    Tourist agencies in Indonesia are useless for that kind of thing, yet so many Indonesians use them. Boggles my mind. Basically those agencies either give general advice that is helpful for other visas like Schengen and Japan (such as letter of recommendation),  or shady advice like the OP's partner received.
     
    Anyway, she should just be honest. Putting you down may or may not hurt you, none of us know. Her age, occupation, etc are more relevant anyway. She should just be truthful, that way she will avoid any problems down the road.
     
    And tourist visa applications have no bearing on K-1 applications. Good luck to you both!

    I would run...not walk..away from that agency.  They are advocating lying to US immigration.  That will end in tragedy.

    This plan is a huge red flag for immigration. You have to list all your addresses from the past 5 years. How are you going to explain we don’t live together. You can’t lie about because they can look up the information.

    I'm having a hard time digesting this.  You both have children and you're speaking about marriage and you've never brought your children together?!?!  Yet, you speak about how selfish it is not to consider the children and how important it is to make things OK between the kids...do you ACTUALLY care what the kids think or have you already decided you're getting married and the kids will just have to deal with it?  
     
    If you do care, someone needs to get on a plane, children in tow, and visit the other party, their children at home.  You cannot get married without the kids haven't even having a chance to meet!  I'd want to see how parenting goes with both parties involved and work through some guaranteed disagreements there long before it was permanent.  
     
    And yes, I am a parent.

    You are welcome - Enough to know they are not pieces of furniture needing to fit together, so moving them is not as easy.   
     
    If you think that staying apart is what is best for your family, that is ok, you know them best.  My husband and myself have to be separated regularly, for different reasons, but we are always so happy to reunite.  I wish the same to your family.  Be it that you spend the weekend at the cabin together, or everyday, different things work for different folks.

    I think you are the first person to mention such a situation in all the time I have been here so I guess that has confused members.
     
    Apart from the cost, I guess such a situation would not occur to most people.
     
    Personally I do not see what sort of benefits you get from delaying the inevitable.

    It's one of the requested/required documents for your interview in Jakarta. Or it was when my wife got her K-1 visa a few years ago. I can't imagine they no longer have that requirement.
     
    You can do the translation yourself, there is no requirement to have a formal translation.

    Mexico and some other countries give you a pass if you have a visa to the US etc. I guess they assume if you managed to get a US one you will not be abusing your privilege.

    I flew from Peru,  stop in Bogata overnight as the plane had issues and then onto FLL / all i wanted to do was get home 
    FLL is easy / the peruvians flying in on my plane had short interviews with immigration

    Prior to 1994, someone who naturalized was expected to intend to live permanently in the US per Section 340 of the INA.  If they moved to a country outside the US within one year of naturalization, it was considered prima facie evidence of a lack of that intent, and was grounds to "denaturalize" the person. However, this was removed from the INA in 1994, in Section 104 of the Technical Corrections Act.
    The cited 1964 case law on the residency rights of natural born vs naturalized citizens was, obviously, decided prior to the 1994 change to the INA on the grounds that natural born citizens could not lose citizenship because of overseas residency.  The amended law now makes clear that residing overseas is not grounds for losing US citizenship.
     
    I don't believe that narrow decision on the law plays a part in changing the requirement to be a "natural born" citizen (i,e., those who were born as US citizens, with no need to naturalize) to run for President.  That is a constitutional requirement (Article II, Section 1, Clause 5), although he claims he can overcome that requirement on constitutional grounds.  I'm not sure how any court can declare the Constitution to be unconstitutional, so I don't know how he's planning to be successful, but..who knows!  There certainly is not enough time to propose and pass a constitutional amendment to change that provision prior to the next election.

    Ok, my idea, a long shot, was to create an online account and add the case number to see if extension letter was online. Then if online, use a print out of that to board the flight on the high percentage bet that the airlines do not know about the Lady Liberty watermark.  

    Aren’t you concerned that something might have happened with the case while you have been gone? RFE, interview, denial, or approval. If RFE or interview, then the case has long since been denied. 
     
    So I do not recommend the Vancouver thing because if the case was denied, she might be taken into ICE custody at the border.
     
    You need to get the case number, or file a new I-751 to get a new case number.
     
    Personally, if it were me I would fly to U.S. alone to dig up that case number. If denied, then file a new I-751, bring the new extension letter to Japan,  fly to JFK or SFO, and hope CBP over looks the previous denial.

    This is going to be my last post in this topic, but I want to reemphasize that our country is a homophobic country and any narrative to frame it less is misleading and it could be potentially dangerous for the LGBT people who actually live in Indonesia because international pressure could subside with that framing. Just because LGBT people doesn't get death penalty for being LGBT doesn't mean it's not a homophobic country. Living in hiding, constant fear of being raided while out and about and only can do it at the death of a night, no protection from the government, risk of being fired from work, 90% of Indonesian citizen polled felt threatened by the LGBT community, extra marital law that could target LGBT community while getting old while being single is still looked down upon, constant hate in social media for being out, self hate that still rampant amongst LGBT people, every LGBT rights group should operate in low profile, just a few months ago ASEAN LGBT Advocacy Week in Jakarta was cancelled and moved because of massive protest from the citizen including the biggest most influential religious group and the government was basically saying nothing. Oh, and of course no same sex legalization.
     
    Thank you so much for the suggestion and yes, my boyfriend could come to Indonesia safely and won't be stoned, but that doesn't mean there's no limitation and what little freedom he has would only be because his foreign citizenship (and he looks foreign), but I would not put him through that, also we're both not in abundance of money and when every decision is a make or break, we couldn't afford to buy our way through the law if something happens.

    file B2 visa. if got denied, ur boyfriend can come to visit you in Indonesia easily with visa on arrival. easier that way, now i cant give opinion about his tight schedule. 
     
    i'm from indonesia so i know theres no issue for gay person visiting their bf in indonesia. i have many gay friends in indonesia and they're bf overseas visited them in Indonesia with no issue.
     
    if you by any chance not comfortable to meet him in ur home town for some reason / small city or whatever, meet up in surabaya/ jakarta/Bali. i was born in Surabaya, live in Jakarta for 3 years and Bali for 5 years, gay community is quite big in those cities same like Bangkok.

    The worst that happens with DCF is that you send an email to the embassy and they say no. You can file the I-130 if the answer is no. A delay of a few weeks is worth potentially saving a year and a half.

    I don't see how it would make a difference, as there is no 'reset' with a new fiscal year since those visa classes are not numerically limited.
     
    It's not a matter of caring.  It's a matter of huge numbers of applicants for your consulate.

    I'm surprised the US immigration lawyer who prepared/reviewed this submission used or approved the language of "formal engagement ceremony" and "celebrate our bond and commitment." 
     
    I just would have said "engagement party" or at most "engagement ceremony."  The words "formal" and "bond" were unnecessary and would tend to do more harm than good, in my opinion.

    When I saw "ceremony to celebrate our union" i thought  "Noooooo. You had an engagement party to celebrate your engagement."
     
    Repeat that until you get it down cold. Engagement party. To celebrate your engagement. 
     
    There has been no "union" and will be no "union" until you marry in the USA, got it?
     
    Don't refer to her as "my wife" anywhere at any time from now until you marry.
     
    Do not use or show any photos of her in a wedding dress.
     
    I see your attorney has already filed the K1. Did he or she include the wedding dress photos?  Perhaps you should discuss with your lawyer concerns you've read that you are now "too married" for a K1 visa.
     
    I don't think your K1 application is as doomed as some other posters here do. Engagement ceremonies are common in some Southeast Asian countries and if you DON'T have an engagement ceremony the consular officer may wonder if you are truly engaged.  I believe that some of the examples involving people deemed "too married for a K1" were from countries where engagement ceremonies are not common.
     
    If you can present this as an engagement party I think you're fine. But I agree with others that your description of this "union ceremony" and the bridal dress photos may be somewhat problematic.

    Marriage in Peru is performed according to the Peruvian law, and specific questions on the process should be addressed to a Peruvian attorney (PDF 94 Kb) or Peruvian authorities.  Consular officials cannot perform marriage ceremonies nor can you be married at the U.S. Embassy.
