    the amount of people who said " we dont need EAD, we dont need AP" but later on they need it ASAP and cant get it quick and decide to abandon the whole thing just because they said "we dont need it"
     
    always file any benefits that you can get. better to have it but dont need it. no additional fee anyway to file EAD and AP with AOS

    She wants to immigrate, therefore the F-1 is not an appropriate visa.
     
    I don't see any basis for an expedite.  Expediting because you don't want to wait the designated processing time is not possible.
     
    Expediting F2A and other numerically limited visas is not possible.
     
    Seems like you're grasping at straws for a way around the current processing times and available visa types.  Waiting and following the rules is just part of US immigration.  If that doesn't work for you, another option would be to move back to Nigeria.

    Get the death certificate and give it a try.

    Logically
     
    * USCIS should only care if you were free to marry your current spouse.
     
    * If you were still married to spouse 1 when you married spouse 2, then the marriage to spouse 2 has no impact whether you were free to marry spouse 3
     
    * since spouse 1 passed away before spouse 3, you were free to marry spouse 3

    AFAIK immediate relative still can be hit with misrepresentation, which makes them inadmissible? Then the whole I-601 comes into play.

    Considering the mother is the third party in the relationship and he seems to do whatever she tells him to do, I strongly advise you to take the CR1 route to protect yourself and your child.

    I also noticed biometric scanning of all passengers on my last few international flights out of the US. As in a camera scanning everyone at the gate, right before boarding the plane. That's exit control right there.

    I have traveled overseas over 5 times and never had issues returning with the 48 month extension letter.I haven’t done anything wrong,have maintained legal status,followed all the right channels,never done anything illegal.I don’t see how I’m gonna get locked up just like that LOL

    Risky. You can be denied and they take your GC as well. I would not attend.
     
    Legally you cannot be forced to file I-407. I would not do that.
     
    ESTA is not for LPRs.
    Legally LPRs cannot be denied entry.
     
    Your situation comes up several times a year on VJ. In all cases when there is a report, the report is the LPR is admitted into the U.S. as a returning resident. Some times there is warning.

    There will be very long AP for any Russian citizens for obvious reasons, similar to the reasons why citizens of Muslim countries get long by APs. Currently, Russia uses these “students “ and “tourists “ to spy or push Russian propaganda. This is the matter of national security and there is nothing you can do. Frankly, I don’t blame them. I would do the same. The only entity you can blame for such delays is Russian government.

    Are you the spouse beneficiary of an LPR?  If so, is your LPR spouse petitioner now eligible to file for US citizenship?  If they are eligible and haven't filed N-400 yet, they should file ASAP.  Once they become a US citizen, they may request your case to be upgraded from F2A to IR1 (spouse of USC).  That way, the visa bulletin will be irrelevant to your IR1 spouse visa case, and you can be lined up for interview based on your DQ date of Sep 2022.

    Just chatting to school about vaccines and school records. This is one of the proof USCIS accepts as intent to re-establish domicile. Basically, everything your sister is planning to do to move back to the US after her husband gets the visa she should do now.
    ETA: your sister is thinking: I  will make plans to move back to the US after I know my husband has a visa.
    But, the US thinks: We will only give the visa to @etrangais sister's husband because we know she is moving to the US and she needs her husband to move to the US with her. 
    It is about reunification in the US. It the family is outside the US together. There is no reason to give the foreign national a visa.

    Highly recommend being as nice and polite to the abuser as possible (they may not deserve respect, but your safety is the top priority). Also recommend being as far physically and mentally as possible when around the abusive spouse. I personally would not laugh at them. That only can escalate things to physical violence etc. Being polite also decreases the chance of them writing bad letters addressed to USCIS, which can complicate I-751 approval.
     
    I'd say family lawyer is highly recommended just to finalize everything fast. Immigration lawyer is optional but doesn't hurt (if a good one is hired)

    If your partner threatens you about the I-751 again, laugh at their face (from a safe distance).  As mentioned above, you may file solo I-751 with divorce waiver and get approved.  Many VJ members have done the same, some even without professional help.  But if you would be more at ease filing with help from a lawyer, hire a competent and trustworthy one, who has a lot of experience with I-751 divorce waiver.

    The chief of the IV Unit there is now retired from the Foreign Service and is writing anti-immigrant pieces for a think-tank.  I have this mind-movie of plastering the contents of that box all over him with use of SuperGlue, then soaking him in honey and staking him in a field full of fire-ants.  I would then stand there and mildly observe (aloud), "See what just a taste of what you put us all through is like?"  I would surely be joined by at least half a dozen other petitioners of my era.  See the first 8 pages or so of:

    Typically, it's been recommended here to wait 2 years.
    That can be very satisfying.  We ought to make USCIS pay us back for all of our trauma, so how about using the papers for a weenie-roast, or fireplace kindling?

    We do not judge on VJ and some people have more complicated lives than others.
