I have a question about form i-131 as part of AOS

By abella in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

Looking at some old posts i see that it is recommended we file this form just in case travel becomes necessary at some point. I do have some questions though.

Is it ok to leave part 3 blank as it pertains to departure dates, length of trip etc? Also part 4 listing purpose of trip and countries we intend to visit? And lastly on part 7 it asks about the amount of trips planed, if one trip or multiple trips. I checked multiple just in case. The rest I left blank as we have no immediate travel plans.

Is this ok?

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

I left Part 3 blank.

In Part 4.1.a., I wrote "In case of emergency travel is required during the Adjustment of Status process." In 4.1.b., I wrote "Germany".

Part 7 I checked the same box but left the rest blank.

For part 3 you can write UNKNOWN for date of travel and length of trip. You can leave all of parts 4, 5 and 6 completely blank. The instructions at the bottom of page 2 state:

If you are applying for a non-DACA related Advance Parole document, skip to part 7.

No reasons or explanations needed when filing for AP.

On part 7 you only need to answer the first question: How many trips...?

You do not need to include a supplemental sheet explaining your reasons why you need AP.

I left Part 3 blank.

In Part 4.1.a., I wrote "In case of emergency travel is required during the Adjustment of Status process." In 4.1.b., I wrote "Germany".

Part 7 I checked the same box but left the rest blank.

AOS applicants do not fill out part 4. The bottom of page 2 of the form states to skip from there, in the middle of part 3, down to part 7. No reason is ever needed on the form or in an attached statement when applying for AP as an adjustment applicant.

I was also baffled with that, and decided to not file AP...

until VJ-ers encouraged to do so...

So I just wrote "unknown at this time" and we got the AP approved.

I'm also filling in this form now.. and wonder can I just leave it blank in Part 3 question 1&2? Coz I want to fill in the form by computer and the system won't allow me to put "unknown."

Does anyone know about this? Thanks!

You can leave them blank and hand write Unknown after printing out the form.

The current Form I-131 right now expired last 03/31/2016. Is there a newer version? Where can i download it?If not, will submitting the expired form be acceptable for the USCIS? Is it a good idea to go ahead and submit the expired form or just wait for the new form to be released?

The current forms are what they have for download on the USCIS website. The OMB(Office of Management and Budget) expiration date only matters internally for the USCIS. That expiration date has nothing to do with whether or not it will be acceptable for you to use. The edition date is what matters.The accepted edition dates for the forms are listed on the site where the forms can be found and downloaded.

The I-131 states this. >https://www.uscis.gov/i-131

Edition Date

01/22/16. A new edition of this form is coming soon. In the meantime, customers may file using the 01/22/16 edition. We will also accept the 03/22/13 edition. You can find the edition date at the bottom of the page on the Form and Instructions.
