Timeline

Today my fiance had his interview with the Kingston embassy. I have yet to actually hear from him as he left his phone with someone in a town close by since it's not allowed inside the embassy. I knew he should be finishing up so I checked visa status and and it says refused. I called DOS and due to the fact the embassy has finalized the process, they were unable to tell me the reason is. I am going crazy over here as I've seen so many get approved every day. What do we do next?

Talk to your fiance and find out if he really was denied and what reason they told him. The next step would depend on why he was denied. VJ members will be able to help you with more information.

They told him he needed the no impediment form, which is upsetting because it wasn't even requested on the letter we received. But the worst part is they asked him when he last smoked weed and was told he's banned from the U.S. until it's one year's time from when he smoked last

Thank you ok&mk. My heart is heavy with sadness. Scammers make life so difficult for the rest of us who just want to live our lives. I should be able to be with whomever I choose and bring them to where I live. To spend all the money and time waiting for this and to be denied for something so miniscual is absolutely beyond my comprehension. My fiance is hard working man and deserves a much better life than Jamaica can provide. We have so many Americans that are lazy, non productive, and a waste of our tax dollars. We should be able to kick them out and let people who want to become someone, be someone, and make a difference in their own lives as well as their families lives. Truly unconscienable and ridiculous!!!!!

Of course, I must agree with you guys about scammers and liars but this denial is based on 'drug' use even if it is 'just' marijuana. This is unfortunate but hopefully, this time next year we'll have a positive report from Sheldon'sgirl with their approval. Keep your head up Sheldon'sgirl.

First of all, is there any proof he smoked weed? Did he admit to it? Even if he did smoke it, his blood test will show clean after 30 days. But you should know they are quite serious about the weed thing (assuming they can prove it or he admits to it).

If you have the bucks, maybe it is time to consult with an immigration attorney.

I am not trying to be rude and I know this is a difficult time

marijuana is a schedule 1 drug. it makes no matter what states are doing. a schedule 1 drug has no purpose, recreational or medical. there was a great error committed by not having knowledge of the consequences to admitting use of a schedule 1 drug

there are threads on vj about this and there is something on uscis or dos that I read last year about recreational drug use. it is something that your fiancée should have been asked at the medical and it is something the petitioner should have known in advance.

I am not trying to beat you down, just be aware for your next round of filing. you might want to just hop a plane, do the marriage thingy and then come back and file the cr1. by then the approval times should be dropping rapidly

again I am sorry to hear about your denial

and no I do not believe it should be as illegal as it is, but this is just the way the law has it pinned

there is no appeal for class one drug use. there is a 1 year ban incurred with no way to bypass it. There is absolutely nothing an immigration attorney can do to help
