    This doesn't make sense. Residency is for people who live in the USA. By not living here for 7 years she has abandoned residency whether she likes it or not. Residency is not something you can choose to keep if you move overseas.

    I work in a bank. Based on my experience with check deposits and cashing, the legal written amount and the number amount appear to be different. In order for the bank to accept the check, they need to be the same amounts. Looks like "nine hundred eighty" instead of "six hundred eighty". That's probably the reason they sent it back.  Just write your next check out a little more clearer and you should be ok.

    So she doesn't have her green card yet? Do WHATEVER it takes to pull your affidavit of support... Get an infopass appointment, send a letter, call them. If you pull your affidavit then you don't have to worry about what to do at an interview. If you aren't successful doing that, tell her you aren't attending the interview and don't go. WHATEVER you do, do NOT lie.
     
    I do have one question for you, why are you still married if it's been 10 months and she hasn't lived with you and doesn't intend to?

    Oh, I know. Try explaining it to what I call "normal" people. You know people who don't deal with long distance and have no understanding haha. Not meant to insult them or us in anyway though. My family, friends, coworkers always ask "ugh why can't Stephen stay longer?" as if it's up to him like he is the one doing the deciding. I'm like hmmm well he can go back for a few months or he can overstay and get banned for up to years and pretty much screw his chances of ever getting to stay permanently.

    The US Embassy does not consider invitation letters for visitor visas.  Your finances are not considered.  Your wife and son's passports are not considered.  Your daughter's birth certificate is not considered.  There is no document that you can send that will be considered.  Your SIL applies on her own.  The interview will be about her demonstrating strong ties to overcome the legal presumption that all applicants intend to immigrate.  Anything from you and your family is about the US.  It's not about her having to return.  Focus on the reasons why she has to return home rather than the reasons for visiting.

    I'm not sure on the best route for you in terms of visa, but I just wanted to clarify that if you do (correctly) apply for a Green Card for your MIL it is to make the US her permanent residence. There are a lot of stipulations for being a Green Card holder, but a big one is being in the US for AT LEAST 6 months a year, and that's if you're pushing it honestly. If she is out of the country for over 6 months she has to get re-entry permits, and if she's not in the country more time than she is out of it, she would risk a very tough entry at the border with the potential for her to lose her GC and face a long term ban on entering the US again. 

    If she wants to live in the US then by all means apply, but a Green Card is not to be used as some sort of glorified tourist visa.

    Incorrect, the date of the wedding has nothing to do with it. The date an individual officially becomes a resident is the key.

    you don't qualify for advance parole, advance parole is only used while waiting for interview for GC
    you are ok, as long as you take the extension letter of 1 year and your expired GC, everyone removing conditions travels that way
    the person that said that to you has no idea of removing of conditions

    This is the same as if I were to tell you to give me $500 and I will get information from the USCIS. The lawyer may have someone on the inside, but I doubt it. Your congress critter is the best to see what is going on with the I-751 petion. Filing the N-400 will force them to make a decision on your ROC before you receive your USC. Save the $500 you would pay the lawyer and apply it towards teh N-400 application.

    It doesn't matter either way. A cover letter isn't required, just something prepared by applicants to summarize what's in the package for the officers' convenience if they want to look at it. So, either by you, your spouse, or both is fine! Good luck on your application!

    Sorry about all this. There is no Fraud here as far as USCIS is concerned. What you have is a unfortunate situation of a Divorce.
    There is nothing to stop her from taking the child or you for that matter but, unfair to the child. If you can't split peacefully with joint custody please try hard for this. If your both childish.... Then be fast and get a Attorney before she does and plat stupid games. What you have is a Simple USA Divorce procedure.

    I get what is called a lease addendum, which only shows the important info such as the persons who live in the apartment and the amount of the rent. Most people get something similar with their apartment lease and it is highly unnecessary to send in so many pages. As suggested previously, send in the relevant part of the lease, i.e. the names of the tenants and such. They don't want to see pages that talk about your legal rights if you fail to pay your rent.

    It is really, really, rare for I-751 waiver applications to be denied. There can be RFEs and interviews but it's almost certain to ultimately be approved as long as the marriage was genuine, even if the evidence is scant.

    Much of that is unnecessary and/or irrelevant. You don't want to confuse USCIS.
    Marriage certificate and passport are unnecessary, they already know you're married and what country you're from.
    W-2s are irrelevant, they care that you filed taxes as married (evidenced by the transcript), not how much you earned.
    All the university stuff C,D,E is irrelevant.
    Copies of USCIS letters mailed to you? Are you serious?
    Shared cellphone bill is good. There's not a lot of point in the bills where only one spouse is listed, except as proof of address, for which you already have other evidence.
    Jewelry store receipt proves nothing.
    Make sure the joint bank account statements cover the whole duration of your marriage (e.g. one statement for every 6 months)
    Are you and your spouse on the same health or auto insurance? Are you each other's beneficiary on life insurance or retirement accounts? If so, include evidence of that.
