    Wow,
It doesn't matter why it happened. What matters is that you shouldn't lie and stuff on a visa application. Being coached is not an excuse...
Grow up and take responsibility of what you did. Can't change that now. Not sure if the embassy cares about why you marked that box married, maybe they do care, maybe don't....

Just getting married and filing for CR1 won't make you admissible. You need to figure out what happens with the K1 first.  After that you can come up with a plan....
  2. Thanks

I don't think you quite understand that lying on US visa applications is quite serious and can cause you to become permanently banned.   Its great if you can show that you were not ever married, but the fact that you LIED about it is not erased by that.

No one here is being bitter.  Feel free to stay positive.  You asked for feedback on your situation, and you're getting it.
  3. Thanks

    Actually, it's both.
First the CO must determine eligibility for the visa. This includes having a bona fide relationship. That does seem to be a concern given the 2nd interview.
Once that hurdle is passed, then they will look at an inadmissibility.
They would not skip the 2nd interview even if they were 100% sure the visa would be refused due to an inadmissibility (waivable or otherwise).

Edit: To be clear, I'm not saying if there is an inadmissibility either way...depends on if the misrep was material or not. But that is the flow of events.

Based on the OP post they seem to be more interested verifying that relationship with current petitioner is bona fide, and not about some some fibbing on tourist visa that was disclosed before. I highly doubt they would've done some version of Spokes process on 2nd interview if their intent was to just deny it. The discrepancy was disclosed during first interview, so if their intent was deny due to that, they could've done it there and then, instead it went into AP, and 2nd interview involving USC. They just need sit put and wait, and see what develops. It is out of their hands now until they hear something back.

This is likely to become a big issue. An apology is nice, but doesn't resolve it by a long shot.
If deemed material, this misrepresentation has a permanent (but waivable) bar.
The bigger issue is they are likely to require evidence of the marriage being dissolved. Kinda hard when no such marriage existed.

They also seem to have doubts about the relationship. Once that item is passed and you are otherwise eligible for the visa, the above items may come into play.

Please keep the thread updated with what happens.

Hah. This is the stupidest advice ever and unfortunately you're not the first person who comes to this forums telling the same exact story.

Don't bother with K1 visa anymore. Get married and file for CR1 visa. In a meanwhile you need a document saying that you're "free to marry" aka "divorced" from your fake marriage. That is if they don't slap misrep on you. Just saying that you're sorry doesn't mean much...

@John & Rose may be more informed on this. He is going through spousal visa now and had applied for k-1.

I know other people can chime in with more information than I can give. However, if your NOA2 date is September 10th then you are past the 6 week limit for it to arrive at the NVC. I'd call and be adamant about getting more information.

Also, please fill in your timeline! It can help others help you.

If you spent more than 1 year in any location(as in living there, not just visiting that is) after the age of 16, you need to get a police report from each country.
  10. Thanks
King's reacted to Roel in K1
Make sure to learn all the steps. K1 is just the first steps of the process.
Then you have AOS , ROC...

Documents to gather can vary by country. What country is the beneficiary from?

At this point the petition will go to NVC to receive a country specific case number, then forwarded on to the embassy there.

At this point, the petitioner can start gathering financial information (pay stubs, letter from employer, W2's/Tax transcripts, banking statements, ect) and begin to look at the I-134 document.

The beneficiary should probably go a head and start getting police report(s), birth certificate copies, new passport photos.

Once you have a case number, again depending on the country, you could start to plan to schedule the medical and interview.

Check out the k1 guides and process flow charts here these will help, time will depend on beneficiary country.

there is no time guarantee for NOA-2, when you get around the 9th month start asking yourself if there is something wrong. at month #4 is just pointless right now.
  14. Thanks
    King's reacted to geowrian in K1 Noa2
Exactly. There are never any maximums. Typical timelines for the I-129F are 6-8 months last I saw. If you go beyond that (and average timelines haven't grown in that time), then you can make a service request to see what's going on.

sit back and pour a drink. you have a long wait yet to go. 3-4 more months. at least.

You have a long way to go before the interview stage. Like @geowrian stated, you are looking at 8 - 10 months. Even after the interview there could be hold ups. Best you learn to be patient now.
  18. Thanks
King's reacted to geowrian in K1 petition
The I-129F is just the first step. ETA: ~6-8 months. YMMV, and average timelines may change by then. You won't hear anything until you either get an approval, a denial, or an RFE.
After I-129F approval (NOA2), the case is sent to NVC, then to the embassy/consulate. ETA: ~1 month.
From that point onwards, the process is embassy specific. Some want a packet 3 before an interview can be scheduled, others don't. All will require the police certs, medical exam, DS-160, MRV fee paid, etc. before the actual interview.

The entire process from I-129F filing to interview is typically 8-10 months right now. This will obviously vary from case to case, and some embassies are faster than others to schedule an interview and/or make a final decision.

Our interview the CO asked 3 simple questions.

Then he said I guess I should ask you if you have any questions for me, which we all laughed and he said your approved

Gotta love the US Embassy in Manila
  20. Thanks
King's reacted to Ben&Zian in K1 - mandatory seeing of family?
It is true, for the I-129f petition, only have to meet eachother, nothing to do with the family.
And as mentioned, come interview time it really is embassy specific do to culture of the country.

A lot of countries don't care honestly; but in a lot of the African countries it is an extemely big deal I have seeen.

As also said, while you are doing potentially the interview stage(when it comes) in S.K., they will still know your origin.

Also was stated you need police reports (at the interview stage) from both countries.
  21. Thanks
King's reacted to Michelle13 in K1 - mandatory seeing of family?
Yes a police report will be needed.  Sounds like you will need at least two.  One from your home country and one from the country you're in now.   They will give you a checklist of all the things needed at the interview.

    Good luck!
  22. Thanks
King's reacted to Michelle13 in K1 - mandatory seeing of family?
In my K1 interview they asked if we had met each others families and when.  But again every interview can look different depending on the country/interviewer.

I like the idea of scheduling a Skype meeting so your fiancé has the opportunity to at least meet that way.
  23. Thanks

Visiting the Fiancee is what is required...  Not the family
  24. Thanks
King's reacted to Ebunoluwa in K1 - mandatory seeing of family?
It is somewhat embassy specific and CO's at some high fraud consulates like to see the fiance interact with the family, more so if a
wedding takes place for a spousal visa. Many have been asked where was your family or have you met the family.
Just be ready to explain it.
You can also have screen shots from skype talking with each others families.
It will be ok for USCIS but at the embassy stage it might be scrutinized for a closer look.
If you (beneficiary ) is in a third country and want to interview there make sure you have a legal permit to be there.
You can also interview in your home country.
The petitioner should front load the petition with lots of relationship evidence and some affidavit letters from family.
  25. Thanks
King's reacted to kris&me in K1 - mandatory seeing of family?
Be aware you will need criminal investigatio reports from both your country and country you now live in

let the VJ community know what countries we are talking about here as this question can be specific to certain embassies
many require appoval of the family especially the mother and that question can and will be asked
