    No effect on the case at all - you can email the embassy and request they send it back to you.
    When they are ready to issue the visa, they will contact you and have you re-send it to them.

    Yes, there is some negativity on here and that makes some hesitant to ask questions, unfortunately. Don't let that stop you from asking about anything you need info on though - I have always found I get good solid info pretty quickly on here - ignore any unhelpful responses and you will find this site is extremely informative.

    Stop the guessing game and take it as it is; 
    He must fulfill his campaign promises from building the wall to a complete shutdown on all Muslims entering the country.
    He tweeted he must abandon the "watered down" ban and find a way to abandon Ban 3.0 returning to the original which would have
    included all Muslim countries. The Genius in his or in his came up with a "Backdoor" Ban; Extreme Vetting Ds-5535. Yes, you will see 
    some get Visas after Ap, but very scarce and very far in between. Why? his proof it is not discriminatory when in fact, it is just that....
    One thing we can all hope is that our spouses are amongst the few lucky ones nshlah  
    Ps. I hope I do not get attacked by his Digital Army of whom many live here on VJ...

    Precisely. The part that bothers me is that everyone who claims to be fighting on our behalf - lawsuits, congressional actions, news media - no one - seems to cover this aspect of this insanity.

    I agree that it is insane that the mere fact that all immigrant and non-immigrant visas in iran have been halted on grounds of national security and extreme vetting of terrorists,  with exception for student and exchange visitor F, M and J visas totally refutes their entire argument that they are banning people from these countries due to their lack of information sharing. How is it they can get sufficient info on students but not others? How is it students, some with no other ties to the US other than wanting to come here to obtain a degree, are less of a national security risk than a family member of a united states citizen with significant ties trying to be reunited with their family?
    If they can sufficiently screen them and allow them entry within a few months, then those seeking waivers of the ban should not be stuck in AP for years.
    I wonder why they havent made mention of this either in the case

    I think it is better to fill in everything that doesn't apply to you with N/A or or None - otherwise, it may appear to an officer reviewing your application that you missed a question and accidentally left it blank.  This way, every field has something filled in.
     
    I just typed in what the form let me and then printed out the form and wrote the N/A's in by hand - we were approved without any issues.

    They are not. Simply overstay of a nonimmigrant visa is considered a civil violation, not a criminal one. When you get into other things, such as human trafficking or drug muling then of course that's a separate criminal offence, but that is not applicable to the vast majority of undocumented immigrants.
     
    The cost of removing every alien who is unlawfully present in the US today would be extremely expensive. One might say it is prohibitively expensive, in that it's so expensive that no sane person would ever want to do it. It's somewhat difficult to nail down a cost, but estimates seem to range from around $65bn at the low end to over $120bn at the top end. I can't say that would be a good use of our taxpayer dollars, particularly if the root causes of such unlawful migration are not addressed. That would be the equivalent of having a leaking boat full of water, emptying out all the water, but leaving the hole in the bottom intact. The issue will simply reoccur again down the line.
     
    The danger in your way of thinking is that you are only looking at it through one lens: enforcement. What is required in this country is a complete top-down reformation of the entire immigration system that deals with overstays, USCIS inefficiency, DoS-USCIS interdependency issues, enforcement, causes of unlawful migration, asylum, immediate relatives, and probably a dozen more things to boot. When you simply modify one portion of it, such as enforcement, you are not dealing with the problem, you're just band-aiding it. Think of it as you're trying to bake a cake, but only using one ingredient. You're not going to get a particularly edible cake by doing that.
     
    And so whilst the system perpetuates, largely invisible to the ordinary American, not a great deal on the causes of all of this will change. Central and South America will still continue to bear the brunt of the blame for a situation that has a lot of moving parts. I have no faith in the current administration or president's ability to deal with such heady topics. After all, Twitter is his primary activity these days, and he's not exactly a big policy thinker. Hopefully the American people, of which I now number amongst, will elect someone who has a slightly better grasp on policy, rather than sticking with someone who thinks building a wall will solve all of the problems, which is both a naive and fundamentally unintelligent way to approach things since it doesn't deal with overstayed visas at all, and they're at least half of the problem.
     
    But sure, let's spend ~$100bn and deport all the illegals.

    You know, the part that sucks the most is the uncertainty. If they just said - AP will take 1.5 yrs - I'd be OK with it. I would be sad, but it would be bearable. Today, if you are a green card holder, you have to wait a bit longer than if you were a USC to get your spouse here. If you endup in Nebraska instead of Vermont for I-130, it takes longer. Just luck. Life give you lemons you make lemonade. But the problem with this lunacy is that it is a freaking blackhole. I just wish AP was allocated a well defined, reasonable, time frame like every other step in the process. I am all for National security - but it has to be fair. I wish Senator Chris Van Hollen could request the DOS to get this data out like he has with a lot of other data.

    The other part that is absolutely insane is that they have banned IR's but F1s are fine. I suspect the universities have a strong lobby that stood to lose a lot of money from the F1 piggy bank and it got an exception added.  So If I were an international student on an F1, my iranian spouse would have been here in no time. But as a US citizen, I have to wait until god knows how long. Is it some how possible to easily vet F2 spouses but not USC spouses? I dont know why the lawsuits are not focusing on this aspect. If the DOS can vet spouses of F1 students without AP, why not spouses of USC's? 99% of the american public does not care. They dont even know this part. I wish media covered this angle more to expose how stupid this whole drama is. So much pain for no discernible benefit.

    The embassy is presumably aware of the K1 in progress and are still issuing the B visa. It is not a guarantee of entry of course but it is a positive sign. He should definitely bring all strong evidence that he will return in the interim (job letter, apartment lease etc) in case he gets asked at the border.

    "A group of leaders in Congress is preparing to introduce legislation on April 10 to redress the fall out of the ban. Known as the “National Origin-Based Antidiscrimination for Nonimmigrants Act” or the “NO BAN Act,” the bill terminates the proclamation and limits provisions in the immigration statute the administration exploited to enact the travel ban. The bill also strengthens the waiver process for those in close family relationships or with humanitarian factors. Fifty-six immigration law teachers and scholars have issued a letter in support of the bill, concluding that it “provides a common sense and humanitarian solution in response to the outcome in Trump v.     Yes it is so crazy- awful directions and not providing fillable forms. It really is sad that they treat people this way.

    When we were given that form, the embassy had emailed it as a non-fillable PDF attachment, but asked us to fill out and send back to them in Word format.  I ended up just re-typing their form in Word and filled in my answers as I went. They certainly don't make these extra steps convenient.

    Wanted to share our experience- it went pretty much as expected- except they focused more on his education/work history instead of our relationship. 
     
    My Iranian husband went for his interview at the embassy in Madrid this morning. He had taken his phone for navigation and turned it in at the door and received a ticket. He said he waited about an hour to be called and turned in his documents to a woman- including our marriage certificate, his police certificate from Spain and his birth certificate and translations. He waited about a half hour to be called back by a man to do the interview with. The man asked how we met but then continually asked my husband about field of education and his masters. He was in the interview for about a half hour- he said the man kept circling back to questions about his masters, education and work experience. He also asked if Pouya had worked for the government or in the Iranian military. Pouya tried to show the photos of us but the man refused. He said that we were refused because of the travel ban (221) and that we should email his CV (resume) and the 5535 (supplemental questions) to them. Pouya mentioned that we had several letters of support- including one from Senator Van Hollen. The officer said he was aware of the letter of support from the Senator and (said/implied) that he could send the other letters to the email address they provided. They kept the police certificate and medical but returned the other documents to Pouya. The man said that they (the embassy) would need to apply for a waiver for us and that it would take many months.

    I think that vast majority of our cases here are pretty simple - the common "complication" in the past couple of years seems to be the country our spouse/fiancé was born in.
