You can do that at the interview.

Scandi got a reaction from midwinterrose in I-751 Service Request - does it even make sense?
A lot of people who filed certain petitions (mainly N-400) during spring 2020 made a FOIA request to get their petitions "out in the open" and it seemed to have helped a lot of them. Their petitions were stuck due to filing right when the pandemic happened, your case isn't far from that. I would try with a FOIA, I don't think a service request will do much. The FOIA is for free so if it doesn't help any, you haven't lost anything.

Scandi got a reaction from Sam Burns in TWO Real IDs. What next?
My husband still has every single one of his old, expired drivers licenses, it's probably 7 or 8 DLs by now. From two different states, at one time he had two valid DLs from different states. Never an issue. Neither of them are Real ID though, if that matters.

Nah, the exact date was never an issue for us. We just made one up. My husband couldn't remember either other than the year, he went back and looked through his old check books (yes) for expenses related to the wedding and figured out the month was June. Then we just made up the exact day as he had no idea. It was never asked about. We did the same for the AOS, we made sure to put the same date on the N-400 that we put on the i-485, otherwise they may have wondered/asked. Or maybe it was the i-129f? Don't remember, but I remember us having to "make up" the date on two forms during my immigration journey. Better have the same date on both.

Give them both passports at the check-in desk and let them decide what passport they want to use. As a dual US/EU citizen I have always put in the US passport info on the airline's website when I have booked a ticket to Europe, but the airline has ALWAYS ignored my US passport and instead want my EU passport. The people behind the desk have always changed my passenger info to match the EU passport instead of the US info that I had already entered (my passports even have different names, I always book the ticket in the US passport name).

Agree, that letter would be interesting to see.

Since none of us have even heard of scenario 1 from anyone throughout all the years on this forum, likely USCIS does not even have a letter for that type of "notice", it's only an online status, not a letter. They wouldn't make up a letter just for OP, it would be something a lot (if not all) people would get if it actually existed. We would have heard of it. So it seems number 1 is not what happened. If they did actually receive a physical letter it was the interview letter, and if so, they just didn't read it and therefore missed the interview. Can't blame USCIS for that.

What kind of letter would that be if not the interview letter itself? The only physical letter is the actual interview letter (with date, place and time), no? Other than NOA1 and biometrics of course.

Yeah we have already established that a combo interview is very different from an "only" N-400 interview. The spouse is needed for the i-751 and is not always asked to leave for the N-400. That is a whole different thing and does not apply to OPs situation.

They won't allow your spouse to come to the interview with you unless you also have a pending i-751. Since it’s only the N-400 in your case, no your spouse will not be required (or even allowed). Doesn't matter if you filed under the 3 or 5 year rule.

OP has a 10 yer green card. Ergo no combo interview. Not comparable.

Likely because the i-751 was denied long ago due to no-show for the interview. Looks like there isn't a pending i-751 and hasn't been for quite some time.

You need to FORGET about the N-400 and focus on fixing your i-751 problem instead. The N-400 is completely uninteresting at this point, since there's a step before the N-400 that you haven't fixed yet.

Why did you file the N-400 if you weren't prepared to go through with the process and are now instead "freaking out"? When you file the N-400 you know what to expect, so the "freaking out" part I don't understand at all.

Might depend on the visa type. I have seen numerous Swedish residents apply for STUDENT visas in other countries when the US embassy in Sweden was extremely backed up on "non-family based" visas. Maybe you can't do the same for immigrant visas?

Got it. Just to be clear, the USCIS would want proof of you living together and sharing finances at removal of conditions stage (I-751).
They'd want evidence for the time between you married and she became the resident to the date of her I-751 filing.
It would not be enough to submit one or two joint bank statments dated a month or two prior to filing I-751. You need a lot of samples for the past 2 years at that stage.
Hence my suggestions not to kick the can down the road and start collecting / establishing the evidence starting today.

Also, if he ever wants to become a citizen then it will definitely be a major issue that his divorce papers show him as divorced from x date, but yet had his ROC processed as if he was still married. It will be considered that he got his unconditional greencard in error, based on a joint filing that no longer existed.

File and finish the divorce as soon as possible so he can send the divorce decree to USCIS and request the joint filing be turned into a divorce waiver.

I don't know where OP is, but here in Los Angeles county the marriage takes 6-8 weeks to be recorded. It's not the printing of the certificate itself that takes long, it's the recording of the marriage that takes that long. The wait times were the same back in 2016 when we got married, but we were lucky and it ended up "only" taking 4 weeks.

OP: This is another thing to do research on so you know when to get married in order to get the certificate on time. Because of the long wait times we decided to get married early in the 90 days. Have your marriage somewhere where you know you will get the certificate quick if needed.

Also, you can pay the AOS fees with a credit card.
