Thank you for your reply. Actually, we never reached the interview stage. My fiancé filed the K-1 petition at the end of October 2024. While waiting for NOA2, USCIS issued an RFE for a divorce decree copy, because he lost the original. We submitted the copy, but about 4 weeks later the case was denied. So the denial happened at USCIS, not at the consulate interview.”

USCIS hardly ever asks for originals....normally, they would need a copy.  Regardless, the ball is now in the US citizen's court.  He must refile a new I-129f or you must marry and meet before starting the spousal visa process.

The problem is my fiancé feels he is too old now and does not want to travel such a long distance to get married for the CR-1

What's the age difference between you both and which consulate? Just wondering if that might be difficult to overcome anyway, even if you refile with the correct documents.

Hello, my K-1 petition just shows “Denied” on USCIS case status (August 19, 2025). I have not received the denial notice yet, so I don’t know the exact reason. Can anyone share how long it usually takes to get the denial letter, and if I should wait before deciding between appeal or refiling? Thank you.

Did you meet in person within last 2 years before petition was filed?

I agree if he does not want to follow through there is not much more to be said

Thank you for confirming my suspicion...

Maybe you or your spouse weren't free to marry in the eyes of USCIS

  • Thank you. The problem is that my fiancé doesn’t want to travel far because of his age. I’m not sure if he would agree to the CR-1 process

Does he want to be together?

Is desire to be together stronger than his desire not to travel?

For either route you need to meet and spend some time together.

I am the beneficiary. The US citizen petitioner is my fiancé.

You, the beneficiary , will not receive a notice of denial.   USC ,  the petitioner, receives notices

sounds like his divorce document was not an official divorce decree

you can actually do a online search by typing his name into google to see if it shows as married/ if you know his SS# also that helps look info on him

Your K1 wasn't denied. Your I-129F was, likely due to the response to the RFE not meeting USCIS' request.

Are you not able to travel to the US and marry? You can do this on a tourist visa but you CANNOT then stay to adjust status. If travelling on tourist visa for the purpose of marriage, you MUST then return to your home country to start the spousal visa

But, it does not sound like your fiance really wants to pursue your relationship. Many of us here have made huge sacrifices during our visa processes. If you have a genuine relationship, then you will find a way to make it work. If one side refuses to make an effort, then I suggest you move on with your life.

Maybe the age difference is too great and that’s why the interviewer is denying it?

I doubt the age difference has anything to do with it. It never got to the interview. Most likely the Divorce Decree was lacking.

I was asking about it for any future application.

Update from me:

I saw the kind replies from everyone but couldn’t reply earlier because I had just joined the forum.

Let me clarify my case details here:

  • We filed I-129F at the end of October 2024.
  • We had met each other before, around May 2024.
  • In June 2025, USCIS sent an RFE asking for a divorce decree copy because my fiancé lost the original.
  • In July 2025, we submitted the requested copy. However, the name on the document (Jim vs. James) was different, which I think may be the reason for the denial.
  • In August 2025, our case was denied. We are still waiting for the official denial letter to know the exact reason.
Thank you so much for your advice and support
