Zedayn got a reaction from sgtm7 in Tourist visa cancelled by CBP agent. Can we still get a CR1 or K1 Visa?
You can file for K-1 or CR-1 visa even though the tourist visa was cancelled.  The fact the tourist visa was cancelled shouldn't make a difference.

Given that both timelines are about the same it sounds like CR-1 would be the way to go.  K-1 visas used to process much faster and thus was the better choice to bring your gf/fiance to the US.

Even if your Immigration Lawyer has handled many PI cases, the Lawyer is not the one handling the paperwork, that will in the main be the ParaLegal, who may not.

I am not sure what a Lawyer can do about taking the wrong documentation or for that matter Medical issues. DS 5535 happens but not very frequently, I was not under the impression that Lawyers talk about this in advance as a norm

Triple check the denied entry, You can ask what happened and review the paperwork, request a FOIA that is about it.

What do you mean by properly answering? That is all water under the bridge what happened happened, if there are any consequences then that is something to be dealt with in the future.

I wouldn’t recommend a lawyer.  A tourist visa being cancelled is minor.  I had a somewhat more difficult situation and had no issues at all with the process.

Do your research, read the guides here, read the instructions for the various forms, and if there’s something you dont understand, just ask.

CR1 is a very wise choice for the Philippines.  I know.   I have first hand experience with what an awesome choice it was.

More or less any way will require at least a short trip by the US person at this point.

Utah online marriages heavily tested at this point by both the US Government and the Philippine Government so your statement that online marriages may not be accepted by the philippine government is just plain false.  One simply must register the marriage.  EXACTLY the same as one would need to do with any K1 marriage if they wanted it to be recognized by the Philippine government.

Philippines requires an online marriage (or any K1 marriage for that matter) to file a Report of Marriage with the appropriate Philippine Consulate.  That's all there is for it to be recognized in the Philippines.

Zedayn got a reaction from Juan&Rocio in Questions about Affidavit of Support/Co-sponsor
Ok household size doesnt mean the number of people living under one roof. Household size is the number of people the sponsor has to support. You dont support your parents right? Then they are not included in YOUR household size. You only count those people you support in your household size. If its just you and your fiance, then your household size is just 2.
Yes typically you can use a co-sponsor, and they need to meet the poverty guidelines as well. You need to have 125% of the poverty level for your household size, the same applies to your co-sponsor if you use one.

Zedayn got a reaction from mogiftney in I have a question about form i-131 as part of AOS
For part 3 you can write UNKNOWN for date of travel and length of trip. You can leave all of parts 4, 5 and 6 completely blank. The instructions at the bottom of page 2 state:
If you are applying for a non-DACA related Advance Parole document, skip to part 7.

No reasons or explanations needed when filing for AP.

Zedayn got a reaction from Mike E in Translation for documents
This is incorrect. ANYONE can do the translation, including the petitioner or beneficiary. This is exactly what USCIS requires (from https://www.uscis.gov/forms/forms-and-fees/general-tips-assembling-applications-mailing):
Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.
The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:
    Certification by Translator
I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.
    Signature_________________________________
    Date Typed Name
    Address

Please note that this applies to translations submitted to USCIS only, NOT translations submitted to the embassy for the interview. Each consulate will have their own rules regarding translations. Some countries do not require a translation and will accept documents in the country's native language.

You are NOT a K-3, you are a K-1. You are correct, your status has not changed.
What you need to do is go back to the SSA and apply in your VISA name. If they give you the run around and say you are a K-3 again, then just ask them to search for your VISA name in their computer. Your name will show up as eligible to receive an SSN. If they refuse to look you up, ask for a supervisor or go to a different SSA office.

Zedayn got a reaction from Hemutian in Is X ray CD required at POE for K1 immigrants
From personal experience, and I have done this twice already, the X-ray CD is never asked for. My wife still has her sealed X-ray CD in a folder with her other immigration documents.
The CD is basically just a souvenir of your medical exam.

A supplement is not needed because you are filing based on AOS. No reason is ever needed when filing with your AOS.
    I will quote a post I made a while back explaining why : http://www.visajourney.com/forums/topic/563869-aos-cover-letter/?p=7795494

Zedayn got a reaction from Carpe Vinum in Multiple filer
The multiple filing limitations set forth in the IMBRA have nothing to do with using a marriage broker. They have to do with multiple filings of fiancé petitions. In your case, this is your 3rd time filing a fiancé petition and therefore you are required to submit a waiver request. From the I-129F instructions:
You must apply for a filing limitations waiver if any of the following apply:
    a. You have previously filed K-1 petitions for two or more beneficiaries; or
    b. You previously had a K-1 petition approved and less than 2 years have passed since the filing date of such previously approved petition.
It doesn't matter if your previous petitions were approved, cancelled, withdrawn, etc. The fact is that you filed them.
I also had to include a waiver request with my petition. You can find a sample of it here: http://www.visajourney.com/forums/topic/509146-waiver-for-multiple-fiance-filings/?p=7177435

Zedayn got a reaction from mjoyceb in Vaccination?
Vaccinations are not required for a K-1 visa. They are required for the adjustment of status once in the US. If she needs any vaccinations, they will give them to her at the medical. For Philippines, the vaccinations are already included in the cost of the medical exam, so you won't pay extra.
The vaccination requirements for AOS only require at least one shot in a series.
For most adults, the required vaccinations for AOS are typically MMR, Tdap, and Varicella. The flu shot is also required if it is during flu season. Here is a link to vaccination requirements by age according to the CDC: http://www.cdc.gov/immigrantrefugeehealth/exams/ti/civil/vaccination-civil-technical-instructions.html#tbl1

Zedayn got a reaction from MsNina in Facebook status
USCIS does not try to validate whether or not a relationship is real. It has no bearing at all on the I-129F approval. If you meet the I-129F requirements, you are usually approved...simple as that.
The evidence of relationship is needed for the embassy interview. The CO usually has no desire to go digging for proof of relationship on facebook or any other online places. They can if they want to, but usually they don't care about it. Only if they believe your relationship is not real will they care to pursue it. If they want proof, they will ask you for it. Usually the CO will just ask to see some pictures of you two together, which is all they asked from my wife. Facebook wasn't even considered.
    Relax, you will be fine.

You do not need to wait to apply for the SSN. The I-94 is electronic now, which means the SAVE database is updated immediately. The information you are reading about having to wait 2 weeks is from when the I-94's were still on paper.
You can apply at ANY SSA office in the country, as the SSA is federal, not state.
