    Continue looking for another job to become financially independent enough to be able to move out of your parents’ house. That will at least give some relief during the wait.
     
    I understand how difficult it is to be caught in the middle (your parents disapproving of your relationship) but at the end of the day you are an adult and this is your choice. They are very likely afraid of losing you, you are planning to move to a new country. They might just be showing it in a very unpleasant way. 
     
    There is no way to be able to live in the US until your K1 is approved, so focus on improving your situation during the wait.

    I would not stay for the full time allowed.  Short visits are better. If CBP even thinks the OP is trying to live in the US on VWP, some very negative consequences can occur.

    I'm sorry you are dealing with this. First since you are stuck with your parents, if you have already tried to talk to them about this then there is nothing more you can do to change them. 
    While you are trying to get out of the home, do not talk to them about your intentions to get married or leave. Keep your plans private.
     
    If you are not making much money and they take every cent of it. Tell them they will now get nothing as they sold the car that takes you to work and you lost your job. You are under their roof and it will be their way or the highway. So tell them straight up that you're taking the highway. Couch surf if you have to until you can get enough money saved to get your own place and find a better job. 
     
    Sadly there is no way to make this faster or for you to stay in the US until your interview.

    It sounds like your husband did not pull the divorce petition and lied to you and to the Officer at your AOS interview. It is very important you seek a very good immigration attorney.

    They're not processing I-130 simply because they know no visa is available for him for another 5 years or so.
     
    Instead they're focusing on immediate relatives (minor kids, parents and spouses of US citizens) plus people who filed several years before 2013.

    They are here , they are safe and am sure your wife is relieved. 
    ‘All 3  options are open:
    1. U4U parole renewal every two years,
    2.Asylum ( long drawn out way to a green card ) ,
    3. Adjust as IR via your wife ( short simple way to green card). 
     
    No use pressuring them to decide..but it’s important for all of you to know if they would live in US long term …then choose Adjusting now.

    While you wait decide if you want to 
    a.) Have your husband move back to the US to secure a job.
    b.) Save money and have it in your bank account in Italy or move it to a bank account in the U.S. (helps with intent to reestablish domicile). 
    Currently your husband will need to make $39,000 for a family of 4 or 3 times that in savings. 
    Your assets do not need to be in the US. You just have to show you are able to access the money in the US.

    While the K3 isn't QUITE dead - why would you want it?  It has all the frustrating parts of the K1 (adjustment of status) and none of the benefits of the spouse visa. 
     
    In the past few years, K3 issuances have been as follows: 
     
    2018 - 5 K3s issued (Mexico - 2, Bahamas, Brazil, Honduras - 1 each)
    2019 - 7 K3s issued(Mexico - 3, Afghanistan, El Salvador, Venezuela and Yemen - 1 each)
    2020 - 2 K3s issued (Honduras and Yemen)
    2021 - 2 K3s issued (Mexico and Pakistan)
    2022 - 4 K3s issued (Mexico - 2, Great Britain and Brazil - 1 each)
    2023 - 6 K3s issued (Democratic Republic of the Congo - 2, China, Great Britain, Morocco and Yemen - 1 each)
     
    The only one I know the full detail of was the one from Morocco in August 2023 - basically because they were asking questions on a FB group and I didn't believe their K3 had been approved by USCIS so I asked and they sent me pictures and I kept thinking that they wouldn't actually GET the K3, but they did. In their situation, the couple had filed a K1, then got married and (unknowing the proper steps) filled out the I-130 and a couple days after the I-130 was filed they K1 was approved so they sent a request that, since they were not married and had filed the I-130, that the K1 be changed to a K3 - and surprisingly it was - which they verified through all NOAs and visa issued to me. 
     
    I'm pretty sure they got lucky and it was a fluke. For the others that have been approved - I always wondered if they MEANT to get the K3 or if theirs were by accident also.

    It's free to file an I-129f after an I-130.  Best case scenario is they close the I-129f, then immediately approve the I-130 to continue.  Worst case scenario, in my opinion, is they actually issue a K-3.  Who would want to have to adjust status? To my knowledge, only a very, very few K-3s are still  issued.

    Welcome to the forum.
    1.  Personal choice...irrelevant to immigration.
    2.  There is no 90 rule.  You can marry and start the process for concurrent I-130, I-485, I-131, I-765 filing right away after obtaining a marriage certificate.
    3.  No. No.
    Married or not, once your I-94 expires, you will be out of status and deportable until you file a proper I-485. Then, you will be granted authorized stay in the US unril the I-485 is either approved or denied.  Be aware that you cannot work (in any form) or leave the US for 3-6 months after filing the I-485.  Good luck.

    Let me help by putting playing the role as a CBP officer at your pet of entry. Because you seem to be extending your stay on every trip and your trips to the US seem to be frequent,  I would have questions. 
     
    Like: 
    "How are you able to take so much time away from home?" If you do not have a job that will make things even more suspicious. 
     
    "Where will you be staying during your visit here?" If you say a person I would follow up with who that person is. 
     
    "Do you have any relatives here?"
     
    "Do you know anyone in the US?" If you answer yes to this question I would follow up with, "Who are they to you?"
     
    You may have noticied in this line of questions that I had an agenda to it. Your length of stay and the fact that you are repeatedly returning has the suspicion of a love interest here in the US. And this will cause red flags.

    You are grasping at straws here.   There are no loopholes to the wait times, which are only getting longer due to the sheer volumes of petitions filed.

    That one overstay basically made all her previous "good" travel history irrelevant. Just to reiterate the point already made by others, overstaying on the ESTA was a huge mistake, and she is unfortunately experiencing the consequences of that mistake. 
     
    I don't want to hammer too hard on it, but I don't understand how this overstay even occurred. Did you both misunderstand her period of authorized stay? If I recall correctly, CBP literally writes the date on the passport stamp showing the exact end date of allowable time in the U.S., and the max stay allowed on ESTA is 90 days. Staying even one day over can have detrimental consequences on a person's ability to keep their ESTA or visit the U.S. ever again.
     
    There's no guarantee that she'll be able to get a tourist visa again. It is possible that with time, she can get approved.

    I think you're underestimating how big a mistake that was though. She is very unlikely to be granted a visa now having shown she ignored immigration laws previously, particularly with a USC spouse. 
     
    As said above, leave it for a few years then try again, you never know.

    Everything I have read (which isn't a great amount) says a K-1 visa holder cannot adjust status after marrying someone other than the original petitioner......but consular filing can be done.  A ban can apply if the K-1 visa holder has overstayed beyond 180 days.  That would require a waiver. This is lawyer time, imo.

    Hi Nick0128,
     
    YES! I had the exact same situation as you and now I have my green card!!  DM me so I could share my experience to you. I entered US through K1 visa, had problems with my marriage and later divorced, and met my 2nd husband (also a USC). So the answer is yes, there's definitely a way to fix your status because I just did mine!
     
    Step 1: I recommend you hiring an attorney because the situation/process is complex, although you can still diy it no problem to save a lot of money! I paid my attorney 15k start to finish, and they handled everything. 
     
    Step 2: The attorney or yourself will need to file an I-130 ( petition for an alien relative). YOU CANNOT DO i485 (adjustment of status), due to the nature of our visa when we entered the US. My I-130 approval came in only 1 month after filing, which is really unheard of! But usual process takes about atleast a year or more for this stage. YOU NEED to get i-130 approved before you can apply for the waiver. 
     
    Step 3: Decide which waiver you wanna do. There's 2 types of waivers, #1 is the i-601 A  waiver - meaning you'll stay in the US till you get the approval before you go home. Because of covid delays, unfortunately it runs about 3-4 years to get the waiver approved.
    #2 is the i-601 waiver- meaning you'll go home and do the consular interview knowing that you'll get refused because you would trigger the 3 or 10 year ban. I wouldn't recommend this because getting a waiver approved whichever you choose is hard to get approved. You'll have to show "extreme hardship" for your USC spouse.  That's why it's best to do the i-601a while still in the US to see if you can even get the waiver approved. 
     
    Step 4: Once the i-130 is approved and the i-601a waiver is approved then you'll have to go back to your home country for the interview. If your interview gets approved then you'll get your visa to fly back to the US and get your 10 year GC. 
     
    Don't hesitate to reach out to me, when I started my process I couldn't find anyone who was in the same boat or atleast know someone who went through the process. So I'd be more than happy to share with you my journey!

    File I-130 for consular process
    Once you have approved notice , pay IV fee and send email to notify NVC you are filing I-601 A Waiver . 
     
    File I-601 A and  wait in the US with your husband and family for the approval. Once approved  , finish NVC process , get scheduled  and go to home country consulate for interview . Return with green card. 
     
    Take action now …administration could change
