Timeline

I would like some feedback, bcs my I-129F petition was denied and my fiancé wants to do the CR1 visa now! My question is will it be easier for us to get approved for our CR1 petition than the I-129F petition we got denied for? Not only did they deny it, but it took them more than 3 years and 4 months to deny it. My fiancé had our first baby together back in November of 2022, and we want to be together as a family bcs being apart sucks. Any advice pls feel free to let me know.

AWA related cases are not really DIY, Lawyer time.

Why was the case denied?

I agree, this cannot really be answered without a few more details as to why the I-129F petition was denied.

I-751 ROC Submitted: 2016-12-20

I-751 NOA Received:  2016-12-29

I-751 Biometrics Appt.:  2017-01-26

I-751 Interview:  2018-04-10

I-751 Approved:  2018-05-04

N400 Filed:  2018-01-13

N400 Biometrics:  2018-02-22

N400 Interview:  2018-04-10

N400 Approved:  2018-04-10

Oath Ceremony:  2018-06-11 - DONE!!!!!!!

Marriage does not cure all fiance case denials.  More information needed.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Post history indicates AWA, plea bargain, misdemeanor battery.  Only a very good attorney can help at this point.  Marriage alone and CR-1 will not be enough.  OP, maybe it is time to consider moving abroad?

I agree now with @carmel34 and @Boiler, if this petition was denied due to an AWA issue, a lawyer is needed for the spousal visa.

I think the USC should just move there.  
 

Yes, you could try for a CR-1, but it will be at a great cost of time and money.

What extra steps did you take to be able to provide evidence that "I'm not a risk to my beneficiary or any derivative beneficiary"?

 

Also, I am not sure I read the timeline of your story properly, but if the victim of the offence(s? - not clear how many convictions total) was a spouse you previously sponsored, this might add a layer to their reticence. 

 

I agree with others, you need to consult with a specialized attorney and see if your plan to live together in the US is realistic.
