KULtoATL got a reaction from B&Gloria in AOS Interview is tomorrow afternoon (k1) - Birth Certificate?
With the interview being tomorrow, don't lose sleep over it. It's a little too late for that when you're asking questions the night before, which doesn't really give you enough time to even pay to get a certified copy of your birth certificate from the issuing entity 🤐

If the interviewer asks for your US birth certificate, just tell him/her you don't have your original with you. Your US passport should more than suffice.

As for the affidavit of support minimum income, you are over the 125% in 2019. If the interviewer feels in insufficient, worst case, he/she will just ask for a new affidavit of support with a co-sponsor. One thing that you may want to consider doing is to bring your 2020 paystubs or 2020 W-2 (if made available already) IF you made even more money in 2020 (though this might not be the case for most of us due to COVID-19). Other documentation such as your large savings and paid off cars could be a good backup.

Affidavit of support is about your financial ability to keep your wife from being a public charge so it doesn't matter if she works or not. Your wife's money or assets only really matter when  you're trying to show co-mingling finances as one of the proofs of a bonafide marriage.

This was not asked but as always, only answer or give what you are asked at the interview. Don't offer more than what's asked to avoid unnecessary scrutiny. Generally, the AOS interview is very straightforward 😉

Hey guys! My ROC package was delivered on 12/03/2020. Check finally cashed today 01/15/2021. Good luck to everyone who's still waiting. I'm sure more checks from December 2020 will be cashed from here on out 🙌

If you can submit any documentation to show that your finances co-mingle, that's always good. I submitted our joint checking account statements and I personally chose to black out the account number (I did the same with other stuff that had account number).

As for pictures, you don't need to submit a whole lot. Send maybe 10 from different times and events during your marriage. Make it a mix of couple shots and other photos taken with family and friends.

    Here's the ROC guide: https://www.visajourney.com/guides/removing-conditions-permanent-residency/

Here's a quick update to my own question... I called USCIS at 1-800-375-5283. Initially, I said 'no receipt number' and then the system asked follow-up question so I said 'technical problem' and was redirected to an agent. Had to wait 3 minutes which didn't matter because I spoke to a human agent as I wanted to.  Agent Johnny had to verify my details such as:
A-number first name, last name date of birth address Upon verification, I just told him I sent in I-751 paperwork in December 2020, check was cashed on January 15, 2021 and that I haven't received my NOA. He confirmed that my check was indeed cashed on January 15, 2021 and the receipt was sent out on the same day (haha I am sure it has not left the building yet because nothing showed up on my USPS Informed Delivery account).

He gave me the receipt number, I repeated it back, thanked him and was going to hang up. He then said he needed to log the call so he asked for my phone number and also asked if I would like to provide my e-mail address. Gave both things to him and said our goodbyes.

So yes fellow filers, if your check has been cashed and you want your receipt number before receiving your paper NOA, just call and ask for it 😉

If I was in your position, I'd rather wait and continue with the K-1 vs. starting over with a spousal visa. Starting over = even longer wait. And with COVID-19, everything is moving super slow. So truly, is it worth your time to start over?

The main upside with the spousal visa is that your partner would receive a green card and work upon entry and do not have to adjust status and wait for an EAD.

I think most people haven't been receiving text and e-mail notifications though they submitted G-1145. The general delay between USCIS receiving a ROC package and cashing of payment + issuance of NOA is roughly 30-45 days based on what I've been reading around here.

I'm not sure about the proper mechanics in terms of filing ROC when someone already knows that they plan to stay outside of the US for an extended period of time or the number of days for a GC holder to be out of the US causing USCIS to constitute it as abandonment of permanent residence.

Definitely look into things like abandonment of permanent residence, continuous presence and physical presence. The first one will affect permanent residence while all three will affect your naturalization if you're thinking about applying N-400 as a result of the marriage and through whatever status you currently have.

All the best and I'm sure someone who is more well versed would be able to provide you with the specifics

No not really. We would have to delay by a year because of how long it takes to process etc.

Currently we don’t plan on returning to the US permanently anyway so it shouldn’t be a problem but I was just thinking in the short term it would be good to know how long I can keep it for just incase 😊

If you remain out of the USA for more than 180 days without reentry permit will trigger immigration to question whether or not you have effectively abandoned your residency, if you out for a year you will have abandon it. With a 10 year green card a reentry permit would allow you to maintain LPR status for like 3 years outside of the USA.

But you need to be in the USA when your conditional green card expires to file an i751 petition to get extension letter or to obtain a i551 stamp. Note re entry permits do not extend your stay abroad beyond the expiration date of your conditional green card even with an extension letter or i551 stamp.

Yes we meet all the requirements for the U.K. spouse visa including the cash savings.

I just wasn’t sure what happens with my greencard. It’s unlikely we would need to move back to the US but I’m just hoping to keep it as long as possible incase there is a need to come back and we don’t have time to wait for the visa to be approved again.
Thank you, I’ll have a look into this 😊

COVID-19 is everywhere and affects everyone. I highly doubt that can be used as an expedite reason. If that's allowed, I'm sure everybody else would want to expedite based on that. NVC, USCIS and embassies would be far too bogged down.

Also, a tourist visit doesn't generally gets lengthened. With COVID-19, I also don't think that would be happening  unless there's a lockdown where people literally cannot get in and out of a country. But again, I could be wrong.

KULtoATL got a reaction from Chancy in Chances of Approval?
The only way for you to find out is to apply. However, based on what you just said, there's a higher probability of you getting denied than approved. Being single, unemployed and a trip funded by someone other than yourself - these things don't help much. Not only that, you have family members in the US and some COs would be assuming you try to enter and stay illegally beyond a holiday visit. You need to show stronger ties to your home country. Prior overseas travel history would be a great advantage too.

Sorry if that sounds harsh but I've prior experience as a single lady, subjected to unwarranted interrogation during visa interview, accused of stuff I never thought about doing and also denied a B-2
