A few years ago I was on a message board about dating in former soviet union countries.  Someone there was talking about making travel arrangements for his K1 fiance.  He started looking into the AOS process and the provision in the I-864 about the liability if the immigrant goes on public support.

He worked himself over with so much worry and anxiety that it affected their relationship.  He could not relate to her after she arrived without thinking about the I-864.  It pretty much ruined their relationship and she went back without getting married.  He was miserable, and she was miserable, especially after quitiing her job and selling her things to move only to have to start over again back home.

My advice - evaluate the strenght of your relationship.  The I-864 liability, thought not trivial, is minor compared to financial and emotional costs related to divorce and, in rare and extreme cases, false claims of VAWA.  Do not let the public charge liability influence you.  Let your relationship influence you.

Are you guys compatible?  Do you see a happy life together?  If you are unsure of her character and personality, then rethink your decision for the K1, hopefully before her interview.  If things are good and you believe she is the "one", then happy journeys!  Well...as happy as you can be while filing forms and dealing with USCIS...

Well said. They need to be able to work for 10 years and get Ss and Medicare .. unless you plan on covering their health costs and self insuring  them out of your pockets

Cheap to get them here, sure. Cheap once they are here, maybe, hopefully they are still of working age and have enough time to be able to contribute for full Medicare down the line.

My wife is still in the N-400 process for citizenship, so this isn't something we'll be doing this year.  It's a next year thing, but I wanted to get a head start with arming myself with knowledge. A lot can happen in a year, so we'll see how this all sits a year from now.  But thank you very much for your insight

    Hi,

Her parents will not be adjusting status inside the US with an I-485.  They will go through consular processing requiring a DS-260.

    1.  Separate I-130 for each parent.  I-485 does not come into play.
    2.  The I-130 starts the immigration process.  Once USCIS approves the I-130, it's sent to the NVC.  At the NVC, you pay the DS-260 and I-864 fees, then file more paperwork.  Once immigrant visa interviews are scheduled in Columbia, the parents goes for their medical exams and then their interview.  Then they pay the $220 immigrant fee to receive their plastic green cards after immigrating to the US.  Upon entering the US with their immigrant visas, they automatically become legal permanent residents.
    3. The I-864 comes into play at the NVC and at their interview.
    4.  Yes, your wife can file for both parents at the same time.

I think it will be up to the person reviewing your application and how they feel that day to look it up themselves or not.

You may send the "masked" transcripts with no issues.

Transcripts are preferable to returns and W-2s (and you have to add all 1099s if you are relying on interest income) because transcripts show what is on record at the IRS and proves that the returns were filed.

SEND IT 2-3 DAYS AFTER SHE CAN FILE.

EVEN ONE DAY EARLY IS GOING TO CAUSE PROBLEMS.

    1. $595 +$85 =$680.
It’s each person, not each additional person.

    2. Yes you can write one check.

You also may want to send it like 88 days or 87 days prior, not at exactly 90 days because there have been cases where they filed exactly 90 days and USCIS send the whole thing back a month later because “filed too soon”

SkruDe got a reaction from CC&TD in Can Green Card Holder study abroad (Canada) thru U.S. school program?
Just thought I'd update on what I've found out:

My wife will not need a visa to visit Canada because as a Green Card holder, the visa requirement is waived. Visa requirements into Canada depends on the country that issued your passport.  In my wife's case, Colombia nationals would require a visa to get into Canada.  But, that requirement can be and is waived because of her possession of a U.S. Permanent Resident Card (Green Card).

Also, will not need a study permit (study visa) because her time of study will be less than 6 months, which again allows the requirement to be waived.

So it appears there should be no issues for her 5 week stay, attending classes at a Canadian University as part of a "Study-Abroad" program hosted by her U.S. based school.

SkruDe got a reaction from Drillerone in Questions regarding Form I-134 Affidavit of Support
I started filling out the I-134 Affidavit of Support and have so many uncertainties and questions....

This is all referencing the most current I-134 form Revision 11/30/16  (As shown on lower left corner of each page)

Part 1 Question 12.  This question is under a heading "Citizenship or Residency or Status".  This heading has questions 11a thru 11e, and then question 12.  Questions 11a thru 11e, I don't have to answer because I am a birth citizen to the USA.  But I'm confused if question 12 is just a continuation of questions for NON-US citizens that had to fill out 11a thru 11e, or if I have to answer it as a birth US citizen?  The question is "I am (fill in age here) years of age and have resided in the United States since (Date). For the questions about beneficiary spouse and children (which is no spouse, no children) do I leave those lines blank or right N/A or right None?  And questions about my dependents (which I have none) do I leave blank or say None? Part 3 Question 5.  Value of my personal property.  Obviously, this excludes my house since that is another question.  But kind of of info do you put here?  If I have positive equity on my car loan, should I enter that positive equity as value of my personal property? Part 3 Question 6.  Market Value of stocks and bonds.  Are you able to put 401k here or no because it's retirement money and not readily liquid money? Part 3 Question 8b.  Are they asking for total amount left to pay on the mortgage loan?  Or what my mortgage payments are? Part 3 Question 22a and 26a.  22a asks about previously submitted Affidavits of Support, so I know that is a NONE for me because I never submitted one before.  BUT....  26a for "submitting visa petitions to USCIS on behalf of the following persons" it DOES NOT say previously submitted.  So am I to write in my fiances name here? And lastly, and this might be a stupid question.  For my phone number.  It asks for Daytime phone and Mobile phone.  Both phones are the same for me.  Should I put the same number in twice?
Thank you to anyone who can help me!!!

Just an update. Filed November 6th and February 14th is our interview.  Already received the EAD/AP combo card last week.  This entire green card process has been much faster than the Visa process for us.  The visa process was excruciating, but this process has been so much better.  Living together helps though

Good luck to all other November filers!
