    He is "threatening to apply for foodstamps"
    The "threat" makes it a blackmail..
    He is within his right to apply for public assistance but to use it as a bargaining power by threatening is not right.

    we all are taxpayers, honey. you said you have means to get insurance but what to use the medicaid as a secondary option. That says to me that, I will keep my money and mooch off the govt even though I can afford my own..

    Yup.. disclose before they find out.. On the forms, they ask for "arrests, convictions,etc".. so refusing to disclose it means lying. misrepresentation is punishable with ban under immigration law.
    Where in IMBRA does it say this?

    Criminal Background Information Disclosed to Foreign Fiancé(e) or Spouse. IMBRA requires U.S. citizens petitioning to sponsor K visas to disclose convictions for a list of violent crimes on the “I-129F” petition form that they file with DHS, including convictions for domestic violence and assault & battery, as well as convictions for elder abuse, child abuse or neglect, and stalking; and multiple (three or more) convictions for offenses related to alcohol/controlled substances.[3]
    Anyway, stop trying to trivialize your domestic violence record , you had the chance to walk away after a couple of calls.

    Adding a "party" solidifies this point. And a pastor on top seals..You are married.

    A word of advice to American women dating Ghanaian men, please stay away from these traditional "engagements". it is a complicated concept and would easily get you denied especially for K-1 process. You can do it later after your fiance has arrived in the US.

    the fraud is using non-immigrant visa with intent to immigrate by adjusting status.  so, it is fraud.  since she not IR of a usc, the fraud is not forgiven.  her preconceived immigrant intent would matter.
     
    p.s.  a son or daughter can adjust through a parent.  lots of people do it when visa numbers available to them.

    I am sorry you're now experiencing the heartache of being denied. I've been there and know the pain you must be feeling. Unfortunately you're experienced the same thing my husband and I did in 2015...the CO most likely feels you're married. The engagement party, the pastor and the engagement rings all give the the impression you did a traditional marriage...even if you don't feel your married.
     
    Next steps: you will need to return to Ghana, legally get married and start again with a CR1. The good news is you have good evidence to move forward with a spouse visa. Also, you won't have the challenge of overcoming a "fraud" finding on the K1. It should be much easier for you to get through the next visa. 
     
    Again, I am sorry you have to go through this. It's not easy and sadly the time apart will be hard. But don't give up. We got through it and my husband arrived in March of this year. If you have any questions, feel free to message me.

    Ghana engagements usually count as marriages.... in my opinion they have viewed your relationship as a marriage. Not an engagement
