Your husband as the petitioner/sponsor files an I-864.

The Joint Sponsor files a separate I-864.

The Joint Sponsor's spouse files an I-864a.

Order free tax transcripts from the IRS.

Hi! Yes I have travelled twice now under ESTA, once with my USC husband and son and this second time alone while they were here in the US. No issues at border at all. When the immi officer at SFO asked why i was here I told him I was visiting family, he asked what family and I told him my MIL. He asked where my husband was I told him he was already here and i was coming to celebrate hubbys grandfathers 83rd birthday. He wished my a happy visit and sent me on my way  I was here for 7 weeks the fist time, I was in Australia for about 10 before leaving for the US again.

You need the AFP check, not NSW. Fingerprints are not necessary as long as you pick the right category when filling out the AFP online application (Category 33 - Immigration/Citizenship which includes ALL offenses, whether unspent or not).

From the Australian embassy - Australian police certificate: You must apply for an Australian Federal Police Certificate (AFP). Australian police certificates are valid for 12 months from date of issuance. Your certificate can be based on a name check or fingerprint check. If it’s based on a name check, it must contain all aliases previously and presently used. Failure to provide a name check certificate with all aliases may result in the consular officer refusing your application for a police certificate based on a fingerprint check.

Your USCIS Case Status will change to reflect when it was sent to the NVC. It will say something along the lines of "On XX Date, your case was forwarded to the National Visa Center for processing". It takes about 1 week from this date for the NVC to receive the petition, and another 5-7 weeks to receive your case #.

No you just wait. The NVC will contact the petitioner to upload the I-864 / other documents

I worry about this myself . My husband is the USC and we ( he, our son, and myself ) packed up everything and moved from Australia to Texas 6 weeks ago. I am still awaiting approval so I am really only here visiting until all of my paperwork is approved. I leave in 2 weeks to go back to Australia 1) so that I don’t overstay  my ESTA and 2 ) for my daughter’s ( from my first marriage) uni grad. I will stay in Australia for a couple of months and come to visit again  before going back to Australia until my application is complete .... the whole visa process is taking FOR.EV.ER. We lived in a beautiful part of Australia and well Texas ain’t that! We moved because we had come to a standstill , we were stagnating and we needed to shake things up a bit . We currently live with my in-laws ( which is rough) until my husband lands a job and we get on our feet so we can move on. Our boy (7) left a lovely little catholic school to attend a much larger public school but he appears to be coping really well and liking school as much as he did in Oz. It will be hard for me to know if we have made the right decision until we are out on our own and not living with the in-laws so I am trying to reserve my judgement until then . My situation is different from yours though in that my husband said even before we left that if we ( ANY of us ) are unhappy and wants to go back to Australia then that is what we will do . BUT I think we have to at least give it a chance first. I left a lot in Australia... 2 children (22 and 18) and I question daily if we have made the right decision. Only time will tell I suppose.

Talk to your husband... you have already given so much.  If he’s not willing to listen or compromise then maybe that is all the answer you need on what you should do.

    Good luck to you xx

Normally at least the amount of time in the US, but preferably double that. Maybe a late summer trip back to visit the US?

There’s no way to say what will or won’t be “safe”.. there are general thoughts such as twice as long out as you were in.. which would be 3 1/2 months ... but the deeper issue is the need to avoid any appearance of using the ESTA to essentially live on the US while waiting for the process. A shorter intended stay next visit might be a wise choice too

My husband is the USC and has no idea what it is like to adjust to a country and often we do it all so effortlessly. Having said that... above there is a comment by someone else about how this could happen to you in Australia being married to an Australian husband as well.

I believe this is a host of factors coming together: One, you left your comfort zone and while exciting initially, it does kind of wear off a little. Secondly, when a baby is born, many of us start feeling closer to your birth family as there is a sense of familiarity. Also, giving birth happens to be such a whirlwind experience. The marriage is often different giving birth, intimacy is different, communication changes, the sense of being able to leave everything behind and start over new back home is definitely never going to be a real option again (even though you may not want to exercise that option ever).

My first now ex-husband and I never managed to integrate children into our relationship and we ultimately got divorced because we never managed to transition from being a no-kids-double-income to a kids-double-income-equitable-share-in-duties couple. I felt so lonely and had wanted to move back to my family. And that happened in the same country.

I guess what I am trying to say is - perhaps it is not necessarily just homesickness but also a sense of loneliness in your marriage? Or a lack of communication?

Move to a larger city in the US. The fact that you moved here from Australia but he won't move 30 minutes away from where you live now is downright alarming.

LiddiaJ got a reaction from Bayman in Change of address with USCIS
    Hi,

I am trying to change my address with the USCIS for my NOA2 if and when I receive it. I went to the USCIS website and followed the instructions, however it is only giving me options for US states and territories. I am an Australian Citizen living in Australia and my husband is a US citizen who was living in Australia when he petitioned for me ( he is still living here) . Can anyone give me any advice on how to actually go about changing my address from one Australian address to another? Any assistance would be appreciated.

    Thanks in advance

You can reverse who does the I-864 and I-864a.  I would do that if the FIL earns more.  However, it is still best practice to have the joint sponsor's spouse provide and sign an I-864a.  Study those form instructions.

    hi

your husband is and always be the primary sponsor so he will have to fill out an i864 affidavit of support regardless

his mom will be his joint sponsor and will file the i864 and her husband as her household member will fill out the i864A to combine their income, as they are married and living in the same house.

they will need to find out if they make enough to cover themselves, their family, and you as the beneficiary

if they don't make enough, they can use assets to supplement the difference

or find another joint sponsor all together and forget about his mom, two joint sponsors can't combine their incomes, only a joint sponsor and their household member can
