I'm really confused about the immigration process for getting to America (where my SO lives) from the UK, more specifically I am confused about the income requirements and am looking for advice on how to meet this requirement (I am aware of requirement amount etc) and about co-sponsors etc.

 

To give some background neither me or my SO have particularly good or well-paid job and haven't attended college. He is making about minimum wage so are no where near the income requirements at present.

 

I know that my SO's dad could be considered for a co-sponsor (he makes around $29,000 a year) however living with him at present is my SO, his sister (18), other sister (13) and also his dad's girlfriend and her 3 kids who are all under 18. I'm wondering how much his dad would actually need to make to qualify as co-sponsor as I know it would take into account his dad's kids, but would it also take into account his girlfriend's kids as they live with him? Sorry  if I sound stupid, just the numbers really confuse me and I've tried looking it up everywhere but just find the wording really hard to understand. 

I also know you can have two co-sponsors but I'm unsure on how this would be beneficial as they can't join the funds together in order to make the requirement and have to make it individually so I'm not sure how this would help? Unless I am just not understand correctly.

 

I am basically looking for advice on this as well as advice on how others have managed to meet this requirements as I am losing hope that this will become possible for us in the near future! Thanks in advance

My advice would be to look up the chart with financial requirements. That will show you exactly how much your cosponsor would need to make. Be aware that dependants make a huge impact on how much money one needs.

According to USCIS, household size includes: "Your household size includes you, your dependents, any relatives living with you, and the immigrants you are sponsoring."

So that should be: Your SO's dad (co sponsor)+His two daughters+Your SO+You=5 people at 125% of poverty guidelines= $35,550

 

If the co sponsor also includes his gf and gf's kids in his tax return, then he has to count them in the household size too, which would total 9 people at 125% of poverty guidelines: $56,312

Now, for the I-864 (Affidavit of support used in the AOS process), the joint sponsor (Your SO's dad) can include a member of his household (probably his gf) who signs I-864a and then combine both their incomes to meet the income requirements.

 

HOWEVER, you seem to be at the k-1 stage, which uses the I-134 form. With that one, you are only allowed to have one co sponsor, meaning your SO's dad can't include his gf's income to meet the requirements (some embassies don't even allow a co sponsor at all at this stage, but I doubt that's the case with the UK).

Of course there is. Maybe in the UK there can be only one and it doesn't have to be the petitioner, but that would be a particular case to that embassy. But in a lot or most embassies, there definitely can be more than one sponsor for an I-134. For example, in my case, the sponsor was my husband (petitioner) and the co sponsor was his dad. They both had to sign their own I-134 and provide their own set of financial evidence.

You're confusing the term "co-sponsor" with "joint sponsor".

 

Regardless, there is no I-134 joint sponsor as there is with an I-864.

 

In your case they filled out two separate I-134 with no connection between them. This is unlike an I-864 which asks the person to identify if they are a joint sponsor or sponsor.
