I need some advice on what to do with my K1 Interview/dates

Hello,

I'm just about to send my email off to Montreal consulate as instructed in Packet 3, They say within 6 weeks I should hear back and I can go ahead and schedule interview & medical after... Which is great! but here's my dilemma.

My brother is getting married this September and It's my understanding that once I enter the states I have 90 days to marry, Then once we file for AOS I will be unable to leave again until its complete, So I wouldn't be able to make his wedding back in Canada.

 

Can I complete packet 3 and then just schedule the interview for around September so that way I can attend the wedding and then proceed to enter US afterwards, I just don't know if waiting that long to schedule interview or anything will cause problems.. My brother understands if I can't make it, but it's really important to me not to miss my own brothers wedding and it would really suck to miss it, but I will if I have too, I just hope I don't.

Or is it possible to leave USA when your there during a pending AOS? Just don't know what to do.

You have 6 months to enter the country after your visa is issued. You can book your interview for May and enter the country immediately after your brothers wedding. 
 

I would also consider what is more important to me as well.

Have you checked the Canada forum to see how fast K1's are getting their interviews? 6 weeks seems super fast to me but again I haven't been keeping up.

Thank you, I didn't know you had 6 months.. That works out good then.

You have 6 months (maximum) from the date of your medical (NOT the visa issue date) to enter the US with your K1 visa.  Once you use the visa, it is invalidated.  Remember, K1 is a single-entry visa.  After you get married, you are free to leave the US whenever you want, BUT you cannot legally return to immigrate without one of the following -- a green card, a valid advance parole, or a new CR1/IR1 spouse visa.

You have 6 months from your medical appointment, NOT visa issuance. You can apply for advance parole, but there's no guarantee it'll be approved.

Okay thanks.

It should work out then, Because I won't have my medical until a few days/week before my interview and that will likely be a few more months... Which will make 6 months enough time for the wedding.

Interesting. NVC should update their website if that’s the case because this is what it says

Yes. It's something they're not clear about. But medical is only good for 6 months. My fiance did his medical Sept. 29 and interview Nov. 10, but his visa expires March 29.

They might get back to you within six weeks to give you the ok to schedule but with Montreal I would highly doubt that you'll need to worry about missing your brother's wedding. Unless things have drastically changed Montreal is super backlogged. 

But as others have already said, you have about six months to enter. Don't cut it super close tho, you don't want to risk running out of time.
