I90 name change denied

I'm hoping this is the right thread for this.

 

CR-1 holder. January 2021, I submitted form I-90 to change the name on my GC to my married name. Biometrics done June 2021. February 2022, I lost my GC. I read that I have to carry it with me at all times and I lost the card holder with my cards in it. April 2023, I still haven't had an update about my GC so we contacted our senator. Today, we received notice that my application was denied. I've attached the letter here. Can someone explain better what their reason is? It seems tied up to my ROC application made in August 2022 but I was only applying for a name change. Should I have submitted another I90 form when I lost my GC? It didn't make sense to me to pay $500 for another application when I already had one processing and at the time I was hoping that the updated GC would be back with me. I just really want to go and visit my family as I have not seen them since the end of 2020. TIA.

You Green Card is now expired.  They will not issue an expired card.  If you need proof of your status for travel, call USCIS and request an ADIT stamp.  You'll have to wait until your I-751 is approved for  a new Green card (unless you obtain citizenship).

Your timeline says you were married less than 2 years when you became an LPR.

 

Once your 3 year gc expires, or once your I-751 is filed or once I-751 is eligible to be filed, you are not eligible for I-90.

Thank you. That is frustrating since I applied for the name change with 20 months left on my GC.  I am glad I did not submit another application when my GC was lost. 

Do I need to have an emergency for the ADIT stamp appointment? When I tried in the summer of 2021 to get an infopass appointment I was told that it was emergency only.

No.  There is a new program which allows USCIS to mail you an ADIT stamp.  Call USCIS and ask for a tier 2 officer.

i never brought my GC ever. i know as an LPR u have to carry it all the time. but if i lost it? 2 years USCIS purgatory, no thanks. it stayed at home locked.

I think carrying a copy is a good idea.

I agree, it's too valuable to lose it. Too much pain to have it replaced.

What proof of name change did you provide when you applied for the new GC… my understanding is that you cannot apply for a new GC with name change if the paperwork you submit precedes the last immigration benefit your received…. 
so, unless you indicated your name changed AFTER you received your initial visa/ CR1 visa the i90 would be denied…

maybe it would have been better to apply for name change with ROC… but most VJ posters suggest changing name when applying for citizenship as that is path of least resistance…

What type of name change? If you wanted a name change that is more than just switching out your last name for your spouse's last name, you need to go through court to get a name change. You can then use that name change document to update your IDs, SSN, greencard etc.

I lost my green card when I was abroad - which meant I had to have it with me, can't leave it at home for travel - and it was very hard to get back to the US and then another ordeal to get the ADIT stamp when the I-90 is taking years to be done. It happens and USCIS should be the one feeling bad for taking over 20 months to produce a card. Can you imagine going to the DMV and hear that your state ID it's going to take 1.5 years to be done? It is very stupid.

 

But now ADIT stamps are mailed and hopefully not to hard to get so you should have an okay experience with it. Stuff happens, people lose things, get mugged, have their house caught on fire or flood - don't feel bad that USCIS works at a glacial pace. Please update when you get your ADIT stamp!
