Op, nice of you to try and make the process 'painless' for your soon to be ex. But the way you were thinking of it by not telling USCIS of the divorce will actually make the process 'painful' for him going forward. Do as others have suggested, divorce quickly so your spouse (ex) can convert his current ROC application to a divorce waiver with the divorce decree.

Good luck to both of you.

However, the sooner you file for divorce and finalize the divorce proceedings, the easier this will all be for him.

This. I think you got really good advice on the stay quiet part (don’t do it). The most help would be what @beloved_dingo stated: file for divorce so that the divorce decree comes in in time. Since yours seems to be an uncontested divorce given the friendly terms, it will most likely be a quick process. A quick google search put the ballpark for that within 45-60 assuming that you still live in GA. Good luck!

Does he speak English? If so, he can make an account here and ask all the questions.

There might be a conflict of interest. Or if you make everything for him and there's a mistake or delay in his case, he can blame you. You don't think he's going to do that now, but I have seen things going south in a divorce pretty quickly.

You are not helping him by spoon feeding him imho.

Divorce, let him handle it. Write an affidavit as I told you before, sign it, notarize it, and that's it.

PS: Even if you divorce, you're still on the hook for his I-864 until he either works 40 quarters, naturalizes, or passes away.

Damn, I’m not just gonna throw him out to the wolves like that #######. I brought him here, I did everything, the least I could do is help him with this process. Once he gets his 10 year GC, then he can figure it out.

She didn't say anything wrong, she gave good advice. If you really want to help him you divorce him as soon as possible and hand him the divorce decree. That's how you help him.

Divorcing him ASAP and letting him continue the process without you with the divorce decree is the best thing you can do for him; the marriage was bona-fide so he will get his 10yr greencard.

The worst you can do for him is not letting USCIS know you guys divorced resulting in all sorts of future problems for him. Letting USCIS know is NOT throwing him to the wolves at all; it's standard procedure.

Making an account here and telling him to figure it out is not throwing him to the wolves!!! You’re seeing this in the wrong way… When you submit the divorce decree it will be converted to a divorce waiver, and he’ll be on his own in his immigration journey. He needs to be involved too.
You didn’t bring him here, he came because he wanted to. Helping him means divorcing soon so he can have a divorce decree rather soon, and give him a nicely done affidavit on your behalf. That’s all.

Since you filed the ROC Feb this year, you got PLENTY of time (2-3 years) until interview/ decision comes, still don't leave it to chance. Use this time to get divorced fast so that you have the final judgement / decree. He can then amend that ROC to divorce waiver which essentially will have him granted the 10 year GC and your wish will be granted as well.

Hey y’all, long story short, we went thru the K1, did the AOS, and now we just filed for his ROC in February of this years. I decided to divorce in March. Nothing bad happed, I am just growing apart from him. He sacrificed his whole life to be here with me and I don’t want to pull the application. He deserves to continue the life he has made here. So my question is: Can immigration learn about the divorce if I DONT tell them? I would have to submit the paperwork right? If I never submit it and stay quiet, they would never know about the divorce right?? Everything we submitted proved that we were married at the time, so they would go based on that right?

btw, divorce papers are NOT filed yet. Wanted to file this month.

You’re very gracious and kind my usa ex didn’t file for me and I didn’t want to move to the USA we where together about 7 years and him and I are still good friends known each other 15 years now I was 19 when we met 21 when we married. He’s honestly a good Christian man .  I like to see people who treat each other well at the sad ending.
