    Hello,
    so sorry you’re in this situation! First, you should report your lawyer to the State bar, so that there are no more victims of his incompetence and lack of commitment. Just because he’s pro bono that doesn’t mean he gets a free pass to be lazy. 
    Second, I would have a free consultation with another attorney and see if they have payment plans. Some of them do. I know Jim Hacking does, and he seems to be very competent.

    The tourist visa would be a very hard sell.  First, they are DQ'd at NVC for their IR5 visas so they have clear immigrant intent.  Second, the interview wait time for a tourist visa is longer than the wait for their IR5 visa.
     
     
    The expedite request has to show evidence on how the benefit sought (in this case, your parent's interview and subsequent immigration) will solve the situation.  You mentioned it is your first pregnancy and you need guidance and support.  What about your wife's parents and family?  What type of emotional support would you need?  Do you have any medical references to back up your claim of requiring support?  What type of physical support do you need?  Are you or your wife disabled and you need someone to physically take care of you?  Why specifically do you need your parents and not anyone else?  You will need to be able to address these questions and related ones if you want to present a strong case. 
     
    Just stating "I want to expedite because my wife is pregnant" would be denied as soon as they finish reading your email.  To them, they would interpret it as "you are using your wife's pregnancy as an excuse to bypass the queue."

    It makes sense that they would have to be older than whoever the affidavit is for - as they are certifying that they know the birth took place on xxx day. If they were younger, they would have no way of knowing of that, as they couldn't possibly have been there - instead, they'd just be writing what someone else told them, which doesn't really prove anything.

    This is exactly what we did - it made a good sized reduction in our mortgage rates, because my husband's perfect, long-standing credit score wasn't sullied by my barely-established one.

    That's not to say the OP should worry - there's no value in that - but there's also absolutely no guarantee, unlike you seem to be suggesting.

    I can't see why they would waive the fee, to be honest. I know it was lost under very unfortunate/traumatic circumstances...but it was still lost for a reason outside of USCIS's responsibility. 
     
    I have absolutely no knowledge of when and why they do issue waivers, so this is just me guessing by the way - but they're not normally known for their compassion.
     
    I know that wasn't the answer you were looking for - and 100%, definitely try - worst that can happen is they say no. I hope it goes well for you 🙏.

    The multiple copies could get CBP the idea that you want to resell and could trigger a custom fee. But that's the worst I can think of.

    That does not matter. You can't try to change the story. You admitted in your post that your husband went to jail for his brother. That means on paper, he admitted guilt and was convicted and sentenced. It does not matter who the real culprit was... your husband willingly served the time and now has the criminal record.
     
    That drug record disqualifies him for a lot of visas, like the multiple futile attempts for a tourist visa.
     
    Listen, we want to help you, but there are some harsh realities you and your husband must come to. Your husband has a criminal record for drugs. Even if he did the time to save his brother, he must bear the weight of that decision.

    Just keep in mind that a US spousal visa, when it is eventually approved, is for immigrating to and residing permanently in the US.  Good luck with your marriage, I-130, and CR-1 process!

    After reading the letter, I think any appeal will be futile.  In the eyes of USCIS and DOS, there is very, very serious doubt about your relationship.  In my opinion, the best course of action is for you to relocate to your spouse's country, Pakistan, and live together as a married couple for a year....then resubmit your case again.  The only thing which can really resolve doubt about a relationship is more time actually spent together.  Good luck.  I hope it works out.

    Did you not like the responses you were getting on Reddit about this? Several people answered you there, but here's the thing, just because you don't like the answers you got doesn't mean they were giving you incorrect information. You'll get the same info here. And asking across multiple VJ and Reddit accounts doesn't change the facts either. You got rather argumentative over there. Please don't do that here.

    I realize you are only 15 and probably not aware of how US immigration works, but you can’t just “immigrate”. You need a petition filed on your behalf by a US citizen or green card holder close family member (sibling, parent or, obviously not applicable in your case, child; or to be under 21 and a derivative on such a petition filed for your parents), or you need someone to sponsor you for an employment based green card, which will require a college degree and usually some experience and, often, writing US licenses exams. If immigrating to the US really is an overriding goal for you, then (could change) but nursing is probably one of the easiest ways to get an employment based green card, however you would first need to finish high school and an acceptable university at a minimum for that so it’s not something that’s going to happen soon.

    I actually think you're not understanding the points that JeanneAdil is making, though I appreciate that her wording isn't as clear as it could be.
     
    In all honesty, I think you'll be fine doing the trip you're doing and that she'll have no problems getting back into the US. I did the exact same trip whilst visiting friends in the US (though I wasn't dating anyone in the US at that time and I'm from the UK - whilst is a much lower fraud risk than the Philippines. Both of those factors would have helped my ease in travelling.). 
     
    But still, I wouldn't worry about it and I would make the trip, in your shoes. I just wanted to flag that the advice you've been given is actually valid - I don't think it's a cause for concern, but it's factual.

    You’re still on the hook for I-864, affidavit of support, that was filed alongside I-485. Divorce doesn’t absolve you of that responsibility.

    I think you are stretching the intent of the rule if you travel alone.  CBP could easily deny entry when they find out that your child lives in Europe.

    No photos aren’t required, but—-Hand your phone to somebody working there. Get a pic with the judge. Do the same outside the building. Go out for dinner and have a waiter snap a photo. It’s your wedding day, so commemorate it in some small way. You’ll have something to look back on and I’m sure your families would like a visual of the day.
