    Sure she can, go ahead. But it is absolutely frowned upon and is legally considered immigration fraud. Multiple forums have confirmed this, and they have also stated that it against VJ ToS. 
    Don't look for an easy way out. They can apply for the K1 visa, get approved, she can come to the United States and get married within 90 days. They can get married first, she can return to her home country and they can apply for the CR1 visa, get approved, and she can legally immigrate as a permanent resident of the US. 

    Coming to the US with intention to marry and adjust status CAN be done but it risks being denied, deported and even banned. I would not recommend this!

    To my knowledge from what i have read and having travelled on VWP (which i assume is the same for you as you had to do an ESTA) you CAN NOT change status while on a wavier visa, it is a huge NO NO!! Don't do it......it will be declined and you will have breached the wavier rules and be in trouble. You will need to leave and then file a K3 or CR1, but for your own peace of mind check it out on USCIS (VWP) or your home US embassy site. This information applies for Ireland and i believe it is the same for all countries granted VW visits.

    I agree on the material misrepresentation possibility. Is it a huge risk? Maybe not. But it may also be on record that you said you wouldn't adjust and knew you were not supposed to, and since you entered on VWP you get no appeal if you are denied.
    I would either file for a K-1 now or marry now and file for a CR-1, you can stay till the end of the 90 days anyway and still visit back and forth while it is processing.

    It generally takes longer for permanent residences during the NVC stage, therefore, US citizens do have priority during the process.  US Citizens' immediate relatives (spouses included) have "unlimited" visas issued each year. Permanent residences do not have this, and therefore are limited by that.

    Nothing has changed my opinion based on what the letter says; it clearly indicates that the reason for denial was lack of an RFE response, not an insufficient response.

    It clearly states that only the INITIAL evidence with the i-130 was not sufficient. It also states that CLEARLY that "as of this date you have not responded". They did not state that their RFE response was not sufficient. Therefore, it is the fault of the USCIS, not the petitioner.

    I seriously have much to say but i will try and keep it simple. To us believers, we know and acknowledge God in all we do and at the right time it will surely happen.
    I have been so anxious and couldn't understand why even date for interview could take a whole 3months but it finally came on the 17th of December,2018.
    My appointment was scheduled for today 17th January, 2019 and i went with all my documents and album.
     
    This is what i think. You are approved or denied even before you get there and so me i think filing and front loading is key.
     
    I got to the embassy at 5:45am (Interview time was 8:30) and it was like i was the first to be hanging around. At exactly 7:00am we were all lined up and marched to the gate for inspection of our appointment letters. We went through the scanning and into the consulate. We plenty rough and funny enough it was the old women who were getting the Visa's....lol.
     
    Fast forward, i was called to the counter to present my documents.
    She asked for
    1. Original Birth and marriage certificate, Police report
    2. Proof of relationship (Pictures/Financial transaction/Tickets) which is all she took and rejected the pay stubs, Wedding cards, whatsapp chats and social media print out that i did.
     
    I went back to join another queue for the interview and the lady called.
     
    CO: Can you please raise your right hand?
    Me: Right hand raised
    CO: Do you promise/swear that all the information you have given are true?
    Me: Yes
    CO: Who is petitioning for you?
    Me: My wife (I mentioned her full name)
    CO: Have you traveled outside Ghana before?
    Me: No
    CO: Do you have a child?
    Me: No
    CO: Does she have a child?
    Me: No
    CO: Can i see your left fingers?
    Me: I raised them.
     
    (She nods seeing my ring)
    CO: Can you place them on the machine for a scan?
    Me: I did
    Co: Congratulations, i'm gonna issue you the Visa. All instructions are on this paper. Go for it at the DHL Office within 2-3weeks.
     
     
    Whaaaaaat! That's it? Hmmmm.
     
    In as much as people share their experience, if what i experienced is anything to go by, then this Youtube videos i kept watching about peoples experiences really affected me. Sleepless nights, studying the documents like i'm going to write my final paper at school. Chai.
     
    So this is my story and what i think. If your case is genuine, just make sure you get the right documents. Just use the check list, pray to God to guide you and sleep. No need to be scared of anything. They are not there to refuse you. A woman almost collapsed right behind me cos of what she had been told. Her Son was trying to calm her down but still and i told her, they need to place the Visa in her Passport and that why they called her to come with her passport so she shouldn't be afraid. She heaved a sigh and guess what? The CO was smiling with her when it was her turn.
     
    Relax guys. Nothing to be scared of if your marriage is genuine and your documents are intact.

    USCIS, NVC, etc. probably know that California is very lax with the living together requirement for a confidential marriage certificate. You should be fine.

    Please understand that for the self employed, it is not "income" until it appears on line 22 of a 1040 form that is actually filed with the IRS.  Revenue minus expenses is "income" for business/self employment earnings.  If their line 22 total income is well over the required amount, they can leave the asset sections blank.
     
    Since YOU are self employed, your "income" is also from line 22.  That may or may not be the same number as AGI.

    I recently had this question as well!
    Your date of entry to the United States with your issued spousal visa is what determines your type of residency you receive. If you enter the USA after the 2 year anniversary of your marriage, you'll be issued a 10 year green card/ permanent residency! So just be patient!!!
    So excited for you! We send our I-130 package out next week!

    Just here to say that denials are absolutely heartbreaking, and that I am sorry to hear about this. Please don't give up, spend more time together, get married, and re-apply for the CR1/IR1 visa when the time is right and you have plenty of evidence.

    I got married in CA and got my marriage certificate the very next day. But we got married in the City Clerk's office, so maybe that is why it didn't take long.
    We had a confidential marriage, USCIS didn't care. Confidential means that no one else will be able to get a copy of your marriage certificate, except for you two. Me and hubby thought it was a good idea, and did the confidential thing

We still didn't get engaged until our second meeting (four months later) and didn't file until after our third another three months later (when I met her family). And there don't appear to be any special things we need to do for Moscow.

    Dont wait to submit the I-130. The determining factor for the IR1 vs CR1 is entry not submission of I-130 or even visa approval.  As long as you are married for 2 or more years upon entry you will get the 10 year green card.

    The entire process takes about 14 months or so.  Plus the visa is valid for 6 months after medical date.
