Same exact thing happened to me! It says ready while you're in AP. Keep checking the status as it will change to "issued" once the visa is printed. It is nothing to worry about, I guess they just randomly put some cases in AP - who knows why..... I also called DOS on an almost daily basis for the latest info. Hang in there, it will soon come!

I'd suggest to revise those plans.
You can apply for EAD without submitting AOS, but you'll have to pay for it and it's validity period will be 90 days from your entry (and it will take about two months anyway). Best option is to get married and file for AOS / EAD (at this point you do not pay for EAD and it will have 1 year validity period).

Then you (yes, you) have a calendar math problem and should be filing on or around 2/20/2014.
Regardless of the mistake, the date printed on the card is the governing date.

Okay, now we are getting somewhere.
If you are going to apply for AOS from ESTA, you need to sit tight. No trying to go to Mexico or other nonsense (she would not be allowed in and would be stuck outside the US).
You should not apply for AOS until you have your marriage cert. If you send the paperwork in without the main piece of evidence making you eligible, your paperwork will either be rejected straightaway, or you would get a RFE (Request for Evidence) which would just slow your whole case down. You will not get to an interview if you haven't submitted a marriage cert, so false to your idea.
You can apply for AOS after her stay expires. Overstay is irrelevant/forgiven for spouses of USCs who adjust in-country.
So, if you want to file ASAP, see if you can walk the marriage documentation over to the country clerk and get some faster service. But if you can't, then there is no need to panic. Just send in her paperwork when you get the marriage cert.

I understand your frustration. I was in AP in JA for 11 weeks. It took a congressional inquiry for our case to see movement. We were approved at the interview and my fiance recieved the green stub with DHL sheet. (by the way when my fiance arrived a green stub was stapled to his passport). So don't worry, if the CO said approved and took the passport it is coming. Do not stress over whether or not they will issue the visa. If they approved it, unless your documents are fake or your fiance has a criminal past or there were fraudulent statements made in any of the immigrant forms you will be good. It is very frustrating. All you can do is try to remain patient, keep your faith in God (this really helped me calm my emotions..PRAY), and keep yourself busy with friends and family. Use the time to prepare for your marriage and AOS. I can tell you from our experience I had over 9 CEAC updates some related to email some not. Keep track of everything. I would say unless there is some outstanding question they are not answering, wait till you get closer to the 60 day mark and then contact your congressperson or senator and speak with their staffed immigration specialist.
I hope you hear something soon. It does look like the embassy is moving alot faster than they were. I know you want this to be over. It is completely frustrating being a US Citizen and having no rights when it comes to this process. You are completly at the mercy of the US Embassy. I would say if it helps you, write a letter to the ambassdor (be pleasant and polite). I feel if enough people express their concerns over how inefficient the Jamaican embassy is, someone will take actions. At the end of the day they may have deciding power over who they issue visas to, but they are still required to be efficient because they are being paid by American tax dollars and their budgets are set by Congress.

your friend's spouse has already muddied the water by entering as "single" - that is misrepresentation.
as for what the steps are to remedy this, i suggest you reread the previous posts. her best recourse is to go back to her home country, follow the proper process for cr-1, and both spouses stop trying shortcuts.
no one here will advise you on how to commit fraud as that can earn a member admin action.

They told you what their "legal" options are. She can stay until her tourist visa expires, they can file her I130 petition now, and she can complete the process back in her home country, just like every other married immigrant has to do. You won't find a lot of support here for helping people to commit visa fraud, which you've already admitted your friend and his wife have done upon her entering the US fraudulently by lying to the CBP officer at POE.

So you emailed them your DS230 and you got no Packet4? Here are they steps we took... 1. Obtain case number from NVC 2. Sent email, subject was our case number. Body of email contained name & DoB for petitioner and beneficiary, a statement requesting packet 3 & 4 being sent via email. All this was sent to kingstonivappointment@state.gov. I also included our dhl confirmation screenshot for good measure. We got packet 4, medical history form and checklist from embassy in less than a day. The checklist details all that is required for interview, I.e. packet 3. You really don't need packet three to proceed. :-)
