the fastest? I don’t need to work I just need to move to get our family back together. Do I want the K3? How soon would that get us there? Thank you.

You can forget about the K3 because there was less than 18 given out last year. So it would be a IR1 and the wait time is about 12-18 months right now for him to bring you over.

K3s are obsolete.  You and your husband will have to start the IR-1 process.  The entire process will take 12-15 months from filing to visa in hand......

When your husband left for Philadelphia he lost the ability to file within Canada and now has to start the process stateside.

 

Fortunately as a Canadian you can go visit anytime.

"Force families to live apart"?  No, your husband could have remained in Canada for the process......there are normally more than a million I-130s pending processing in the system at any one tome.....The queue is long.

All of our paperwork has our Canadian information on it because he doesn’t have a “home” there

Exactly the SAME process....except for certain circumstances.  Being apart is part of the immigration process, unfortunately.  Most of us have been through it.

Ok. Thank you. His job offer was very misleading and they said they would take care of my immigration then changed the offer once he started so it’s unfortunate for us. We were naive in thinking it was easy join my husband and children.

His Job offer was only 2 weeks before his start date. We never had any intentions on living in the US prior but he was offered the job of his life. I guess we suck it up now. Glad I didn’t sll my house

I'm sorry that your family is in this situation.  The US immigration process requires a great deal of knowledge, planning, time, patience, and money......

Why does it say 7-10 months on the webpage? Is that just for the I130 part then you need to add on the rest of the forms after?

Thanks  thankfully they will pay for all of it but that seems like 1/2 the battle only.
