Did you have an RFE between 2021 filing and 2024 interview waived approval ?
It was standard practice that they RFE all cases that sat pending for long…so am trying to see if that is changing. Thank you

Not that I am aware of. I just saw on the USCIS website that it went from pending that entire time to approved as of yesterday.

I was reading the news today that there may be immediate cash payments to Americans as part of a potential coronavirus stimulus package to help boost the economy.

If this is approved and goes ahead I wonder if this will be for permanent residents too and if so would this affect the concern that the other user expressed?

Wondering the same thing?  My husband has his Green Card working in a restaurant that recently closed because of COVID-19.  I know everyone he works with is going to collect unemployment but this seems like a grey area for immigrants.

  3. Just in case somebody from KCMO stumbles along this post during their visa journey.

We were helped by a very helpful woman at the gladstone DMV (would 10/10 recommend going there).  She made a call and was able to get my husband's drivers license extended for 90 days at a time.  She said we could do this up to three times and that hopefully it would last until our AOS interview.  We had to go back and get another person at the DMV to renew it a second time (worked again) which was enough to last us until the interview.  All we had to do was bring his expired license and the I797C form!

Hope this helps someone in the future

    K1 AOS I-485

    Part 2 Question 1a.

Interesting, thanks for the reply!  Why did you have to send in a copy of your NOA1? Isn't that just the notice of receipt of application that you get a few days after sending in the original I-129F?

I think we just did it for extra measure and then realized we didn't need to send the NOA1 later.

I was not able to get a DL in St. Louis until I got my EAD. Didn't want to get one which would expire with the K1 because I was using my old DL.

So I did all the exams with I-94 and visa and went to the DMV once I've got my EAD.

These are the accepted documents for REAL ID:

Looks like they still dont' accept the 797C which you will get once filed for AOS. Maybe you can who knows.

    Thank you

The I-94 date won’t change. He will be in a period of authorized stay once you have the NOA1 for the AOS packet you submit. He will have to wait until he has an EAD before he can get another license. One of the (many) pitfalls of the K-1...

Damn, well we knew it was going to be harder with the K-1. Just didn’t factor in all of the little things and forgot about the license. Not the end of the world, but would have made life easier.

Once the I94 expires, it expires.

Some states offer extension of the temporary 90 day license by showing the I485 Noa1 receipt notice but most will not.

Most states will only issue a license once the EAD or GC is approved and that was something that we just accepted as we knew that when we came in on a K1 Visa.

If you needed to drive, a Spousal Visa would have been better.

Check your state's DMV for documents required for Non US Citizen DLs.

    It varies by state.

Yeah, we fully understand what we took on choosing the K1... just want to check our options on driving. The DMV webpage says that for adjusting status you need “Immigration documentation indicating status AND one of the following : 1.) employment authorization document I-688B or I-766
    2.)Passport “

Just want to comment on it. I was there today trying to get a driver's license... They didn't care about the NOA1, only if I would get the NOA2 which is basically being approved for the green card. They told me they can't do anything, the only way according to them is i-94 + Passport which  is basically the K1 status and even if i pass the license would expire when my I-94, so I am back to square one.

Hi, we are living in KC and basically experiencing the same thing. They gave my husband a license but the expiration date is at the beginning of September (when his i-94 expires). I was wondering if you’ve gotten anymore info or anything on this?  The DMV website says that for licenses during AOS they need “immigration documentation indicating status and one of the following : employment authorization document i688B or i-766 or a passport”

this makes me think that the NOA would be the immigration documentation indicating status and then you would only need your passport. Of course all of this is fine and dandy, and the DMV can decide what they want. We have found that the gladstone DMV is a lot friendly than the others, so we will most likely go there when we get the NOA

  9. My fiancé entered the US and came to live in KC on June 9th. We got married July 6th, we were able to get his social security card and a drivers license for him. When we went to the DMV they were able to issue him a drivers license but they said they could only issue it to the date of expiration on his I-94 which is in September. My question is, we are going to send all of our paperwork in for AOS on Monday, when USCIS receives this, I know we will get a 797 but will it change the I-94 date or update it?  It looks like the MO dmv will only accept a passport and I-94 for K1 visa applicants. Any help is appreciated.
