if he chooses the divorce waiver at the beginning then yes you have to get divorced.
Do you want to stay with someone who had a child with someone else? I would not but you are not me.
You can start the process as married and if you decide to divorce during the process he can switch to a divorce waiver. You do not have to do the whole process as married should you decide you really do not want to stay with him.
I do highly suggest separating for a time to get your thoughts in order. Do what's good for YOU.

No one is being insensitive. They're pointing out the following points.
As with most else in life, those who fail to plan find that they have planned to fail.
This applies to living arrangements, finances after marriage, and other considerations.
These challenges exist for domestic marriages, and even more so for those overseas.
Lengthy periods of time occur while waiting for petitions to be processed, visa interviews, etc.
Most couples use this time to plan for initial arrival and progress during the next months.
Some people shake their heads when others haven't budgeted funds for AOS and then complain.
It sounds as though your situation was the outgrowth of a near-complete lack of planning.

Are you sure that he will be counted as a in state? Most of my friends had to wait for their GC until they were counted as in state.

Make an Infopass appointment at your local field office and state what happened. There's a good chance they will re-open the case on their own motion and you won't have to do anything further.
Be aware that new Infopass slots open in the early morning, typically around midnight - 3am, so it might take some doing to actually book one.

I got my card in that same week, I got the we are producing email on the 19th and on the 23rd I had my card.

Please dont try to participate in a conversation about a topic you clearly know nothing about . Please go read the N-400 form especially I want to point out the Y/N question asked on there as a little hint. Pertaining to breaking immigration law and the law in general . When you harbour an illegal alien ( the means they got here dont matter ) out of status , whatever you like to call it , it is in direct violation of “8 U.S. Code § 1324” which if found guilty of would most definetly exclude you from gaining US citizenship forever if not likely to get you deported.
The mere fact that the IO knows about this and OP actually admitted it is enough for denial and an investigation.
ON TOP :
Trump has enacted an even stricter definition widening this by just merely helping or giving aid to an illegal alien. The languange being used it It makes illegal to "facilitate" the presence of "aliens." This was part of his executive order on sanctuary cities

Look at section 6 for further information.
Now if a US citizen is found guilty of those crimes that would be bad enough but it makes it a thousand times worse that a legal permanent resident is participating in that. Dont forget a green card can be taken away quite easily by USCIS, and this would be a prime example of that happening , rightly so .

Someone wrote in another post that they went to an infopass and the officer said that they really wanted to help but they couldn't as the case was still with the NBC. I have a feeling that I'll receive the same information.
I always call the military helpline, but it is the same people as if you call the normal uscis line, only that they answer your call faster.
I can not visit my husband until he comes back unfortunately :/
But I kinda just feel stuck here because of all this. I have some friends in other states and I would love to go visit them. But I am just terrified that I'll receive post from USCIS and miss some important information.

It is a generic message, mine said that too but my case isn't even ready to be scheduled for interview. So EAD/AP only.
The 120 days is generic too, I received my EAD about 10 days after that message.

I bought a one-way ticket, no problem at all. I guess they only require a round trip ticket if you come on a tourist visa etc?
I actually managed to get a 1st class ticket for the same price as a round-trip ticket. Was really nice 12 hours, lol.

My congressman has already contacted USCIS, he is just waiting for a reply.
Should I not contact the senator and ombudsman if the congressman already has inquired?
Another person in the same field office as me, who applied 2 months after me already have her GC. I read about some others in here who applied in November as well who already have their interviews.
