    Many have been  denied for doing just that. If you hired that lawyer I would fire him.

    I think paying 500 for someone to double check your paperwork seems unnecessary. I definitely understand the fear of messing up and just wanting to do it right the first time though and if that to you is worth the lawyer, then go ahead. At this point, all you'll get is peace of mind, so whatever makes you feel better is the best choice. Still, like most people here on VJ, I of course think that there's no need for that at all. Comparing with the checklists available here should be more than enough. I also recommend http://www.mrspresson.com/ . For compiling my packages I only used her blog and checklists, since her organizing system is just as annoyingly detailed as I like it to be. You can also post your list on VJ and have people here check it out. Personally, I thought the most invested person in my case working out was myself and my husband, so I didn't want to leave it to someone else for review...too controlling for that

    YES there can be a problem. Her AOS could get approved BEFORE the EAD. Then you are officially on the hook for her.
     
    It has happened before. Some people get the Green Card before EAD/AP. In fact, look at my timeline. My wife got her green card exactly one week after the EAD/AP card. Just one week. That would be very little time in your situation.
     
    To be honest you are about to be played again. File for divorce now and cancel the affidavit TONIGHT. Your wife is using that fact that you are frustrated to manipulate you. First she will just need the EAD, then later the EAD will not be enough so she needs you to wait for the GC.
     
    TAKE ACTION NOW OR GET WALKED OVER MORE.

    How many other things has she told you that weren't true?. She gets the EAD, then she has to find a job, then she has to save money, then her green card comes, then she leaves and you are on the hook for at least 10 years. If she receives food stamps, medical aid, or other public assistance you might have to repay the government. 
    Her filing for VAWA has nothing to do with you or your criminal record unless she makes a criminal complaint. But her getting her green card will obligate you to the US government.
    File for divorce now, ask at the initial hearing that she be made to leave the house and explain why, that you are afraid she will make false claims, destroy your property, etc. Sounds like she is really good at stringing you along and she will continue to do that until she has the green card.

    Hi, I also don't know anything specific, but you said something about looking at your lungs. Is there any chance that the X ray will show something in your lungs that can be mistaken for tuberculosis? Just to be extra safe, I would suggest getting a doctor's note saying that your wounds and such come from the food allergy, if you can. Otherwise, I think you just gotta be honest and hope that if the doctor is suspicious he will just order further tests instead of just deciding you are unfit to immigrate. Overall if the doctor is qualified, I think you'll be ok.

    I get the camera shy thing, you'll just to make it a conscious decision for the immigration process. Scenic locations/landmarks are definitely best. What helps the most I think though is photos with other people, especially family. Anything that will make it look real instead of "we are fake and we are taking these 10 pictures in the same couch because we intend to not see each other much more and nobody outside this house knows about us" . Most of our photos were selfies, but a couple of times we asked strangers to take a photo of us and we had one photo of my husband with my mom.

    Right now you can only accumulate evidence. Boarding passes aren't main evidence, since they only show you were in the same country, not that you were together in person. Just collect lots of photos of you together, and of you with each other's friends and family. Something I did that was pretty useful, was to put the pictures as evidence through screenshots of our social media. That way you can show the dates and that it's "official" by seeing the likes/comments of other people. Other people suggest chat logs, but that's also no main evidence, so it's only really useful on hard embassies to pile on top of photos.

    Just like a couple of days ago there was no refugee/visa hold. Now there is. The article cited before and the current fears don't stem from people with too much imagination and time in their minds. It stems from drawing plausible outcomes to the situation. Trump did make statements during the campaign about "banning muslims" and was expressed in such a broad manner, that it was perfectly reasonable to conclude that even GC holders from those countries could potentially be denied re-entry. While to reasonable people this may seem ridiculous, similar crazy things have happened already. With ease. What everyone here is talking about is caution, uncertainty and fear. Do you think that things are just the same as they were months ago? They are not and this uncertainty, which hopefully will not be confirmed with worse news, is for now, reasonable.
     
     
    As of now, no. There is however a feeling of uncertainty based on the views of Trump and past statements he has made. Personally, I can't put it past the new administration to enact some sort of ban like this.
     
    Yes, the executive orders, as of now, don't affect current GC holders. There's no certainty though that this won't change in the future. Also, it's not just a 90 days pause. These 90 days are supposed to give the new administration time to come up with a definitive plan of action. That means that after the 90 days they may or may not be able to enter the country/continue processing.

    First off, I am sorry you are going through this. My husband's K1 was denied in 2015, so I know the pain and heartache you are feeling.
     
    I would highly recommend you contact your local Senator or Congressman asap. When our K1 was denied, the Ghana embassy ignored every message I sent to them and an attorney I contacted said the embassy wouldn't respond to them either. We only got answers when my Senator sent them an email. They may not be able to get you a second interview or reverse the decision, but they can give you answers which would be vital for moving forward. Some suggested getting married in Nigeria and filing for a CR1. That alone won't fix the problem. You need to know exactly what the CO noted in your case for the denial. 
     
    Take some time to be angry and cry, but don't wait too long. Time is of the essence.

    If your boss dit not deduct taxes for you, that means you still need to pay those taxes, over what he payed you, or you will be commiting tax fraud. that is a bad idea with or withouth K1 visa in prosses.

    Sounds to me that if your boss tolt you he was paying taxes for you when he hired you and then was not doing that, he has not payed you the amounth of salery that he owes you. ANd if you have a written contract you should go afte that as soon as you find another job. You can still get the rest of your salery then and pay that to the IRS yourself. Regardless report him as soon as you are shure of your new job. Becasue that is false pretences and most defenitly illlegal, if he does that with you he is probbaly taking advantage of other workers to.

    Those kind of employers are the big problem for america where immegrant workers are getting the blame for.

    Really only one chance.  If they have a question or issue with what you sent in with the first RFE, they could possibly ask for more info, but general rule of thumb is one shot.

    You don't have anything to worry about!
     
    First, any mail that you get will be sent to the US citizen's address, not the foreign fiancee, since it is the US citizen who's officially petitioning for you.
    Second, the addresses that "count" for mailing and official records for both you and your fiance are the ones on the I-129f, not he one on the G-325a. 
     
    On the G-325a, if you wanna do everything strictly correct, just put the address you are living right now as current. That's the truth at the time of filling the form.  You are not supposed to get any mail from USCIS, but if you are still worried, just put your parent's address or your fiance's US address on the I-129f, part 2, "Alien Fiancé(e)'s Mailing Address"  and their name in the "In care of Name" question. I put my fiance's US address in that part and didn't have a problem. This address can be different than your physical one (Part 2, question 29).
     
    This part is just how it worked in my country, so I'm only 95% sure that it'll be the same for you: it was my fiancee (US citizen) who received an email (not mail) from my embassy telling him that they were ready to see me, etc. So no matter what, you shouldn't have a problem by stating where you live currently, even though you won't be there in a couple of months.
     
    By the time you have your embassy appointment, you'll have to fill other forms and you can put your updated physical address there.

    If they are still LPRs and they have not worked for 40 quarters in the US, then you are still liable. Once they either abandon their LPR status, become a citizen, or worked 40 quarters in the US, you are no longer responsible for them in terms of the I-864. For future I-864/I-134 purposes, you must include them (and their dependents - at least as of the time filed) in your household size (as long as you are liable for them, as described prior).

    Yes, you can do a 3rd K-1, but I think a CR-1 would probably be a better approach. Either way, the CO may assume that you are bringing people into the US for immigration purposes only...you'll likely need to show that the assumption is incorrect and the relationship is bona fide.

    Of course there is. Maybe in the UK there can be only one and it doesn't have to be the petitioner, but that would be a particular case to that embassy. But in a lot or most embassies, there definitely can be more than one sponsor for an I-134. For example, in my case, the sponsor was my husband (petitioner) and the co sponsor was his dad. They both had to sign their own I-134 and provide their own set of financial evidence.

    I traveled from TX to NY right after I married and used my passport with no problem. I carried a copy of the NOA1 just in case, but I never needed it. In theory you should be fine, but without wanting to fall into fearmongering, things right now ARE weird so you might face some weird moments. Overall, worst that can happen in my opinion is that some agent decides for whatever reason to make you life harder and will her up with silly questions, but she IS in the system as if everything has been done right, she should be ok in the end.

    A request for initial evidence (RFIE) is given when something essential is missing from the application (a document that is specifically asked for in the filing instructions, such as a birth certificate). A request for evidence (RFE) is sent if they are not convinced by the evidence provided (e.g. they want more supporting evidence of relationship).

    hey guys, I got approved yesterday, interview went pretty well. Just wanna thank you guys for the information, and especially a huge one to user pantonia because I almost got 221(g)ed for exactly the financial docs part you pointed out. Fortunately I was able to get the cosponsor docs a few days before the interview. My status on CEAC is now on AP and i should have my passport w/visa in a couple of days, likely Sunday. Once again thanks, and I gotta say, this site is amazingly invaluable.

    With all the time and money it costs to go through the process, I'd just go to the interview, get the visa and once you have it, I believe it is good for 6 months, so you don't have to immigrate as soon as you get it. If you think there's still a chance to fix things between the two of you, I'd go ahead with the plan and then use the 6 months or so you get to figure things out.

    I think a lot of us aren't seeing these stories as a new unprecedented thing;  we are seeing them under the new perspective of the messily implemented executive order. Secondary screening has always been a thing, but now they may or may not mean something different. In other circumstances I would say to people to "risk it" since the worse that could happen in normal circumstances is to get an unpleasant time detained or an invasive interrogation/search and that is always a risk just by flying, but as things stand now, people could be risking not being allowed into the country at all. I understand not wanting to fall for fear mongering, but I believe that an abundance of caution for now is not crazy.
