    Jay-Kay, I can't provide a link to my own personal experience. I do think that it is wise to allow someone's actual experience to carry a little more weight than just to be labeled as 'lots of misinformation'.
    Tracy TN, there was absolutely no mention or question of which country did I come from during the entire process I went through in order to confirm that I did not need the actual I-94, but that the stamp I and my K2 received in our passports was sufficient.
    SS were satisfied with the stamp, and I applied for my SSN within 1 week of arriving.
    The CBP staff at Peace bridge, where I had originally been told to apply for the I-94 by a an answer on my post here on VJ, using the same link you provided to the OP, told me I didn't need one the stamp was it.
    The fellow on the counter at the info pass counter at Buffalo said I wouldn't need the form, the stamp was it. When I insisted on hearing that from someone other than himself his supervisor said I had the stamp and that was sufficient.
    Our congressman's office liaison confirmed that we would not need the form, the stamp was sufficient. She also confirmed that the supervisor I had spoken to had worked within USCIS for 20 years and was a very reliable source of information and as she had confirmed I would not need the I-94, just the stamp I let it rest at that.
    So having spent a numbers of hours in phone calls and an entire day in Buffalo NY, trying to get a straight answer, I accepted that - I didn't need the actual piece of paper, the stamp was sufficient, and not once was I asked what country I was from, whether it was a VWP Country or not.
    There is not always one way of doing things with this process, so be careful to label other people as misinformed when they are talking from their own experience.

    if you don't have the I94 than you should at least have a stamp which is in the passport on the page of the visa, part on the visa part not. It should be dated and signed by the CBP agent. Social Security will accept this as equivalent to I94 and you should be able to use the copy of that page in place of the I94 when you apply for AOS, including a statement that you were not given the I94 on arrival.

    Just thought I would add a note in here for future readers.
    I was surpised to find that Grace Removals will ship 2 cubic metres of stuff for $1450 plus 3.5% of value for insurance. this includes them coming out here and packing all the gear, creating an inventory, shipping and then delivering to my NY home and unpacking and removing packing debris. WOW! I was so happy with that price and it's amazing what you can fit into 2 cubic metres. It will take 3-4 months to arrive but at that price I can wait.

    I care more about not breaking the rules so that everyone has it easier. People who break the rules are the ones that make it harder on people who always try to play it straight. I don't try to find loopholes to help myself do things. Yes, it makes me angry when people do that, so if you're genuinely not, while it seems like you are, I apologize for getting upset. I just is one of those things that makes me automatically angry and annoyed.
    You're looking at possibly getting a ban, which BAFFLES me as to why you would want to do that. I just cannot process WHY you would jeopardize your visa journey. Like I said, i get that being apart sucks and I spent my fair share crying when it happened, but it's just a part of the process. It's just a suck it up and deal with it type of issue to me.
    It is 180 days per 365. The clock doesn't reset at the beginning of the calendar year. There is some debate in the Canada forum as to if it's per calendar year or per 365 however. I've seen people get away with per calendar year. But getting away with and being legal may be two different things.

    I find it fascinating that the only people who are talking AT ALL about impeachment of the President are those who are either a Democrat or a backer of the Democrats. The republicans are not planning to impeach the President and have said so in Congress... I also find it interesting that the democrats are using the "Impeachment" news as a wonderful way of raising money. I wonder if their expenditure of the money received has to be accounted for...

    Sometimes it is easy to miss the really important issues when we get caught up in the hope of an ideal situation.
    Some children grow up never knowing one of their parents and they are still happy, well-adjusted people. What is most important is that the parent they are with loves them unconditionally.
    I hope you have the time to think carefully about your future, and that of your child. The child's father can always come over to visit his son. If you no longer want to marry him, what would be the point of totally uprooting yourself, leaving job and family security, friends, everything, so that your son can see his Dad sometimes...

    Haha as an Aussie I have to comment here!
    Partner typically means "same-sex" partner in Australia as well. Some of the older people use it for their bf/gf because the term boyfriend or girlfriend isn't serious enough to explain their relationship.
    Also, Australia recognises defacto couples. You wouldn't really be a spouse, but in that instance you could conceivably call yourself a partner, especially because you have to go through a type of "divorce" process to split possessions etc.
    Honestly though, I only ever said bf then fiance and now husband because "partner" to me usually means "same-sex" so I didn't want that confusion
    **Addendum - depending on what state you're in this makes a difference too. Some of the inhabitants of certain states (which shall remain nameless) are odd

    Anti-Semitic attacks in France consist mostly of neo-nazi or anti-Israel punks defacing synagogues with swastikas or arson. This is not the pogroms!! It is not grounds for asylum nor SHOULD it be. Honestly this whole post is ridiculous and makes zero sense. If you aren't trolling and really do have a fiancee in this situation my advice if she doesn't want to go back to France she should go to Israel where they love frivolous asylum claims as long as it's being made by an Ashkenazi.

    Ok, so entered, got married, entered with intent to adjust, attempted to adjust, got lazy and couldn't even go to her own immigration appointment and was presumably denied.
    It doesn't seem as though your fiance has ever paid any attention to immigration before, why now?

    While I can't speak to what the intentions of other are or were. I do agree that the ability to adjust from a tourist visa or the VWP should not be possible.
    Closing this loophole will require an act of Congress. So if you want to see it happen, write both of your Senators and your Representative.

    I dislike there are people on here even who rather blatantly advocate coming in on a VWP and adjusting. Saying oh well, how can they prove it, intent will mean nothing, etc.

    It is like a family tradition on my father's side. I also lived in a town with a lot of Brits and Irish FOB types and many of them did the AOS through VWP (knowing that they would AOS). There is also a lot of "marry the first American who is decently ok" type of thing, which while it isn't super fraudulent is rather morally dubious in my opinion.
    I know that we do things the right way and I can live with myself for that. As soon as I know other people behave in illegal or morally iffy ways, I make up my mind that they are people I don't want around me.

    I am not here to ask advices or anything..
    Just want to share that my husband passed away this morning... peacefully... he had brain cancer and we have been fighting for more than a year now... there was a point in our fight that we thought we are winning... but we lost... i am just thankful that he passed away peacefully... in his sleep, and i got the chance to tell him everyday that i love him... and that he is my love, my life, my world, my home and my everything...
    Whenever I read people here posting marriage not working out, just using me for greencard, giving up... and a lot of things... i am so sad...
    I found the perfect husband... the perfect person... and yet he was taken away from me in such a short time...
    I promise I will honor his name... i will honor our love... and I do not think I could love other person as much as I loved him... and still loving him... my love for him will not die until my last breath...

    Unfortunately that has just the wrong appearance for USCIS: overstays tourist visa, gets married, but has no solid evidence of bona fide marriage relationship. It even sounds like the B2 was more or less being used as a fiance visa, which is also problemmatic. If you try to prove up on the relationship by saying you were coming to stay with your fiance that you met online with a B2 visa then you've really blown it.
    It doesn't sound like your husband is going to want to file for adjustment of status on the validity of the marriage. The business of just discovering the tax debt and driving illegally on a daily basis is pretty alarming insofar as not knowing this guy very well. The driving must be from losing his license somehow. Drunk driving is the most common reason for that, and if they catch you driving again when it is suspended for that it's another criminal offense. Whatever it is, it sounds like distancing yourself pronto from this person is a good idea and since adjustment of status looks unrealistic with what you've said - it looks like going home is the best legal option.

    Three days after I got here, me and my wife opened a joint account together. That depends of the bank, we were not even married and were able to do that and it's the account we have been using. Check with another bank that doesn't give you a hassle, she just needs her s.s. card and two form of identification like her passport with the visa she used to enter the country even if it's expired and a debit card from another bank (that is what we used for me).

    First, someone that enters with a K-1 is eligible for an SSN right away. You do not have to adjust status first to get an SSN.
    Second, there is no deadline to file for AOS. You must marry the petitioner within 90 days of entry to fulfill the terms of the K-1 visa and be eligible to file for adjustment. Once the I-94 expires, then they are out of status until they file for AOS. AOS is not filed by the spouse either. The only form that is filled out by the spouse is the I-864 affidavit of support. Without the I-864 from the USC petitioner/sponsor, they cannot adjust status. Also, if called for an interview, both must attend together and prove the marriage is real and valid. It is the only way to be granted permanent residency.
    You are not authorized to work with just an SSN. You must also have an EAD(employment authorization document) or a green card. He has been accruing illegal presence for 4 years as well as working illegally.
    He needs to find a really good immigration attorney. Not just any lawyer, but one that specializes in immigration and has a reputation for solving/winning complicated cases. See what the attorney tells him. This is beyond the powers of DIY.

    CBP shares data with USCIS.
    There's some batch processes that match up data, run every month or so.
    In time, USCIS will have learned he's left the USA.
    Since he's left the USA, he's abandoned his green card application (per USCIS, btw, not me)
    So, what to do, to come back?
    1. get into CDJ IV, ask for a re-entry permit, explaining the circumstances. He may or may not get it. or
    2. File the I-130 this week. The good news here is that the casefile will get sent to MSC, and they are approving I-130s there within 90 days. You'll have more work @ NVC, but it's Electronic Processing for a CR-1 at NVC for casefiles with interviews at CDJ, so it's possible to go fast as well, receiving an interview date immediately after case complete at NVC, actual interview within 20 to 30 days of finishing up at NVC.
