#1. The whole process (USCIS, NVC, Consulate) could take 5-6 months but it could also take 10-11 months. Based on current trend, 10-11 month is more realistic than 5-6 months

#3. Your passport is not required at this point, so you can renew your passport now and submit the new passport with DS-160 later.

We filed in 2017. My husband moved to US from Australia in 2015. Filing taxes, settling down, changing jobs took him a while. So we filed late.

We're at the NVC stage.  In case anyone is interested in learning from our experience, I uploaded an IRS tax transcript on the same day as all the other documents and later realized it was only page 1 of a four-page document.  So two weeks after uploading everything, when I found the mistake, I was worried that this error would cause a delay.  Everything was showing as "submitted," but not yet reviewed.  When I tried to re-submit the correct document and replace the one originally uploaded I couldn't, so I called NVC (on hold for almost an hour), the nice lady said to go ahead and submit the other three pages by clicking on "add new document" in the affidavit of support tab so I did that today.  So for everyone's benefit, if you forgot to upload a document and they have not yet reviewed what you originally submitted, you can add documents later, before everything is reviewed, and avoid the dreaded notice of incomplete documents and the three-week wait after re-submitting the correct documents.  Just go ahead and add a new document, additional evidence of bona fide relationship, evidence of additional visits, etc. before they review everything, which typically is a three week wait after submission of everything.  So that's what we did and we hope  to get case complete and an interview date soon.  Good luck everyone at the NVC stage!

It depends on where you are in the progress. If NVC hasn't touched your case yet, so you need to wait 2 months for it to take effect. If NVC is processing your case, so yes, it takes only couple days, 2-5 business days to upgrade the visa categories.

Unfortunately, the internet does not show true emotions  So, your short answers communicated rudeness. But, I am glad you clarified and we are all good now in the Hood. As for your question, you do not need a police report. Only your Beneficiary needs both Police and Court clearances (Casier Judiciare & Antrometrique) both translated by accredited Translators only. Also, It is best to always check the DOS and USCIS sites directly. Asking around is excellent, but take everything with a grain of salt around here. Best of luck to you.

If USCIS approves your i130 petition before your next visit to Nigeria to see your husband,I will advise you delay the NVC processing so that you can have more evidence as other supporting documents.

    Goodluck

It really doesn't matter what you think or what I think.  What matters is what the consulate officer thinks.......there have been many cases  almost EXACTLY like your case here in the past 2 years.......they almost always end poorly.......
My advise (take it or leave it):  More visits, more face time......
I apologize if I seemed to berate you.  That is not my intent.........I urge you to do more research here on VJ regarding Nigeria visas......I wish you the very best....

    Two lessons for everyone here...again....
    1.  Traditional marriages can be legal according to US immigration.
    2.  Attorneys make mistakes.......but rarely pay any consequences.

well its a wonderful topic we have here. i really would say cultures are like pyramids submerged in an ocean, you only see the top from afar but when you get into the ocean u will find out that its deeply rooted and can be very devastating if u are caught unawares.

though i av never been to the states but i have couple of ideas from wife who is from Nigeria too, tourist from the states, friends from my high school even in canada and other parts of Europe.  sometimes the problem that allows so many Africans and 3rd world countries  to nurse the  migrating overseas is  because of what some of those who have stayed in the states is portray in  their stories of
    1. how planned  the states is in terms of provision of certain basic infrastructure/ amenities
    2. it is sometimes said that you can do an much as 3 jobs a day and u will make more money and when converted to the local currency , u can save more in ur home country. buy luxury cars and properties
    3. social security  and other benefits.. (some times alot of the 3rd world still battle with no health insurance or even to access portable water)

if not because i have been to some countries and i have ample idea  of what its like, i could still be in the pool of those who think going overseas is filled with money tree where u can just stretch ur hands and pluck money.

though most of these African countries have deep leadership problem where corruption, and mismanagement of public funds  is the order of the day.
