    You're not treating him a US Citizen, you're treating him as a resident alien. He's eligible for the 3rd stimulus check as he's been considered a resident alien for 2021 and has a SSN.

    You've both done the best you can with what is available.  Go with it.
     
    That you asked for an official copy and the copy is faded in the same places is, in my opinion, a good sign.  It means that your "original" and your "copy" look the same.  The important details are there and can be read.
     
    Even in the U.S., there's no way to go back and fix a "faded" copy of a birth certificate.

    I'm assuming you're the USC, and that your wife will now kill you for mistaking the NZ flag for the AUS flag.
     
    I am the USC petitioner, husband is a kiwi.  We did a K-1, so it was a different process, but back in 2018 it took only 9 months from filing to marriage.  We are now waiting on the removal of conditions on his GC, which will likely take two years.

    My wife and I are filing all our forms to immigrate to The United States, and we are currently filling out the CRBA forms, we have come against a speed hump,  both our babies are IFV babies. They are both our DNA...my sperm and her eggs. Anyone else have to go through this and where do we begin?

    I'd like to evidence see that the relationship is even and ongoing.
     
    As an example of specific evidence: receipts of gifts you've bought for each other, phone bills showing you've called each other, maybe chats of you both discussing plans for the future.

    I would only put recent photos. You have photos from when you met but that was relevant for K1. Maybe just put 4 or 5 photos with a blurb.
     
    Then get a state ID. At least it will have your address on it.
     
    I mean, you have to do something. You don't have anything.
     
    Maybe add a letter from your brother saying that he lets you live in his property, because you don't have a formal lease.

    If you don't have much of the suggested evidence -healthcare, mortgage, lease, etc.-, include a letter explaining in detail why. 
     
    Include all the documents you can find where both names appear. 
    To prove you have a common residence, include any document with name and address -ID, memberships, mail-.
    Ask your brother for a letter explaining the rental agreement.
     
    Pictures are unfortunately irrelevant and some agents do not even consider them as evidence.

    The main problem is the I-751 process.
    You filed jointly and that requires you to still be married. 
    If you're separated and divorcing, you must ask for a divorce waiver and they will issue an RFE for the divorce decree. 
     
    When did you file for removal of conditions? Did you enter the US with a spousal visa?

    Really? The website told me 4-6 for an update (not a decision specifically, just anything) and even now it's still saying  4-8. They should really update the time estimate to match their work load so people won't think they're being left out in cases like mine.
     
    I'm actually surprised so many Ecuadorians want to even come here tbh. Their country is way better. The only reason I'm staying in the US for now is BC I don't know how to get my pets there yet (cat and turtle) since no plane will take them across the ocean in that direction and BC my grandma has no passport and can't travel with us if we did go permanently. But legit I just got back from there for a Christmas vacation and I almost didn't come home with my mom and brother. That's how nice it is there.

    I submitted a K1-Visa case back in August and the first and only update I got in my case was the "we received your case here's your number" notification on the site and in mail. Everyone else who submitted around this time at LEAST got another update. I'm beginning to think I'm being ignored considering how the government feels about minority races (and unfortunately both of us are minority) AND because we aren't a straight couple. Does anyone know what's going on here? I've emailed the Texas building and I'm thinking of spamming the main USCIS email until I get an answer. If they have a number with a live person I'll spam that to.

    That @mari04 was asking/saying was: Where you separated when you applied for ROC? Where you separated when you received ROC? Divorce takes time so what was happening with your relationships between your application for ROC and when you got the 10 year green card?
     
    It sounds like this is very important.

    I give it 99% chance of what happened:
    1) OP applied for ROC.
    2) While ROC was adjucated, the couple separated and possibly filed for divorce.
    3) OP failed to disclose it to the USCIS
    4) OP received 10 yr GC
    5) ex-wife possibly notified USCIS about this
    6) or USCIS figured it out from residence addresses on the N400 form
    7) at the citizenship interview OP was grilled on this.
    😎as a result they figured out that op was separated before receiving permanent GC and hit him with misrep
    now they will not renew his gc unless he proves that he resided with his ex wife at the time of the 10 year gc receipt. 
    this is the only explanation that makes sense.

    It is pretty common among people with two surnames. Even if you input everything correctly on the forms they end up messing it up. 
     
    My suggestions are: don't freak out, fill the AOS forms correctly and fix any issue AFTER you get your GC.
     
    You can add the name/middle name/surname on the "other names" field if it makes you feel more comfortable.
     
    I'm certain you won't get an RFE for this.

    2 yrs outside is definite abandonment, if a valid pressing reason caused you to want to stay out you could have applied with strong reason to uscis, you should return to US & continue residency now, the pandemic was worst in Italy according to news media, and you say light & banking was being kept up in the US, careful with your excuses have back up documents for  uscis

    OP has been out of the country for 13 months, not 2 years. If they try to return in Feb 2022, they would have been away 1 year and 2 months.
     
    @scottfede, the official method to apply for a returning resident visa, SB-1.

    Unofficially, you can do what you plan by trying to return in February and see how CBP handles your case.  It will be at their discretion on what they do.  They may let you in with just a few questions, try to get you to state you have abandoned your residency and to sign a form to that effect, or refer you to immigration court.

    Greetings to All,
     
    This is my first post ! I am LPR; will be able to apply for citizenship later this year. I am originally from Bangladesh. I was married on the first day of 2022. It was family-arranged marriage (typical of sub-continent) and it was according to islamic method. Due to my work, I had to return to USA. I want to apply I-130 online for my wife now. What do you think?
     
    After I apply I-130, I am thinking to ask my wife to apply for Visitor/tourist visa. If unsuccessful, then might thought of F1 visa category. What do you think?

    There's a US census in 1940 available and the names are on there; you can check on the genealogy websites. 
     
    Like others said, there should be school records or records of her family living in the US. If you can find anything about her parents living the US, then obviously the child (his mother) would be living in the US. Old obituaries, a news article, maybe they owned a store or had a job, owned property, etc.

    You don't need EAD to study. You can enroll when you move there with the K1, marry, and submit the AOS paperwork. 
     
    I don't see how F1 would make your timeline faster because you want to start studying Fall 2022 or Spring 2023.
     
    That's in addition to the problems of having the K1 already. They are going to realize that you withdrew because you are applying for an F1, your F1 will be denied, and you'll have an uphill long battle getting a spousal visa, which takes 2 years.
     
    You haven't even applied to graduate programs which is time consuming and competitive. Many have already closed applications for Fall 2022.

    If you file the i-485 before the I-94 expires, you will be in a period of authorized stay while the AOS is being processed.  That is, until USCIS makes a decision, you will not accrue unlawful status.
