Hi all,

So, my mind has been racing quite a bit. My spouse had a B1/B2 interview back when we started dating so he could come to the US and get to know my family, etc. He put me as the point of contact, and selected the "Friend" option. At the consulate, they asked him "Who is (insert my name)"? He panicked and blurted out "friend". They probed further, and asked him, "Is she your girlfriend"? He repeated, and said "friend". He can't remember if this was at the first window when the visa clerk checked his paperwork or if it was with the consular officer. The consular officer asked background type questions, and then they approved his visa. Later that month, at the port of entry, he was sent to secondary and was asked about who he was coming to see. He mentioned my name, and they asked him who I was. He said "a friend", and they called me. I told them we were boyfriend and girlfriend. They released him, and after that he has visited several times with really no questions.

Fast forward 3 years, and we are in the CR1 process. I worry that this will cause issues when they see the evidence in the I-130 and compare it with the B2 visa date and see we were actually boyfriend/girlfriend at the time.

I am loosing my mind with so much worry that this will impact our CR1. What do y'all think? Any advice is greatly appreciated.

You are over thinking......stop....🙂

Thank you! I'm just starting to freak out the longer I wait for my spouse to interview. I just worry about things like this where they may suspect material misrep, or something of that nature. The thought just simply horrifies me, and brings on anxiety. I think it's just OCD.

I think I just need to simmer down and stop over thinking.

Not to alarm, but would this even be considered material misrep? Does it rise to that level? Not sure, hopefully others more well versed on 212(i) can chime in...

Oh wow.😟 If anyone could help clarify - I would be grateful.

A very similar situation happened to us, where on a previous B1/B2 application my spouse listed me as a "Friend" rather than "Other" although we were already engaged at the time (which is demonstrated by the evidence in the I-130 packet).

I posted my own topic about it and would be interested to hear an update about what happens in your spouse's CR1 interview. Good luck.

Good luck to you too @FlyingCircus. I think, as@Lucky Cat@Dashinka , and @KULtoATL mentioned for my topic, gotta lose the anxiety and stop overthinking. I read about misrep cases almost everyday on here, and it makes me freak out. Time to calm down :) !
