From I751 divorce waiver filing point of view: the requirement is of a divorce that's been granted by the court. So unless that or the filing of divorce papers has happened, I think, I751 application would remain in status quo and there is no need to update it with anything.

    You are welcome!
As you are filling the application online, step by step (after each answer, you have to click “next”), and it asks you for the proofs. That’s how you attach any needed document. In the end you can add whatever you thing it is necessary as “additional” documents.

Wouldn't it be better to resend everything back to them with a letter attached stating clearly that as petitioner (that is you), you never assented to withdraw the case and therefore you are requesting USCIS to cancel the Withdrawal in the first place and switch your case to Divorce Waiver?
I751 is not a Joint Application. A spouse signature to show the marital status doesn't give the USC spouse any whatsoever equity into YOUR I751 case.
I am at a loss to the lawyer you talked to who saw no problem with this line of argumentation.

I saw this piece as an effort to fill the larger picture of a joint living in marriage in the IO's mind where this type of information is not at all critical evidence but I think it creates some nice vibe after you have already presented all the financial, legal and other hard evidences in your packet.

Do you live in a district repped by a Democrat? Maybe John Lewis? Definitely contact their staff (even if your rep. is Republican) and tell them all these shenanigans and ask for their help.

I got the notification at 1pm that cards were delivered to my mailbox around 11am. I rushed outside and they were definitely in the box!
10yr green cards in hand, NO errors on them; correct Resident Since date, correct names, correct gender and correct 10-yr expiration date 😁

Amadia here mentioned that you can ask to talk to asupervisor to tier-1 person to get to Tier-2. I haven't tried this trick on my own.

As people said here, the best approach would be to prepare but wait for some kind of response from USCIS first which would be one of these: RFE, Call for Interview or Approval. In case of RFE or Interview call, you will then have the additional evidence prepared to present to them on the spot.

I think i have seen at least one case in Boston that went through combo interview on this thread. You may also call them to try to get a Tier2 officer and explain your case.

    This is not correct.

N400 can ONLY be filed after you have completed 2 years and 9 months or MORE since the date of issue given on your Conditional Green Card. For example, if the Conditional GC was issued on the date 01/01/2016 then the person would become eligible to file N400 on or after the date of 09/31/2018.

    Pros:
1: You get the citizenship and have the processing time counted towards N400 once you become eligible and apply for it without having to wait for ROC approval.
2: You done dealing with USCIS

    Cons:
1: Most likely delay the approval for ROC since it is highly likely that your ROC would be combined and processed along with your N400.

I don't know much about USCIS and its inner workings but a lawyer once told me that there is such a thing called "A file" connected to your A-number. There is only one such physical file that contains everything about your case from the day you entered the usa. So the chances of those two i751 not merged into your file are very slim. One thing you can do is to take the photocopies of your first i751 along with you to the interview.

The good thing for the original poster is that he followed the law and presumably paid for i751 fee twice. There are no inherent illegality in his case except that he got (probably) bad advice from a lawyer which he could clear up at the interview.

Maybe, writing a short cheat-sheet notes on a post-it would be a good idea to stick to your talking points during the interview.

The retroactive part plus the Obamacare part are, in my opinion, ridiculous ideas intentionally added by the schemers of this "policy" as their Opening gambit for trolling purposes and to invite litigation in Federal Courts.
