  1. Not that I have heard of as long as the “consummation” occurs prior to filing the I130 which you are already aware of, and you have good evidence to prove that. I would expect more scrutiny with respect to your previous situation, but it appears you have that well in hand and have remedied it to the best of your ability. Good Luck!
  2. Good luck trying to figure out how USCIS processes cases. I know it is frustrating to see other contemporary cases completed while your’s is still in process, but there are many factors involved. Each case is individual, and some may require more attention than others, also it is not clear within USCIS if they re-assign cases if a clerk/IO is on vacation, or out. It does seem that USCIS tries to somewhat balance the workload, but like in any relatively large government bureaucracy, who really knows what parameters are used. Good Luck!
  3. One thing I learned yesterday at our cousin’s oath ceremony is that the judge is not scheduled (at least in Detroit) for an hour after the time stated on the interview NOA. My cousin’s notice stated 2pm, but the judge showed up at 3:15pm and apologized for being 15 minutes late. Apparently the notice time is when future citizens need to be in line to check in.

  5. It is unfortunate you didn’t choose Option 2. Our cousins are taking their oath today about 3-4 weeks after their interview with a name change. Regardless, congrats on you wife’s naturalization!
  6. If you as the USC have a reason to relocate back to the U.S. on relatively short notice, you can request the consulate in the country you are currently in to process the I130. This is referred to as Direct Consular Filing (DCF) under exceptional circumstances. If the I130 is submitted to USCIS, DCF will no longer be an option, but you can request expedited processing at the various stage of that process. I would do research on DCF as there are many that have taken this route. The VJ search engine can be helpful with that research. For some reason the political elite in DC think this is a replay of Charlie Wilson's War, but it is way different, and at some point given all the manpower losses in Ukraine, Zelenskyy will be requesting troops. This should not be an issue with a B2 application as your mother applies on her own accord and although she will need to list any relatives living in the US, there is no need to prove a relationship with evidence. As to an eventual IR5, you sibling will need to prove this is their mother usually through a birth certificate showing the mother and the name of the child. If the name differences become an issue, there is always the possibility of DNA testing. Good Luck!

  21. Because K1s and spousal visas are taking about the same amount of time, and a spousal visa is much more superior than the K1 particularly when it comes to the beneficiary, but also cost.
