    Yes, twice now. No issues at all, it was an extremely smooth process.

    How long do you think it should take to approve an I-751?
     
    I could do 99.99 percent of them in 10 minutes each.  
     
    I could RFE the other 0.01 percent in an hour.

    = 333.5 hours to work through the back log.  That’s less than 9 weeks.

    I’ve just submitted mine! I kind of wish I didn’t wait so long to do it seeing how easy this was to complete. After doing the ROC I just wanted a break from the whole process, but this was a lot easier (submitting it all online made it a LOT easier too!) 
     
    Looking forward to completing this next chapter and finishing off the whole process for good 😄

    Sorry for the delayed response. I reached my post limit yesterday, so I could only read the comments you all left for me. Today, I'm going to clear my mind, summarize things, and submit lengthy posts, Cathi, davidvs, aurelius22 I wanted to reply so badly.
     
    My American friend says otherwise. He doesn't think my B-2 will be denied. In fact, I applied for B-2 and paid the application fee of approx. 26000円 ($180) yesterday after speaking with Jorgedig. The fees are non-refundable. So, I'm hoping you'll all advise me to take this route (B-2) for the time being. I could be a complete moron. But let me act young and dumb shortly because I didn't have a good childhood (big chunks were bullying at school, domestic violence at home, and depression).
     
    The following are the reasons:
    1) I am a recipient of a Japanese government scholarship. I was awarded a highly sought-after scholarship.
    I will present this fact to the immigration officer. Japan is more advanced than the rest of the world in many ways and has a high standard of living.
    He/she may believe I'm not going to blow this opportunity I worked so hard for.
     
    2) Japan is the place I call home these days more than Mongolia; I'm financially and academically connected to this country, but not emotionally or socially.
    If I leave this country, I will lose a lot of money, my degree, and possibly my bright future. I will also present this fact to the immigration officer.
     
    3) I'm a global member of an NGO called oSTEM. I'll bring up that I'm affiliated with a US-based organization.
    This organization is dedicated to LGBT STEM students and professionals. They do, however, only operate in the US, UK, and Canada.
    Unfortunately, because I didn't live in the same country as them, I never felt like I belonged.
    I'm going to shamelessly ask them to assist me as well.
     
    4) I purposefully chose a more relaxed, less crowded embassy for the interview location. So it must have something to do with the success rate, right?
    I'll put on my natural smile and compliment his/her outfit to brighten his/her mood, haha. The probability of success jumps may jump slightly. Something is better than nothing.
     
    5)I'll need to make a copy of my bankbook to prove I have enough money. Because I can afford to travel, the problem is my passport was issued from ...
    I mean, surprisingly I didn't find the phrase "third-world country" to be offensive. I am sorry anyways, you seemed a bit offended, aurelius22.
     
    aurelius22, your story is so inspiring, and I completely understand you. I shed tears. I wish you the best of luck in everything you do.
     
    katiana, Yeah I can't imagine Serbia being LGBT-friendly. I understand your pain.
     
    Coco8, Japanese borders are closed to individual tourism. We don't know how long it will stay that way.

    AffableAndy, Thank you, buddy. I feel like being int. student of Japan has similar status as being int. student of the US. aurelius22, that's why I came off as "overly confident".

    I am in a same sex marriage now, but I was also was an international student with a relatively weak passport (Indian citizen, though I was a student in the US). While I was a US student, I got tourist visas within the US to the UK and EU with no issues, they just wanted to confirm that I was enrolled. One trip was to visit family in the US, the other was to visit a friend who was also an international student in Germany. Obviously there is always the risk of being rejected, but it was a very smooth and easy process.
     
    After finishing my US undergrad I also got a B1/B2 for the US (albeit from India) with no issues, though of course I did not have a boyfriend at the time, we met when I came back for grad school a couple of years later.
     
    It can be a little scary but you are in a developed country already and presumably following the regulations in Japan that relate to a student visa. I'd apply, worst thing that happens is you get denied and go meet up in Thailand or something instead.

    We just got back from a trip to India, and the extension letter caused absolutely no issues at all. I was a bit nervous about being asked questions as we are a same-sex couple but the airlines staff and immigration officers did not bat an eyelid. That part of the journey went very smoothly.

    My husband's window opens on September 21, and we'll file a couple of days after that. His I-751 has not been approved, yet. Our documents are pretty organized, so we'll be ready!

    We can do this in late October and are already planning to submit the N400 at the earliest possible time allowed by the USCIS (Universally Static Collection of Inert Syndicates).

    I can't say it's really hearsay if her loving husband is on here telling us that she admitted to him that she lied on entry. Pretty open and shut to me, but hey...I don't know what the bar is for triggering VJ's ToS.
     
    Would be a whole another matter if it was a scorned ex on here telling us that. I have every reason to believe OP's claims, which is why I advised the way I did. As much as I hate the fact I had to provide that advice, given a different situation I'd be more than happy to tell them to AoS otherwise.
     
    Personally and as someone who came through Consular Processing, I don't give two damns about the whole 'jumping the queue' thing. It's all artificial rubbish at the end of the day, rules that were in place because they were meant to be cruel by design which is drawn out from a system that had racial quotas and said immigration law that is on the grand scale of things, pretty darn ancient. Those people who AoS aren't making Consular Processing take longer, if anything, it's one less person in the queue for interview at the Consulate.
     
    This is why I'd never advocate for AoSing from tourist visas/ESTA to be banned. All it's going to do is clog up the diplomatic missions even further, cause more heartache and separation for couples. I get a lot of people here have the mindset of 'well I suffered through it, so should you'. We should advocate things to be better for the people who follow us in their journeys, not worse, rather than just saying 'rules are rules' and because of that saying that the rules must be made worse.
     
    Anyway, before I get reprimanded for going off topic on this thread, I'll leave it at that.

    She signed documents asserting OP would live with her. There are legal consequences to denying a spouses access to their homes.  
     
    OP and wife convinced either other, USCIS, and State the relationship was bonafide. OP has a right to figure out what is going on with the relationship 
     
    That observation seems to be employing a stereotype.  
     
    Lawfully moving  to the most  advanced country in the planet is the opposite of a world of hurt.  
    I’ve been detained several times by CBP, INS, UK border force, Australian border force.  If one cannot cope with that possibility, one should not travel internationally. 
     
    Based on the post, OP has done nothing wrong and will not be doing anything wrong by coming to America. 
     
    1. Get a job 
     
    2. find a place to live. 
     
    3. remind her that she has to provide financial support when his income falls below $1400 a month 
     
    4. Find a lawyer skilled in the art of enforcing number 3
     
    OP’s wife had a choice. And still has choices. OP is supposed to wait in limbo until it is “convenient”? Is OP an object or thing?

    It doesn't really matter, but remember to file using the correct address! For AoS there is one address for USPS and a different one for Fedex/UPS/DHL etc.
     
    I used UPS because I live near a UPS store and USPS closes before I get home from work.

    I personally wouldn't trust USCIS with an address change in this situation. They are notoriously bad about processing address changes as it is, and filing 2 different AR-11s in a 12 week span could mean them using the wrong address down the line. If your permanent address isn't changing and your partner will be at the old address for the 12 week period, what is the purpose of updating? You would still want mail to go to your home, correct? Also, if you are going home on your off days, even less reason to change addresses.

    There were a few people on the LIN updates thread who got their I-751s approved shortly after putting in their N-400, so I don't think they are necessarily related.
