    It was longer than ours. We didn’t have one at all. We got married when I was here visiting my husband. I arrived on Tuesday, we got the license on Wednesday. WA has a 3-day waiting period so we got married on Saturday, went to Red Robin after the event, husband went to work on Sunday and I flew back to the U.K. on Tuesday. No honeymoon. 
     
    And we are no less married than a couple who spends tens of thousands on the wedding and has a three-week honeymoon cruising the Caribbean.

    send copies of boarding passes, hotel reservations, items with concrete dates in CONJUNCTION WITH THE PHOTOS that PROVE you met within 2 years.

    She is coming because she now has a Green Card, she is a LEGAL permanent resident. She can do what she wants. She's not some Amazon package you can return.

    Indeed time will tell. Jerry Hall? Christie Brinkley? Both modeling into their 50s and beyond. Plus clothing companies that appear to the more mature market use more mature models. No woman in her 50s is going to buy clothes that are being modeled by a 19-year-old.  I’m almost 46 and shopped for some clothing online today and was delighted to see clothes being modeled by a middle-aged beautiful woman with grey hair. Really gave me the impression that the items would look good on me too. 
     
    It’s not your choice whether she stays here or not. You don’t own her.

    It’s pretty cliche, but I think more people need to adhere to the idea of marrying someone for who they are, not who you want them to be or see them becoming.
     
    If you think it’s wrong of her to expect you to work with it being hard on your body, your should probably do some looking into how hard pregnancy and childbirth can be on your body. That’s absolutely not something to force on someone who is unwilling. Not to even mention the responsibility of having a child.
     
    I don’t really blame her for not wanting to bring a new person into the world with someone who is willing to just cancel a visa after 2 years of marriage.

    She clearly has intention to immigrate using B visa, which is visitors. She'd lie on the border that she has no intent to stay here and she'll leave before her visa is up (thats what you agree with when entering, that you DO NOT HAVE ANY INTENTIONS OF STAYING/ADJUSTING). So yeah, i don't get your "adjust" from visitors visa isn't fraud. She would be lying to the border officer. That is fraud:

    YOU need to check the facts.  She is not currently in the US.  If she enters now on a B visa, intending to adjust status, that is FRAUD.  I have asked for this thread to be closed due to your persistent TOS violations in planning for fraud.

    It's immigration fraud to use a nonimmigrant visitor visa to enter the US with the intent to adjust status.

    LOL, well whatever.  You believe what you will, and USCIS will ask for a document that does not exist because it was based on false information.

    Yes that is a major difference, but I would note that who makes that judgement call is the key component. It is not a fact but a decision based upon one's circumstances and the person interpreting them. Intent is not something provable. In this case, it's the CO's call. The only recourse would be their supervisor (or higher) to overrule them, or via a court (although the doctrine of consular non-reviewability makes that nearly impossible).
     
    Is it a misrepresentation? Yes.
    Was it material? Judgement call.
    Was it willful? Judgement call.
     
    I personally don't think they would determine she is inadmissible based on a material misrep. That said, that is the least of the issues here. The issue here is that the US will require evidence that the marriage was dissolved...which appears that no evidence to that fact exists.

    I disagree.  The person in question chose "married" for marital status on the B-visa app.  That was incorrect, and the USCIS has rightly requested evidence that the "marriage" claimed by the applicant was legally terminated.  
     
    This whole situation is a reminder that any info provided on any US visa or immigration application stays with the applicant.....

    Not to be harsh but that’s a red flag (for you, not the case). Many marriages suffer far worse stresses than being apart a year (not to minimize it, but). Many people here have been apart a few years before one can immigrate.
     
     
    That’s incorrect, attempting to receive the benefit is all that is required. The wording is “The person procured, or sought to procure, a benefit under U.S. immigration laws;” (bold added)

    OP, I feel your pain and understand what she was trying to do.  There is no US visa for dating.  When I first met my now husband two years ago in Brazil and fell in love, we researched all the US visa requirements and concluded that it would be a waste of time and money for him (young, single, Brazilian male) to even try for a B visa to visit me in the US, because of all the overstays that happen all the time.  So I went to visit him many times, to develop our relationship and decide if we wanted to get serious and eventually be together, either in the US or in Brazil.  Eventually I made nine trips to be with him in Brazil, and one trip together to London and Paris.  We got married in Brazil and I filed a petition for a CR-1 visa for him.  He arrived in California three months ago and life is good.  I recommend the same approach in your case.  Go to Brazil as often as you can and see where the relationship goes.  Then decide if you want to be together in the US and if a K-1 or CR-1 works better in your situation.  Good luck!

    Her main reason to go to USA was to meet you and stay, it's that clear. So the CO figured that out in seconds. Also, the decision against her was made before she even showed up. It could be anything. As a secretary, she can't make enough to sponsor herself for USA trip. The CO somehow saw that she has you in the country. That's it. She can now forget about USA visa for a few years, at least.
    Well, based on what was done and how... It's fine.

    A seasoned and retired US Consular Officer told me once, that in her career, she was stationed at many many different countries, and while every country is unique, for each of them, there are only about a handful of "stories" and literally after about a month, every CO figure out very quickly the top 10 "story lines" for that country are. and while every new applicant feels like they're creating a story so unique and great and wonderful, it's only the 5th time the CO hears that particular "story" that day.
